  1. Just to start this - B'card repaid £60 of the £120 I am claiming and on 11th April I submitted a MCOL, unless they come back by Monday, I can file a default judgement on the Tuesday. Will keep you posted.
  2. The VAT issue is not something that concerns me, what does concern me is that Orange should have defaulted me at x date, but left it 18 months before doing so. The ICO has ruled this to be unfair but the question really was, can Orange amend the default date when techincally on the date in question they didnt default me.
  3. Hello, i hope someone can help me. I have a long running complaint with Orange. To cut a long story short they defaulted me after 18 months when they tried to reclaim the VAT from HMRC under bad debt relief. After complaining to Orange they let slip that accounts receive defaults after 6 months of non payment, not 18. I got the information commisisoner involved who have ruled that the information relating to the default (i.e.) the date was incorrect. The ICO have asked Orange to correct the data. However, can orange now legally backdate the default as surely this would be incorrect as on the date they will backdate it to, no default was issued? if it was incorrectly dated surely it is invalid? i mean a parking ticket with the wrong date on it cant be changed, its invalid. I am not sure where to go to now, ICO have no powers of enforcement and it seems like a court should decide. any ideas as this is affecting the chances of me getting mortgage
  4. funny you should ask. I sent my requests via the branch and heard nothing for nearly 40 days. as the deadline approached i sent them strong letters. i got a call out of the blue from the branch manager to collect my statements and they went right back to 1998. from microfiche i wondered why lloyds didnt bank the £10 cheque until today when i got a letter from the copy statement unit informing me that they dont hold the information requested. confused, I was.
  5. i havent made £25.00 though, they charged me that in a fee and i had to pay a further £30.00 via Moneyclaim. So I am a fiver down.
  6. The claim was for £60.00 so a) they have shortchanged me and b) i think it is about time Nationwide was brought to task, unless of course they compensate me for the distress caused.
  7. well claim was filed a while back and on Monday I could have entered a judgement, however as the 11th hour approaches, Nationwide have paid me £30.00 which I was claiming plus £25 instead of £60.00 I have decided to take my claim to the court and once and for all let Nationwide explain to the world how much the charges cost them.   8. Well after a long battle I got a call from the branch and my statements were ready. Just to give you all the info, the account was closed Oct 2006 and passed to a Debt Agency. I paid off a % to close the account. I have gone through the charges and they took £1,085 between this period. My first request letter will be hand delivered today. If this goes to MCOL stage they owe another £848 in stat 8% interest! Has anyone succeded in going back this far yet?
  9. Hello all I gave in my request, cheque and ID showing my address to the bank clerk on 22 March. I got the bank to copy and stamp it so I know they had it and could prove so. We are now day 30 something and nothing, absolutly nothing. I dropped through the same branch a letter on Monday threatening court action for non complaince and absolutly nothing. The account was closed 6 years ago and I wanted statements back to 1998. Can I take Lloyds to court for non compliance?
  10. My request for statements last June was ignored so I went into local branch on 22/March and handed them the letter and cheque. I asked for a copy of the letter with a date stamp as evidence of request. It is now nearly 2 weeks later and I have heard nothing. I can feel a case coming on to take them to court for non compliance. My request goes back to 1999.
  11. thanks, the request to remove the default was there all along. have pushed the button on the claim now but will write to natwest and explain all.
  12. Should i file a claim now they have agreed repayment but they refuse to remove the default!! despite the default occuring due to all their fees.
  13. Bounced DD on 01 March for a DD i didnt set up! Nationwide wont refund stating £30 is in line with other banks. I have been complaining all month and I have informned them again I shall issue a claim as soon as the charge hits the account. will keep you posted.
  14. i think all refunds are scheduled for nr the court date and never reviewed again
  15. My a/c was closed with them over 6 years ago however in the 18 months running up to it, i was hammered for hundreds of pounds of charges. anyone advice?
  16. just wanted to update you all. A while back it looked like cases were going to court and having received the difference between £12 and the charges, i said i would cancel the action if they paid me the court fee which they did. I left it a while, got a court date for the end of march and i cancelled it. However now I come home to find that Citicards have sent me £180 cheque, the balance of my claim. a wonderful surprise!

Hello I am helping a friend get some charges removed. turns out the account went £2.05OD and a month later the charges started to cause an overdraft and more and more and more charges (not transactions) made the account overdrawn. My friend moved and told the bank however in their eyes the notification wasnt complete so the account continued. It wasnt until a credit file was ordered did my friend realise a default had occured. can i get this overturned on the basis the penalty charges caused the default and what should I say? Your help as ever, appreciated:o
  18. well after a few cases it seemed i would only get awarded what i had already received. still £91.00 plus £30.00 court fee so not too bruised. not sure why they gave up fighting. still have barclaycard to work on now
  19. it was several weeks ago that i thought it was best to just write to them and ask for my £30 court fee back and cancel action. they sent a cheque and i banked it. previously they had paid the diff between the 12 and 25 pound. in the meantime, i received the court date today for March. do you think i should cancel the court or let it rund for a few weeks to see if citi do pay up the rest?
  20. It seems LTWFB has found fame in all our defences as being the case that lost. shame i didnt change my name to Mr Citicardsareawunchofbankers V Citicards. That would make an interesting line in the letter
