  1. Wait for the SAR post up the reults I sure someone will be able to help with a little more info to go on.
  2. They will have carried out tracing searches with the CRA,s and electoral registers. Any information you have given for instance for your move eg letting agents to CRA checks on prospective tenants and as we know even the DLA sells person details. If they have good reason to believe you are the debtor they are looking for they can carry out searches and place defaults The ICO says the data must be accurate.
  3. Use the DCA,s Office address to return mail if you use the return address on the back of the envelopes from my experience they get lost in a dead letter section so any letter you write gets lost.
  4. Print out a copy of your file with Experian I would also check Equiifax and send to the potential lenders, also formally request them to give a full explanation of the refusals. The alternative is SAR the CRA and the banks although it's £10.00 each.

  6. breaches of OFT guidance Section 2.4 (b) may apply as may 2.3 implying the threat of legal action 2.6 (i) disclosing matters to a third party 2.6(a) unreasonable contact frequency and times. 2.6 (j) acting in a way likely to be publicly embarrassing eg the calls your work place. I would suggest reporting this to the OFT immediately.

Ask for the compo and apology if they don't comply threaten them with court action, use the word I WILL TAKE COURT ACTION for The harassment and distress, give them a reasonable figure you require (£1500.) in my exoerience is a good starting point) If no response send letter before action then take action. This one of the worst cases of work place harassment I have seen.

  10. Hi all, I have a feeling that even the ICO is or has become biased towards the CRA's. I quote from a letter from the office . ''The 4th principle of The Data Protection Act says that personal data mut be accurate and if necessary updated. As searches on Table 1 are clearly marked for outstanding debt information relating to these appears to be accurate, wheather or not the data is recorded in any table the searches relate to is not necessarily an issue for the ICO as long as the data recorded is accurate the CRA will have complied with principle 4.
  11. Hi Vic, The case I handled I supplied info with a checkable footprint only to see the same info used by 2 other DCa's within a matter of a couple of weeks. Perhaps this info is passed around as they farm out debts to other DCA's especially when dealing with stat barred.
  12. I would never supply I & E details did so once on behalf of another and discover the information had been ''shared'' with another DCA.
  13. In my opinion it proves that you applied for the card not that they actually issued one. The court case dealt with I believe with an agreement that was mislaid not a non existent one. you could try SAR to Cap1 I would write to say debt remains in dispute until the break down of the fiogures is provide send RD of course.

  15. This would seem like you need some professional help, as you have wrongly declared some non taxable income and HMRC has neglected to see (or want to see) the error. I don't believe pension credit is taxable. Also if your sister had a works pension the wrong information may have been given directly to HMRC by the pension provider and due to the horrendous foul ups at HMRC it could be ongoing. A word in your MPs ear might help to. Have you tried http://www.hmrc.gov.uk/complaints and appeals?

These searches are carried out when you open a new account or become a trustee of a registered charity as an officer who would have access to the charities account and as a generic check to show you are who you say you are. As chair of a couple of charities I get this king of search on a regular basis with no effect credit reports.

Of recent experience I have found that the OFT and the ICO now seem to believe that it's ok for DCA's to search Table 1 '' If the DCA is reasonably sure that thet have traced the correct person for whom they hold an outstanding debt''. This goes against every effort that CAG has put into try and make the system fairer. The reasoning is based on ''The 8. Principles of reason and good practice'' The 4th. being that the data processed is accurate.
  18. Hi, Has your sister had any other income that should have been declared at the time she claimed her pension? Has any court action taken place or been threatened regarding her tax affairs before she got her pension?
  19. Hi247orbital The Brig hasn't been gagged just major neurosurgery on spine and loss of feeling in hands.can't hold a pen or type to well yet. All the searches have been removed from CRA's The MP is still asking questions about them and the use of DCA's for collecting benefit over payments etc. Plesed to see the advice and responses are a good as ever.   20. I am awaiting a decision from ICO and fos on these entries on equifax and will post up the results. ICO has said that they would only expect to see legitimate credit applications on Table 1 searches on a Equifax report, the new format is '' misleading''.

Any deductions from current or future benefits is controlled strictly to avoid hardship, the usual practise is if no social security benefit is being paid and the overpayment is stat barred the DWP will ask at set periods if there is any change of corumstances,but the debt stays live and due if a social security benefit is paid, this does not include state retirement pension.
  22. Complaints to IFO,OFT & Consumer Direct, Phone FOS and ask their opinion. All this could count as the creditors final response.

  24. Hi Gerald, MH paid up,Lowell have ceased to answer letter as do Equifax, so I've gone to the FOS who are n the Equfax case now. The ICO has put a specialist investigation team on to the have 80 days (About 60) left. I also put 1ST credit Connaught LCS and Priestley under investigation by the SRA so been quite busy.
