  4. Hi, Sorry but Barclays are correct in this, because you were discharged in 2007, any ppi claims will go to your Official Receiver and the sum of £1,600 would be distributed to your then creditors. I know that the £1,600 would have been nice. Stigman
  5. Hi, Sorry to hear about your loss of your father. I agree with Bazooka, you because your father has unfortunately passed away, the tax exemption no longer applies so you need to inform the DVLA and tax your car and pay the appropriate fee. I do not know if their is any rules that allow you to use this exemption for a specified period of time to clear up your late fathers affairs. Stigman

  7. I have been moaning about standing charges for years, they say it is for the cost of supplying your home with electricity/gas that we purchase but... Supermarkets provide us with food to purchase but do not charge an entry fee. Just one example. Stigman

  10. Have you sent Lowell's a CCA request? Do you have all of the statements? If not send Vanquis a Subject Access Request to get all of the info, maybe PPI and as it is defaulted loads of charges to reclaim back. Do not ask any Reclaim Company to do this, you can do this yourself for free, any help in how to do this just ask away. Have you checked your Credit File, is Lowell the owner of the debt? Ok, after Bankruptcy if anyone chases your Brother in law for debts before his Bankruptcy date other than a few exceptions like the example above then just refer to whoever chases to the Bankruptcy number and Court The Judge will give your Brother in law a talk about do you understand the implications, please make sure he does and that he has talked to someone who can spell out everything. It's not like on TV, you all sit at a table in a room. Stigman
  12. Tax debts can be included as well as the Council Tax. With the tax debt was he in a Partnership with another Business Associate? Only thing that cannot be included are amongst others any Social Fund Loans and Benefit Overpayments. Stigman
  13. Your Brother in law can go back to Court and ask for a variation in payments if they are too high and causing him financial issues. Bankruptcy will effect your Brother in law if he is employed or going to be employed in the financial or security sectors, it even effects him if he is a Governor at a local school (until discharged) so he will need professional guidance.   15. Is the debt still showing on your Credit reference Files? If so, place a notice of correction against the debt on your credit reference Files. If you have been declined either a Mortgage, Loan, Credit Card or Employment because of this default marker then you can sue for compensation. Can you just confirm please you said that MBNA sold your account while in dispute but you did not owe the debt? Stigman

  17. Hi, You are under no legal obligation to supply any personal medical or financial information to any DCA, the only person who can order this is a Judge. You have not said what the debt is for? Have you checked that the debt is fully compliant and Lowells have the legal right to collect the debt? Only ever pay what you can afford, if your off work and on a reduced income due to ill health then pay only £1 per calander month. Pay only by Standing Order, never pay by Direct Debit or Debit card as the amounts can be varied without your knowledge. Stigman
  18. Please do not go down this route, although the op must feel that way personally the op must keep everything in writing and hopefully legally so we can all continue to advise/learn. As to your complaint to the workman, complain directly and in writing to your Council, they are the ones that have contracted the workman so the Council are fully liable for any damage that their sub-contractors cause.   19. Hi, The final letter from the Bank will be either a Final Response or Deadlock Letter to take it to the Ombudsman. I would send the Ombudsman as much information as you can, include a timeline as well so they can see the full history. If sending via post, send copies only, NEVER send originals. Stigman
  20. Hi, When you asked for a copy of the CCA, I take it this debt is either a Credit Card or Loan? If it is either then... First thing to do is stop paying until you get a fully complaint CCA request. I'd personally stop all payments, ignore all correspondence unless it is a claim form. Not complying with a CCA request is a fully valid defence because the date is pre March 2007. Stigman
  21. Be nice if Barclays would give you the option of increasing the font, I have increased the font on my phone but the app loads in such small font that if you use reading glasses (like me) then you need these to operate the app correctly. Stigman
  22. You need to get your father to cancel the Direct Debit and pay via standing order only. A Direct Debit's amount can be varied with no knowledge to your father until the money has left his bank account, a DCA will not care if a 68 year old man goes hungry. If your father is on a low income then drop the payment to £1 per calender month, if your father has only £5 per month left spare then he is entitled to some spare money £4 per month for emergency expenditure. Yes the DCA will start kicking and screaming threatening Court etc.etc. but a DCA shouts the loudest because they know full well that a DCA is at the bottom of the receiving pile when it comes to paying bills and creditors.   23. Just one of my drugs costs £1,408.56 (Taken from the nice.org.uk website) per month, this excludes 7 others including Morphine and Tramadol. Stigman
  24. If it is continuous usage then over time the Paracetamol will become less effective as the body accepts this as the norm. Just buying Paracetamol endlessly is not the solution. Stigman
  25. You really need to book an appointment with your doctor. If you require the maximum amount of Paracetamol every day then you need to book an appointment so your Doctor can prescribe you effective pain relief which is also correctly manged in your best health interests. Stigman
