Had a letter in the post yesterday from Egg. My first in 12 months. Its an absolute notice of assignment to "Britannica Recoveries S.a.r.l, t/a Arrow Global Receivables Mgt Ltd." Background: I defaulted on this loan in 2006 and entered a CCCS DMP with Egg which CapQuest administered 'til 2010. In 2010 I complained to the FOS about PPI and this complaint remains unresolved as Egg have failed in their duties to pay the compensation and provide PPI calculations etc. The FOS are presently chasing Egg on fulfilling the adjudication - which has only partly been done despite it dating back to March 2011. During the early stages of my dispute with Egg they tried passing to Fredricksons who passed it back to Egg after a couple of letters. I am paying Egg £20 pcm at present, on an affordability basis, and have been doing so with no problems for over six months now. I'm worried that they will start getting heavy and harrassing me, just like CrapQuest used to. At present although the FOS have adjudicated against Egg on the PPI Egg have not paid all of the money due and have ignored requests to do so. Understand from a neighbouring thread that Fredricksons and Brian Carter will now get on board and make my life horrible. So any suggestions as to best tactic / approach to take?

and what are freds like with F&Fs? nothing less than 75% or do they accept lower? Stagparty, I've started my own thread as don't want to hijack yours. Feel free to hijack my thread if you want though mate as we're all in the same boat being 'shelled' by Egg

I've received an IDENTICAL letter ref my Egg loan too. In my case the account is in prior dispute. Hasn't prevented Egg assigning, full blown absolute assignment to Arrow. Looks like they're selling off all of their defaulted accounts to Arrow in one fell swoop. So, have to ask, what are Arrow like to deal with?

TBH they process financial diassociations fairly promptly

I did wonder why my score had flatlined at 900. seemed an odd score. makes sense now. not that their scores mean diddly sqwat in the real world anyway, but in rip-off-Britain-land the CRAs scoring earns them millions each year from gullible people, like me, who thought it had some sort of recognition by lenders.

What legislation? There is no legislation of the CRAs. Time to introduce it mate and I think the best tactic is on the European Human Rights front. -

Good and correct observations. I do not believe there is a statutory 6 year period for CRA reporting. I believe they rely on the 6 year limitation period under the Limitations Act 1980 (Wiki link here http://en.wikipedia.org/wiki/Limitation_Act_1980) I gather that the CRAs rely on this and I believe it is backed up by the OFT guidelines etc. May be wrong. Probably am, dunno, but I'm fairly sure there is no stat period as such for this kind of thing. The German equivalent is I believe 3 years, hence why their CRAs strike data after that period. There is a case for EU wide legislation in this area and you might want to involve your MEPs as well Brig. -

It has to do with the limitation periods in each EU member state, which varies. In germany it is 3 years; in England & Wales it is 6 years. So you won't find it enshrined in any EU legislation; it comes down to national statutory limitation laws.
