  1. Hi,Just recently my local credit union who I have been with over 20 years have started reporting to CRA. They also do a full credit search which is recorded, possibly because of new FCA regulations, which caught me by surprise as I was sometimes rather creative in revealing the full extent any debts I had to them. However, they were also the last port in a storm and saved my bacon on a number of occasions. What seems rather unfair is they just report the loan amount but not my current share balance with them. Is this valid? Anyone else experience of this?
  2. thanks dx. its moneyshop. i was just being cagey as its at delicate stage. yes i will make a complaint on monday, just checking if they were spinning me a yarn. i made the point in my response that the information has to related to me if they are referencing it in my complaint

Hi, I am in the middle of an adjudication negotiation with FOS re a complaint with a well known high street lender (I'd prefer not to mention the name at this stage as a I am considering an offer from them to settle the complaint). As part of the SAR request I made originally, I noticed they missed various bits of information such as missing loan account information, emails and phonecalls (which I thankfully retained). I flagged this up to the FOS in order to support my complaint. Now during the adjudication process, the company have referenced other bits of information such as internal case notes. When I challenged the fact that they were relying on information which they had not provided as part of the SAR, their reply was: "The information was provided in accordance with the Data Protection Act 1998 and all personal data, identifying Mr X was sent to him. Under the requirements of this Act, we are not required to send any data which does not personally identify Mr X' Am I right i thinking this is a cover up and I should progress via the ICO. How can they say that internal case notes are personally identifiable? My SAR explictly stated that "Please supply all information you retain about me about me I am entitled to under the Data Protection Act 1998 relating to my payday lending accounts with you from 1st Jan 2009 to 1st September 2014. I am specifically interested in the following information * my customer account information including loans granted, payments received, loan extensions and interests and charges paid * any data related to me that was accessed from credit reference agencies; * all copies of written and audio correspondence related to my customer accounts"
  4. def get a complaint to FOS - its only a one page form on their website. It will keep CRS honest as well while they know you have a complaint in
  5. report on to FOS as your complaint was not upheld. they have to pay a case fee of a few hundred quid for every case over a certain threshold so it hurts them. as we have seen with the payday lenders, in the long long run these complaints eventually do matter
  6. Wonga's view of the world now seems to be that the world only began after their deal with the FCA and if they deny everything it means there was no irresponsible lending prior to that! If you take a look at the FOS website, there are plenty of decisions against Wonga for irresponsible lending. I wonder is it worthwhile someone explictly writing to FCA and asking the question?I guess if they acknowledge too easily some of the failings of the past then they could be out of business quite quickly - the arrangement with the FCA seems to be a means of trying to draw a line under the past in a way which will not cost them too much and mean they can stay in business

It is a fairly brutal judgement - I hope the redress gets paid to the complainant but sadly I'd imagine that Minicredit will ride off into the sunset having made huge profits out of some desperate people (like me)Well done to all the folks on this forum who have encouraged people to complain to the FOS

  11. thanks for reply sillygirl - i d imagine the strategy is now to go out of business without having to pay compensation to those they mis-sold to. Seems very unfair considering the carnage the PDL's have caused - wonder will FCA let them away with it?. Have actually written to FCA re minicredit asking them what arrangements are in place around outstanding complaints with FOS
  12. Has anyone had any contact from Cash Genie regarding this redress scheme? I see they have stopped offering payday loans - when a company winds down such as this and Minicredit, how are any outstanding complaints with FOS handled? Is there a pot of cash put away to deal with them lol?!
  13. thanks dodgeball - that puts a slightly different spin on things. I also always thought the purpose of a default notice was to offerthe opportunity to remedy the default so no matter what the timeframe of loan or sums owed? Either way, the whole area seems very vague considering the huge importance of this to a persons livelihood
  14. thanks citizen - do you know if the ICO publish their decisions similar to how the FOS do it. Given the practices of the PDL's in the past you would be thinking any official body should be clamping down on lack of compliance especially when the effects of a default can be so destructive
  15. what worries me is that the ombudsman is accepting that the letter informing of a default is sufficient and is ok instead of the actual default notice. I remember receiving the exact same letter from Payday UK and even after agreeing a repayment plan they tried to place a default on my credit file due to the repayment plan lasting more than 90 days (it was actually 92). I complained and they removed it immediately The behaviour of the PDL's is to be expected but I am shocked the ombudsman has upheld the default in the instance where they only issued the pre-warning letter - seems to be complete lack of consistency

  17. Hi, Ive been monitoring the decisions database on the FOS website as a bit of research for some complaints I am putting in against payday loan companies. I have just about avoided a default myself thankfully but sailed very close to the wind - to show the anomalies of the FOS and the default process, take a look at the following links The same scenario re lack of a default notice but two very different decisions!!   18. Most of the decisions I have seen on the FOS website seem to be upheld where there are excessive rollovers but also seen a few weird decisions go the other way so fingers crossedGiven the news about minicredit, you just wonder how long some of the smaller payday lenders will stay in business
  19. hey sherbit, yes have both WDA and Uncle Buck in my sights with the FOS for excessive rollovers and lack of affordability - only when I looked through my bank statements did I realise the scale of rollovers these guys permitted and encouraged. I got some nonsense back about WDA using a bespoke scoring system...full of cr*p!!Have you complained about any other lenders to FOS?
  20. hi,I've just had a similar experience with WDA where in their final response they have replied with a load of gibberish about the loans, dates and amounts. I do not know if this was because they have poor record keeping or being disingenious. Thankfully, I have kept all emails and bank statements - in my case they rolled over my initial loan 10 times thereby paying almost £600 in rollover fees against an initial loan of £200I am in the process of escalating my complaint now to FOS.BTW, do you recall the extension method - I have a link in some historic emails to extend my loan but cant fully remember what information they asked for?
  21. thats a very similar/exact same response I received to my complaint to them. What was the basis of your complaintLendingMetrics product only appears to have been introduced in 2011 - given my complaint relates to 2009, I am not sure how they can claim that although it probably is a standard response letter

  23. great news - one of the worst of them gone. I have a current complaint with FOS about unaffordable lending in, wonder how it will affect that. Tbh, I dont care - having read the horrible experiences that people have had on here with this lot, CFO and motormile, it is great to see the back of them

Will have it posted by the weekend - have a fair bit of evidence already, just looking some supporting info on the rollover process so my complaint is fully accurate Yes was thinking the FCA may be interested in the number of rollovers and treatment of vulnerable clients themes
  25. hi, can anyone help with some historic info on Uncle Buck rollover/extension policy either via emails or have or historical references to the website c2010? I have made a formal complaint to them which i received final response today (which of course they refused to uphold). My complaint is based on affordability/irresponsible lending as in the 1st cycle of loans with them, they rolled my initial loan over 15 times without me paying the original loan back - simultaneously they gradually increased my credit limit. During this time i had a large no of payday loans and a terrible credit rating due to a gambling problem. I eventually agreed a repayment plan with them - after completion of the repayment plan, they then re-lent to me again and as you can imagine, the cycle continued until i agreed a 2nd repayment plan with them. At this stage, I asked them to permanently bar me as a customer but unbelievably they lent to a me a 3rd time and I ended up in a 3rd cycle of repayment Their reason for refusing my complaint was that they used a product called Lending Metrics to assess affordability. I am absolutely sure there no income/expenditure info required provided for the roll-overs but any help on the actual roll-over process would help? Given the debt I was in, any product that looked at my credit file would have seen my credit rating was terrible
