  1. I think you need to write and accept the part payment (as a part payment) and make it clear that proceedings are to go ahead to recover the outstanding amount. Send a copy to the court, and make the court aware that this case is NOT fully settled as CITI may try to mislead the court that it is Bru
  2. Just listened to Eleanor Gill on the BBC playback system.. I agree, she held back quite a lot from the callers, it was like she was afraid to give advice for some reason or another. an excellent opportunity somewhat wasted, i think. but... tomorrow's another day Bru

  5. Got this out of the blue, in post this morning : Dear Mr ********* We refer to your correspondence in relation to charges on your account. We wish to advise the situation is still under investigation by this department and we hope to be in a position to respond to you with the next four weeks. yours sincerely M. Gourley Customer Care Unit. is this strange, or has anyone else received one like it
  6. The Area manager should be in a position to make decisions on refunding your account. Though I agree with you that is a bit suspect that she is unaware of what is going on. Be careful though, big aid has a point, you must be able to show the court your willingness to mitigate. Very simple, if you ask her has she the authority to deal with your complaint and rectify the situation. If she does, agree to discuss the complaint, and the complaint only. If she doesn't , tell her you will discuss it with the organ grinder and not the monkey

I wouldn't agree to this meeting, unless the terms of the meeting are agreed in advance, Indicate that you are willing to meet to discuss your ongoing dispute for unfair charges, but that, due to impending legal action, you are not prepared to discuss any other business until this matter is resolved.

  9. Absolutely, I think they may be trying to have the case heard in Belfast. Under Part 26 of the Civil Procedure Rules. PART 26 - CASE MANAGEMENT – PRELIMINARY STAGE Fight this Tooth and nail, at least one defendant must be an individual for this to take place automatically. In any case if you branch is in the Craigavon Area you can argue that Craigavon is the Defendants home couts Hope this helps regards Bru

UPDATE 25 July 2006 11:42 am Phoned First Trust Bank (Belfast) Customer Care Unit and Spoke to Mariead Gourley, asked if The bank was prepared to abide by the OFT Ruling of 6 April 2006 and reimburse my account before 28 July 2006, as per my LBA Letter of the 14th. I was informed by Ms Gourley that the First Trust Bank adheres to the FSA code of conduct and that nothing would be considered while my complaint was under investigation. I explained that as I was the party threatening legal action, I should be the one who dictated any timetable of action. I was told I could do what I liked. LET THE FUN BEGIN

Recieved a letter in the post Yesterday (they were quick off the mark) Dear Mr ******** We acknowledge receipt of your letter dated 14th July 2006 and enclose a copy of our acknowledgement to your complaint dated 3rd july 2006 yours sincerely M. Gourley Customer Care Unit Cheeky buggers didn't even bother typing new reply, stapled was a copy of the blah blah letter they sent me on the 3rd.

  18. Hold your nerve Flojo. They are simply trying to scare the bejeesus out of you. I'll make myself available on your date for moral support ( I'm only a few miles up the road). I am slightly surprised though, at the amount of time you have to wait. All these claims against the banks must be having an effect on waiting times
  19. Got my Blah Blah letter from the First trust yesterday acknowledging receipt of my preliminary request. As with everyone else they are trying to set a timetable of action. They must have thought I came up the river Bann in a bubble. LBA will be delivered on Friday 14th July regardless of what First Trust thinks Keep you informed Bru

  22. Hi Guys, Been posting on a couple of other threads. Time now to start my own. The story so far: 20th June. Posted 2 DPA Letters and 2 cheques to First Trust. 28th June. Been very fortunate and received six years of statements for both Accounts. 30th June. hand delivered preliminary letter to Branch. Will update as and when I have any more info Cheers Bru
