All, Having sent back my allocation questionnaire and having responded to Cobbetts request for further information, I today received an allocation questionnaire from Nat West asking for my claim to be struck out due to not having presented them with the aforementioned "further information". They responded, as is their norm, on the very last day that they could. What is the chance then of their being successful in their striking out of my claim. I have not been able to find any reference to this happening in other cases so would appreciate any reassurance you may be able to offer. Yours Richibax

Hi! Richibax here. Cobbetts had until 7th Oct to respond having previously acknowledged my actions. Their defence was dated 6th Oct 06, whereas the covering letter was dated 10th Oct and refers to a case at a different county court (Northampton rather than Harrogate) on its back page. It even states THEIR solicitors name as the claimant on the same back page!!! I am not sure what the "part 18" you refer to actually is, but Cobbetts are asking me to identify the following: ....the section of UCTA Act 1977 I am referring to, the regulations of "The unfair Contract Terms in Consumer Regulations 1999, AND the principles of common law I have relied upon for my claim!? They are asking for "..,.the proper particularisation of the claim, but I have already itemised EVERYTHING including dates and interest accrued! They say until they have received this that they cannot plead to the allogation, despite their having already atsted in their acknowledgement that they intend to "defend all of the claim". .......I think I really am missing a trick everyone! I am at the very beginning of the process and cannot seem to even obtain a figure on the total amount they have charged me over the past 6 Years. Their lending division inform me they only hold these details in hard copy and nothing electronically!@$?!, apart from the past year which I may obtain free of charge in my bank. They have told me that they will charge me £5 per sheet on any re-printed statement! Any tips on obtaining accurate figures on what they have carged over such a period?
