  1. So - has anyone else received a missive from EC asking you to call them with regard to their fantastic one off offer which ends this week? Since I haven't actually received any such offer, I think I'll resist the temptation to call.
  2. I sent a very detailed request for documents and logs I wanted and they still managed to leave imortant ones out - so be prepared to fight on .. good luck. T
  3. I'd be interested in that thread, SG1. For example, I'd like legislation which forces DCA that buy a debt to a) declare how much they paid for it. b) limit the amount they can collect to say 10 or 15% above the paid price. c) and still conform to CCA regulations

  5. Well - finally received my SAR from MBNA (7 days shy of date due) and am disappointed that they haven't complied with my full request. Missing: Notice of Default CCA (got same sheet as one EC sent which is an application form) Notice of Assignment I did get Transaction logs, Custome Info System logs and some screenshots that seem totally useless to me. The transaction logs are interesting. I haven't photocopied a couple of pages and put them on photobucket. I won't put the links here since even with sensitive info blanked, I reckon a seasoned DCA or MBNA mole can identify me if they want to go to the trouble of doing so. There are some people on here that I would trust and I would appreciate a PM from if interested in seeing them - could use your advise. What I will say is that it shows that they issued (and posted) the NoD on the 7th, and it states in the log that the expiry date is the 24th. I make that 4 days posting (2nd class) + 13 calendar days - 1 short of the 14 I'm supposed to get (BTW - is that 14 working or calendar days? I assume it's calendar). What's really interesting is that on the 18th, it shows they sold the account to DCA1, bought it back on the 22nd, then sold it to EC (not Varde as EC stated in their letter informing me of sale) on the 28th. Is this recission of contract? Doesn't state absolute or equitable - just SOLD in both cases. Haven't got my Varde letter to hand so can't check what date EC send their assignment letter at the moment. Anyone have any thoughts or advice? T

  7. HH, I got the same letter, as indeed did M&M. I'm curious as to why you think it's a sale or return though? The whole business of who owns the debt is mystifying though. When I made my F&F to experto, the response was "Our client has rejected your offer", which indicates to me that Experto are not the owners.
  8. In my neck of the woods, Moorcroft do have a self-employed collector (actually a really nice old guy). Are you saying that he would need a license to collect on their behalf? What if he didn't?

  10. Vint? Can I pick up on the legality or otherwise of the notice of assignment? I understand that there are 2 forms of assignment: Equitable - that is, they share with the OC the ownership of the debt but pursue the debtor instead of the OC? Absolute - they buy the debt outright as an asset from the OC - at which point, anything to do with the debt is theirs alone? With respect to the above, under which circumstance is the Notice of Assignment required, by law, to be delivered to the debtor either in person or by recorded delivery? Tranders
  11. You'll find that Experto Credite are showing up a lot recently with respect to MBNA - usually fronting for Varde Investments (Ireland) Ltd. M&M, myself and several others have them on our backs.

  13. Thanks,Cerbs - as I mmentioned in a previous post, I've got no bones about apying, but I'm not happy with the shenanigans of both MBNA and Experto Credite in the way this has been handled. This at least gives me the opportunity to keep haranguing them whislt still keeping them dangling. So now I send a "serious dispute" letter and continue paying my monthly payment as a gesture of goodwill. Waiting for my MBNA SAR so I can investigate further.
  14. Hi Sheena01 - I notice that you've always refered to this CC as an Abbey card - and they were indeed run by MBNA. However, the Credit Agreement you posted is clearly an Alliance & Leicester CC application. Have MBNA sent you the wrong one? Also, the terms &conditions page, as Cerberusalert points out, is an '02 version. Interestingly, I also CCA's MBNA for an A&L CC account I had, and they sent me mine with the exact same T&Cs right down to the '02 detail. My card was applied for in '04. Cerberusalert? Could you take a peek in my thread and have a look at the CA?
