  1. Ok but the default is now in capquests name and the OP is saying they got nothing to do with it now its been passed over.
  2. Update. Natwest removed default after a letter of apology and given indefinite time to repay aslong as I pay something each week. Virgin definitely removed default. Cackquest bought the debt but cannot provide any paperwork and apparently home retail group have nothing to do with it. So does that mean I can force Cackquest to remove the default from my credit file until they can provide the paperwork? It has been nearly 3 months now. If I can how do I do this? Thanks for your help so far credit score gone from 98 to 532 what a difference this has made.
  3. ***UPDATE*** Natwest are re investigating and are not happy with their collections sub contractor and the way that i say they handled the case. Cackquest 28 days on sent a letter saying they are still waiting for paperwork to prove i own the debt. (They sent a letter saying they own the debt a few weeks back) Here is hoping they cant find the paperwork and there stuck with the debt. Virgin Agreed to remove the default for full payment. Egg cannot produce any form of paperwork let alone statements to claim ppi back - What do i do here?

I looked at the bcobs for natwest. what happened with natwest was i got into difficulty and i phoned and said as long as i stay in my OD but dont make any payments will i be ok to leave it and the phone operative said yes. So i did 5 months later the accounts closed and natwest send letters asking for the lot back immediately. Which they are well withing their right to do. However i told them about the conversation i had with the telephone operator and they said that they will look into it.. . in the mean time i get collections harrasing me with calls and i said i will make a token payment until the matter is resolved as by now i was getting huge charges been added on and then the DEFAULT whilst the account was being investigated. Well i gave up as they said they were no longer dealing with me as i refused to make larger payments than they wanted and that they were in no way legally obliged to take a payment from me unless its what they want. I kept making and still make the token payment into the account. And i get phone calls from this collection agency saying i must stop paying natwest and pay them. I told them i will keep paying natwest as the debt it with them and not the DCA ( i will get name next time they ring). The egg debt is 7 years old and Capquest cannot get any information for me and neither can egg i was going to reclaim charges but cannot get the info. I tried years ago. And i will ring virgin when i get home see what they can agree to.
  5. Debts are as follows:/ Natwest 8,500 o/d was 7,500 Defaulted nov still arguing like mad over the default. Capquest Egg, 1,800 defaulted 7 years ago removed from file still paying. Capquest Homeretail Group: Default balance: £356 Capquest + HOme retail group charges added now £1108 Virgin: £103 defaulted paying in a few weeks to get default marked as (s) so thats 1 down. Oh and i got a letter with 2 lines on it from cackquest we now own the debt.
  6. Update: They sent me the CCA as it was a online agreement there is no signature just my name printed. I have asked them for a statement and told them that until I am satisfied of the amount i will not be making a payment and seen as i have another account i am paying back with them with a financial hardship attached to it they will most probably have to add it to the queue. Experian and Equifax looked into the entry and said that the name has been changed as cap-quest are now in charge. SO if this means they own the debt should they not have sent me a letter saying so? Whilst i have been waiting for the letter to arrive i was getting calls from a Tracing Company employed by cap quest to check my details and i refused and said they had my details sorry. They told me "we will ring everyday until you do" o i did reply i will add you to my call barring program sod off. The calls stopped now which is good i can sleep beyond 8am on my days off.
  7. I have no archived but then maybe your right they just changed the name from home retail group to capquest. My Experian report is down until tomorrow (update of address) and my Equifax is the one im going by it does say the entry was made on November 27 2012 no payment history etc just opening with the default. I do not want to list my debts I was just after advice on this default so looks like it is legal. I will definitely post back tomorrow I can understand my Experian report much better than Equifax.
  8. I am paying no interest or charges on any money I owe I got that frozen. IVA or bankruptcy is not a option I have planned all my finances out and a firm believer in I got myself in the mess ill get out of it. Credit Files However I hate. I hope to be better off one day and pay the debts back faster and move on with my life. Even if HRG delete the entry for a NEW entry to be added and marked as default by a separate company in my understanding of the procedures Cackquest have to send me a letter to back up the Default on my file. Otherwise HRG issued the default 7 months ago and now im going to be harmed for 6 years 7 months. They have extended the default which I think is like a sort of punishment?
  9. Hello im going to cut a long story short. 1. Debt with home retail group 2. Home retail group pass debt onto cackquest 3. Home retail group DELETE their records from my credit file 4. Cackquest open a new entry with DEFAULT 5. Been as it is cackquest that has enterd the default should there first letter not have been to issue me with a default notice and not hello you owe us? I told Experian and Equifax and there looking into it saying that cackquest should have sent me a letter. Now im only talking to a phone line operative not the guys in the basement am I right and got a good chance of having the default removed? Cackquest are upset anyway because they bought the debt and have to stack it ontop of another debt that is due to be paid in 2019 with this ontop they get all their money in 2026 but they have my letters declaring severe debt and agreed that the re payments will never change Im paying the debt back not avoiding it please understand that. I was just wondering if I managed to avoid a Default altogether.
  10. Goes back 2 years..... Letter sent i owe money lots and lots of to and throw and lowells could never send a cca or prove i owed the debt. RESULT I GOT A LETTER LAST WEEK SAYING THEY RETURNED TO SENDER :-D:-D:-D:-D:-D:-D:-D:-D:-D:-D:-D
  11. Your local council environmental health will help... they will condem the property for sure live electrics should never be exposed to water. Also your ll under the tenancy act has a legal responsibility to fix the property within a reasonable time otherwise you can legally get someone out to do the work and then you take those costs out the rent. Speak to your council they will be round quicker than a quick fit fitter and tell the ll or the ll agents to fix it immediately. My house flooded and ll wont replace carpet thats rotten - RENT HELD - Moving out - Environmental health fining ll.
  12. UPDATE. FSA say that because i have not paid monthly i have breech repayment terms... Terms and C do not say that at all which was confirmed by tier 2 customer complaints. Natwest refused at first to speak to me but i got a number that took me direct to customer complaints. FSA are not interested but natwest will see what they can do as they have the recorded conversation where i was told that i can leave the account alone untill april and make huge payments. However given this evidence i was told that i most probably will have the default despite when recieveing the phone call i have tried hard to sort it out and continued to make payments. I have accepted to keep paying interest because at the end of the day i owe the money and have every intention of paying it back. To be honest the person dealing with this seems a great person and understands that i am not and never have tried to not pay this debt i just wanted to pay some smaller debts off to raise more money to pay this huge debt off. However that post raises some interesting points and may aid me further. Natwest have said that if this complaint fails they will not speak to me no more. This cannot be right i must be able to fight this as long as i want especially seen as they admit their advice last year was wrong.
  13. Ok a update on this natwest point blank refused and pointed me in the direction of OFT they say that get this... Yes we can accept your token payment BUT we will issue the default and pass it onto the debt collectors as we do not formally agree this. Basically i went in there all guns blazing firing law statement after the other and i think i scared the hell out of the supervisor who said speak to the OFT and hung up. OFT have sent a complaint to natwest and said that in 6 weeks i have to phone back and they will then take over and deal with natwest and judging by what i said it is likely they will take over. Kind of makes me think OFT are having some problems with natwest recently.

  15. Ok so i set up a standing order to transfer £5 a week into the natwest account. See what happens i am sure ill be back.
  16. Ok here is the story. Feb 2011 - Current acct exceeds OD limit and natwest phoned asked what was happening and i explained that i am struggling to pay bills and put in more than i owe. March - Took out a £2000 loan with another company and restructured finances best i could to keep within OD April - Ran out of money totall so changed bank accounts to a 0% intrest for 1 year and left natwest account alone and phoned and said sorry but untill april 2012 im really stuck. Natwest said ok but you will have to pay interest and i agreed. Oct- 2011 Natwest send debt collectors to my door and i told them to go away. So i went into the bank asked for a manager and explained everything why i can only make token payments and i did approach them in jan 2011 for help via a loan to consoldate all my debts and on paper everything showed as been great saving me £600 a month. But computer said no much to the managers annoyance, so thats how all the previous happend. Anyway natwest managers cannot deal with a account once its been passed to collections so we phoned them on speaker and chatted and me and the bank manager got fustrated because i said ill pay £20 p/m untill april then £300 p/m but i need the interest stopping and the £350 p/m bank charge otherwise things will get worse. They said no way whatsoever. So the woman on the phone read this statement saying ''We cannot come a arrangement so a default will be applied and this debt will be sent to the debt collectors'' The bemused manager said to the womman on the phone why do we have to do this the customer has got what he wanted but were giving him a default. We natwest now loose money (Interest and sale of the debt to creditors) The answer was thats how we have to do it. I handed my card and chequebook over and a apology from the manager. Now can natwest do this or if i just make a payment each week can i stop the default? I have to work fast natwest phone person said all this will happen within 7 days. Thankyou so much for your ever helpful help. I DO NOT WANT TO AVOID PAYING THE DEBT I OWE IT

Back in Janurary i opened/transfered from natwest to santander all was good so i thought balance transfer at 0% for 1 year and they do everything even give me insurance for £10 pcm so i signed the docs and I had to transfer everything over myself they did nothing. They made hell for me as companies were charging me for bounced dd and when i explained they all refunded the charges thank god. come march my first £10 was due to come out of the savings account and i was told that it would automatically come out of my current account it was just the way it is. But it never i had a £25 charge for going £10 o/d on the savings which i never used. i phoned up customer services explained what i just said and the £25 was refunded and £10 taken from my current account. April £10 came out again with now £55 charge because santander changed the o/d rates to per day. ( I thank those who started kicking off about charges for things they deserve to be charged for and claiming it back) so i ohoned complained again and said to close the account and send the papaerwork to my home...... may came another £10 and £55 fine another call asking what happened to this letter and told that it will be chased up. (BEAR IN MIND I WORK AWAY FROM THE UK SO IT TAKES TIME FOR ME TO ACTION THINGS) June comes nothing again so i phoned up and was told...... you should have gone into branch we cant do this over the phone. So i did and the branch refunded all the charges but will not close the account untill i pay the £10's and i said i wont because i never used the account/insurances and really i should not have been offered this account seen as i am £3k o/d from the moment we balanced transferd there really would have been no option for savings untill the o/d is paid off. The branch manager said no no way i said that they got excited for the account transfer and i ended up having a product i never needed and i have been complaining from the begining about this account i dont want. So what can i do? Personally i would like to think i am right and that the branch manager was wrong. In effect i feel like the 15 minute whirlwind of transfering i put my truct in the person opening my account they never told me the downside of switching to santander for example... santander do not do faster payment like natwest, nationwide, barclays and hsb and they never will. They went though my natwest statements and should have seen the ammount of funds transfers i do to see that i would have been better staying with natwest and trying to sort out my problems with them.   18. Ok statute barred letter sent and a response received saying i made a payment which i did not. So i sent a letter back saying prove i did make a payment and now they say thank you for your response and we are waiting for bank statements for this debt and can take months. Seriously are these guys idiots or what? They say i made a payment which i do not acknowledge and they cant send that so they are wasting time sending bank statements which will prove i never made a payment for over 6 years. So we wait expectantly.
  19. It hasnt been acknowledged for 6 years because untill now i never found out who had the debt. My credit file shows Lowell searching it for over a year but they have been removed now i did tell them that i never gave them authorisation to search and damage my credit score like that.

Years and years ago i had a ccj and i telephoned Northampton CC and they gave me the details of the company cant remember now who it was but they passed the debt on and told i have to wait for a letter. So i did and Christmas's went by still nothing so i went back to CC and told them the situation and they said basically go back to the company who filed it and they said they didn't have any record of it.And now on the date the CCJ gets removed lowells come forward saying hello. I have told them that it is statute barred and now i receive this letter saying that i did make a payment and acknowleged the debt. Which i never did. So letter sent to them andwe'll see what they say normally takes a few days for a reply.

  22. Lowell say my debt is not statute barred because I made a payment of £50 and acknowledged the debt. I definitely have not made a payment or acknowledged the debt as i never knew who put the ccj on because Northampton CC did not have lowell listed as the CCJ holder. I have asked for proof but they wont entertain me just keep saying pay it or else. I know there is another thread but i do not want to hijack his. What do i do FSA? OFT?

Got a full refund.... the sales assistant said it was illegal to give refunds lol we had one hell of a argument when i told him i used to work in retail computer sales years ago he backed off a bit but then when i said ill phone head office up again we got the refund. He dropped himself so far in it talking garbage he really did not need me calling head office. STAND UP FOR YOURSELF YOUR RIGHTS ARE SIMPLE COMMON SENSE
