  2. Good Morning .... I am sorry I cannot scan/not working...pls bear with me ok...as the title of thread states...I have 3 ppi's to sort out... 2 Halifax Credit Cards and 1 unsecured loan... But first a few preliminaries... I shall deal with the Visa Cards first...The FIRST I want to deal with was signed in 2001 This particular form that came in the SAR s split into 2 halves....at the top it says 'Visa Card Application'....Underneath that it says 'Credit Agreement Regulated By The Consumer Credit Act 1974... Then the form is split into 2 halves with 6 points...on the left hand column from 1-5...name address,employment...and in point 5 it says 'Product Details'...'If you would like the to take advantage of these services please mark the relevant boxes,,,then there is a tick which definitely looks like it has been made by a computer as the x is made by a computer...in the CREDIT CARD REPAYMENT INSURANCE box... Now I know for a fact that the person I am doing this for is ONLY JUST doing a computer course NOW and he was approx...55yrs then In the other half of the page at point 6(In the right hand column) it states Principal Cardholders Application and Declaration and then in between this and the Right To Cancel Box and Signature Box which clearly states 'This is a Credit Agreement Regulated By the Consumer Credit Act 1974 sign it only if you want to be legally bound by its terms.....there is stuff like credit scoring and fraud prevention etc... However just above the title in 6. 'Prinicpal Cardholders application and declaration'...it states.....'Attached to this application form [/b]you will find important information about your account.Some of this is repeated in the Halifax Credit Card Conditions.You will find a copy in your Halifax Credit Card application Pack. Nothing else came in the SAR apart form statements.... The Issues 1.As this was signed in 2001...is this Regulated by Agreements Regs 83/1553 2.Does the fact that there are no PT's at all..i.e APR,Amount of Credit or any of the matters contained in Schedule 6 1983/1553.. on this form affect the validity of PPI itself.... ab initio 3.Are the PT's 'within the 4 corners of the signed form? ....were the PT's present at point of signature?   4. Good evening ims21 Just a little insight if you can.... How would you calculate repayments PPI from 06/10/2003 to 05/07/2005 when there are no monthly statements for that period yet evidence is present that PPI WAS added to account on that date.... The PPI has been calculated FROM 05/07/2005 until 03/06/2010 as all statements were provided for that date apart from some missing about 8 in between these 2 dates... So i guess then ...how would you calculate unknown figures from 06/10/2003-05/07/2005..or what 'common sense/figures' would you use.. AND...the missing months in between 05/07/2005 and 03/06/2010/figures would you use... Thank you m2ae:-)

I have compiled a letter stating that the above is unsatisfactory and that a fuller breaksown is required and that xx amount of months are missing/unaccounted for when they sent SAR.... sent it off yesterday with nonsense cheque... I shall post up the reply AND amount OR referral to FOS. Just a quick question... What category does PPI payments/CI from customer DEDUCTED from account fall into. .i.e Balance Transfer...Cash Advances...Retail...Purchase...etc.. The reason is that I can then tell at a glance which APR applied to it at any particular time as opposed to Introductory Rates... Thnks for all your help...

  9. FINAL ANALYSIS MBNA offer was £330.01 after only 3 weeks from a written letter by me to them on bhalf of friend.... They moved swiftly Offer too low....Offer has been calculated on this thread with stat int to be £399.64..MINIMAL Statements for Periods between 06/10/2003-05/07/2005 not supplied therefore unaccounted for.... ACTUAL REFUND should be in region of £475.00-£500.00...estimated guess

  13. Yes...I will NOT use the missing months to show reasonableness what do you think ims? ...The Period from 06/10/2003 ....To.....-05/07/2005 OR do you think that that would be a size-able chunk...bearing in mind the above figures?

  16. sorry ims..but is the claim from date the same...ie...05/07/2010 and goes into claim FROM box.. I appear to come at a total interest 8% simple of £55.17 could you give me a second opinion..and if it is correct...then that would be added to 344.47 and used as counter offer correct? thnks

I'l be back with final figure that I shall revise upwards as a minimal counter-offer and use the missing months as leverage to get them to full and final settlement I shall be moving on to the HBOS PPI loans and conditional loans...in the meantime am reading up on Citizens explanation of Single PPi arrived via your link Rgds:-D
  18. Thats great ims..I will definitely write to them on thi matter... How would I take the above figures and apply them to the statin spreadsheet for period 03/06/2010 until 31/05/2012 when the cheque was written out (or rather the letter in which the final and full settlement was given) Thanks

I have calculated the figures from 05/07/2005-03/06/2010 and =TOTAL CHARGES £186.89 COMPOUND INTEREST £157.58 TOTAL £344.47 HOWEVER my friend has received a cheque for £330.01 I have not even factored in the missing months FROM OCT 6th 2003-05/07/2005 for which there are no monthly statements in the SAR package..but we have correspondence that evidences PPI being added to that accounton that specific date 06th October 2003 Also bear in mind that the last payment was on 03/06/2010 and the cheque was dated for 31st May 2012...we are looking at many months of STATUTORY INTEREST too...are we not? Ims thank you for all your help today and last night The spreadsheet is beginning to work completely in all areas...I am using FosC1 from 05/07/2005 until 03/06/2010 to see what the figure is compared to what they actually offered... And then go back to it all again afresh and input an average of 2.00/month form 6th Oct 2003 Until 03/06/2010 to INCLUDE the missing months and have a look at what the new figures would look GUESTIMATE like. Settlement Date was paid by cheqiues just the other day actually 31st May 2012...so would sheet statint run from 03/06/2010 until 31/05/2012 please advise... thnks and then I will
