  2. What parts break OFT guidlines? Sorry I am used to negotiating with creditors but taking on payday loan companies is new to me and I am still learning!

  4. Just thought of another question... How long will it be before LS put default on my credit file? Do they give notice before doing so? The reason I am asking is my last defaults were all about 4 years ago when I got made redundant and I am counting down the months to 6 years when they will vanish and I can look at building a decent credit rating again?
  5. I have sent them another email to let them know that I am in charge and not them Ill make sure that I pay them £40 per month on time for the loan amount plus 1 months interest. Then it is upto them if they want to push on with recovery or legal action, or try to claim for extra interest/charges. Thankyou for your reply. I have informed you of my circumstances which has led to a drop in income and has put me in financial difficulties. If after paying my priority debts I only can afford to pay you £40 per month, and you continue to add interest/charges to the account than my situation will only get worse as this will not even cover the extortionate interest rate. I beleive that a reasonable (but still expensive!) figure for you to charge will be one months interest, should you disagree with this then you are welcome to have this decided by the OFT. This is what I will be offering in my repayment plan. I have set up a standing order of £40 per month. I will be in contact in 3 months to update you on if there has been an improvement in my financial circumstances.

  7. I have had a reply from the email I sent them. I had explained in the first email that I had my hours reduced at work and therefore my salary also, they sent the above email then I replied with this offer... Thankyou for your email. I have just looked on your website to see how much I owe and it is higher than I thought and a bit of a shock to me. £510 + £153 interest = £653 However I would like to sort this out as soon as possible. Can we set up a plan for the next three months of £40 per month to start reducing the balance ? This will leave £533 after 3 months. I can then review my financial situation and should it have improved then maybe look at increasing my payments. I hope to hear from you soon to except my offer.   9. They have replied, they sent bank details and have confirmed they have discontiued CPA....   11. I get paid tomorrow so giving an update for the mess that is bound to follow... I have reported my debit card lost I have emailed lending stream and told them I am canceling the CPA with them, I told them I will be in contact with them to offer a repayment plan shortly when I have worked out how much I can afford after paying my priority debts. I have phoned my bank (lloyds) and it was easier than expected to cancel with them, they said it will take upto 2 weeks to set up but if lending stream do manage to take payments after todays daten they will refund them to me. The first woman I spoke to started asking questions like why am I cancelling and how am I going to repay them. I told her it was none of her concern and she just needed to cancel the CPA for me, but she kept on asking. I just told her that I wished to make alternative arrangements with them and that was enough for her to shut up. I think it is sorted but I have sent a follow up letter just in case
  12. Hi I have been stupid and took out a payday loan just before xmas, I paid it off in January but then that left me skint an not able to afford the bills so I took out another. This is due in february and I wont be able to afford this without not paying more important bills which is not an option (unless they raid my account first of course!) I have just over a week to sort this before I am deep in the smelly brown stuff. I understand first thing to do is get a new bank card and cancel the old one. But this may not work so then cancel the recurring payment but I not entirely sure how to do this?? I dont want to switch bank accounts unless I really have to as my branch location is really handy for me. I dont know how willing they would be to help me (its Lending Stream) and how much to offer?

Your due payment date will be moved to the 30th/31st of each month Please find attached a Notice of Discontinuance which you will need to complete, sign and then send to Court. We are happy to forward that to the Court once signed if you would prefer. We look forward to hearing from you shortly. Shall I tell them I will do this when I have had written confirmation from Santander that my account has been credited?
  15. I'm sending their solicitor an e mail to accept... Dear Chafes solicitors. Thankyou for your letter dated ## ### 2012. I disagree with the majority in the content of your letter and it is clear that Santander continues to disregard me as the customer and any complaints I have. I would like to accept your offer of £345 "as to save Santander costs" I look forward to concluding this long standing complaint and receiving written confirmation that Santander have waivered the charges with your offer of payment.   16. Im struggling to upload. But i believe the summary of the letter is clear £175 charges. Clear £125 arrears (just more charges that they have taken out of monthly payment I sent) Send me a cheque for £45 - dont know where they got this figure from, the court fee was £25. the letter is a bit confusing because they say in the letter they are going to defend and I am not entitled to interest, then they are offering me a cheque of £45 to save their costs?? £45 = Court fee + interest??? total = £345 I want to accept their offer. Will a simple thankyou for your letter then I'd like to accept you offer reply, by a short email to their solicitor be ok?

  18. Not yet, they have only done ackowledgement of service. They had until 16th September to acknowledge, which they have done this week. So now they have until 30th September to file a defence? Do I have to do anything in the meantime or just sit and wait to see what their next move is?
  19. update.. I have just checked on money claim online website and just seen. santander consumer finance issued an acknowledgment of service Unsure what to do next so going to have a look around this site and ask for help if I still don't know
  20. Received another letter from Santander today. They have charged me again . That means this month they have charged me twice for the same thing. :mad2:14/8 they charged £25 late payment and now 22/8 another £25 late payment. Total charges are now £300. I have only claimed for £275, will I be able to change this to £300 at a later date?? (this recent charge is a direct result of me refusing to pay the previous £275 in charges that I have claimed for) I really need to win this now as the charges upon charges domino effect has now escalated to a level I can not afford

The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 22/09/2010 to 24/08/2012 on £275.00 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.06. Already done it online yesterday. Wanted to give them more info but there really is not much room to do so! Thought I'd best get a move on with it because if they put on another £25 for me refusing to pay the previous £275 in charges then it will take it over £300 and cost me a little more to claim. A little nervous but bring it on
  22. I have had enough of them adding charges on charges and thinking they can bully me into submission so I have just filed a claim this evening. Its a car finance agreement. The total claim including the court 8% interest is just under £300. How likely are they to defend this and if they do will they defend all the way to me having to go before a judge?
  23. Ok they have replied to my 14 day letter before action letter with the standard please refer to the terms and conditions cow excrement letter. Can I start a claim now even though its before the 14 days because they have replied? They have added another £25 charge because I refuse to pay the previous £225 as I expected them to so now stands at £250 I am going to need some help with doing this please if someone could kindly give their time to help
  24. No. She tried to do online but it would not let her and told her to go to her branch. She did this and sat through them trying to convince her to keep it open even though it was not required as we were now covered by the joint account, she told them she did not want it and thought that was that = cancelled.
