  1. the seller said that there is nothing wrong with the car, supporting documents were provided to show up to date maintenance work, this is not true and iknow for sure, if something is wrong it is, and I can follow my guts n carry on

  6. so what you are saying is the seller is right ? I know that there is something wrong that's why I don't accept your argument that it's ok because it isn't, simple as that. Yes you have to be careful in what you are saying because at the end of the day, even a legally trained solicitor wouldn't jump to conclusion like you guys here, you might be right in what you are saying, but the way you do it sounds like you don't know the background of the story and you just go like...yeah as described....private seller = no guarantee ...ect.. since you claim to be a mechanic, what is a full service and what would expect from a car that is advertised as fully serviced from the main dealer ? there is nothing personal here but you guys you are making a front here and it just look like you are covering each other, anyway I hope I am wrong on this and I would admit if I were...just cheer up
  7. how is it that the spare wheel being not the same is personal information ? I think you guys you need to be careful in advising people, you are just making judgment after judgement and you are not even leaving any probabilities which a quiet concern.
  8. MOT is due very soon Advisory notices on the MOT none, it was last year.
  9. you are missing the point here, you say tear and wear,but MOT wise it could be a failure,in other words those advisory notes are crucial to the car and not tear n wear stuff

  11. A garage would always advise, they are there to do the job and they are not the VOSA to force you do something, also what if those I advisory notices failed me on the MOT ?

I understand your point of view, but this way what you are saying is that if you buy an old car you are left with it and you have to deal with any problem that might arise, but let me remind you that the law is there for this specific reason to protect consumers. I think you are taking the "advisory notices " wording as something that is extra or not required, it is not the case, the spare wheel is an example. To make the matter clear, on the sheet it say the following: Important information/Advisory Notices

I am not sure how this will make a difference and I guess this is not a mechanic forum to discuss the mechanical issues, but for the sake of the argument the advisory notices are as follow: Exhaust Back Box outer skin starting to peel Fuel Tank cage rusting away Both Prop Shaft support Bearings perished and weak Surface rust front and rear and rear metal brake pipes O/S/F and N/S brake pipes surface rust Spare tyre different size profile Coolant expansion tank cracking Heater matrix slight leak So if this information was available to me at the time of the sale, then I wouldn't have bought the car, I am also left now with a £2200 bill, those are not from an MOT perspective but from a specialist garage, NOT from the main dealer as it was suggested by the seller on their listing as having full service from the dealer which was not.
  15. The breach would be in my view as follow: The seller broke a specific contract term. Deliberate concealment of information that might lead to believe that the car had no issues ( full service ) where it did at the time of the sale. in other words I can prove that the car had already a problem before it was sold to me as it's developing now into a fault that needs to be fixed. Also as an example the spare wheel is not the same. This is an unfair practice from The Consumer Protection from Unfair Trading Regulations 2008 this might apply to a dealer but I am not sure if it's applicable on a private sale The seller could be trading from home as there was many cars on their drive, and the seller seems to know a lot about cars, the seller stated that the car belonged to a relative ...ect obviously I have no proof of any kind but I will contact trading standard and see if they can investigate whether the seller is a trader selling privately to avoid paying tax or their legal obligation to the consumer .

Well, it's not that I don't like the answers, it's the way it was put forward, people come here for help, and the law is clear on this: whether it's private or business seller, there is a kind of protection here and it's clearly not what some of you are saying, so I think you have to be careful if you were to advise people. Anyway I am willing to discuss your view and it's not that I don't like the answers, feel free to shed some light, let me repeat again and see if this will make sense. I believe that I have ground, because the seller breached the contract, they listed the car with full service history The advisory notices are from the service NOT the MOT, in other words the car should be up to date, not having problems that should have been be fixed, or left, also the seller tore the piece of paper where the advisory notices were written, clearly it was misleading, I wouldn't have bought the car if i knew it had few problems, some of which the spare wheel is not the same. I was quoted £2200 to repairs, now this wouldn't be a car with full service history ? doesn't this all suggest that the car was not as described.

  19. Dear all, I bought a car that was advertised on autotrader. according to the seller ( private ), it has full service history from the main dealer which was done few months ago. I bought the car with good faith, however when I called the service garage where it was last serviced,I was told that there were few advisory notices and it seems that the former keeper did not want to fix them, those advisory notices were removed from the service records so that the car would look up to date with its service and that there was nothing wrong with it. I contacted the seller straightaway and asked for money back but the seller declined, I asked for the money toward the repairs without any response. The question is if I have a leg to stand if I take this further and potentially court action to get the money to carry out the outstanding repairs. I have the logbook and a written piece of paper in which the seller signed and stated that the car was SOLD AS SEEN but also I still have the details of the autotrader ad in which it is stated the full description of the vehicle with full serv history ...ect PS. the seller looked like a dealer working from home, the logbook wasn't on their name.

I realized now the the flight will be delayed and I will have to spend the night at the airport if I wanted to go ahead. according to edreams my flight was changed, when I checked with the airline, it was indeed postponed from 10 pm till 10 am the next day, it's a connection flight, so I have to be in Frankfurt to pick another flight that is being delayed. have a family, the youngest is just under a year !! I can't spend the night at the airport and it's too late for me to book with another company as prices are double ( the main reason I bought the ticket early for cheaper ) can anyone please assist and tell me what are my options, so far i contacted both edreams and luftanza the airline and I am waiting to hear from them, the only thing I heard from them is that the flight has been changed, nothing else,not even an apology !
