  1. No still haven't sorted it, sent yet another letter last week. I know its only £225 they owe me but its the lies thay told & the fact that they didnt believe that no offence had ever been commited that p**ssed me off. I am going to take it to the next level as per their manuel if I dont get paid this time.
  2. I have just been reading about someone else who has a judgement against them & now I'm really worried. The lady says that judgements over £5000 have interest applied is this true in all cases? I dont want to be forced to sell & I cant remortgage as I am now unemployed.
  3. Hi Hootie16 I have had nothing but trouble with this lot (marstons) Please look at my thread (carnation in the bailiffs section. They took complete advantage of me & then liwd to walk away with the money after adding nearly 500% interest.

Hi Ditman No nothing was signed for ever I now know in hindsight he was too clever for that, due to everything going on around us & he knew we had no contents insurance so every penny mattered, we took him at his word I did not believe someone could do this knowing what we were going through. He did seem genuine at the time even when at the beginning when he said it would only take 6 months to do, he did not even go in the place for the first 3 months. When I rang he said he had an urgent matter to deal with but not to worry, he would do the house to high spec & again he said if work went over the rent would be covered. When all this was going on I rang the Halifax to report him, that was when I was told they had nothing to do with it as I had signed the money to him, I told them about the rent & the £5000 debt they said they only ever pay up to 6 months & again down to the builder/purseholder. They also mentioned that all payments to the builder were made before work even started, paid in 4 instalments to the tune of £48,000. I tried the Halifax insurance (Dax I think) & they said the same it was my fault. I still have a lot of paperwork but nothing on were his promises were made, it was all done face to face or phone. I asked him loads of times to give me things in writing especially the rent payments so I could show the landlord & he kept saying he would put it in the post or he would sort the landlord out. Nothing in writing ever materialised. Only thing he made certain of been in writing was the sign off. When the landlord took me to the count court re. the rent I did not attend as I was ill & at the time didn't understand the paperwork & when I did send it in it was too late. I tried to get it to appeal, but was refused at appeal to have the charge removed. They said someone had to pay for the rent & I had nothing to prove what I had been promised. It is the time frame that now worries me & whether I would get legal aid with it not being a criminal matter.
  5. Hi I'm not sure if i'm in the right place with this query but I was wondering if there was anything I can do regarding a builder I had. In 2004 following a serious house fire in which I fell from the bedroom window ending up in ICU for 2 weeks. At 7.30 am my parents who live round the corner from me got a knock at the door & it was a man who had been to my house asking neighbours did I have family near by as they told him we were all taken to hospital. He told my dad that he worked for insurance companies & sorts out rebuilds & accomodation whilst work is done. He led my dad to believe he worked for the Halifax (My mortgage bank). He told my dad that the insurance company would pay for the whole build & all rental on temp accomodation. As the biggest worry at the time was me & my family my dad put him in touch with my partner a couple of days later. He was ill himself & worrying over me, & believed everything this man said. When I came out of hospital a month later we had a 3 bed house 5 miles away rented. This guy who was sorting it told me that Halifax would pay 6 months rent in advance & if it was not ready one month at a time. (When I came out of the coma apparently I had signed a note about him taking control of the Halifax money). I didnt remember this & my partner is not business minded at all & believes everything he is told.We were told it would take 6 months. After that date the landlord starting hassling me for rent so I rang up Nick (builders name & pursestring holder) & he said he was awaiting Halifax check. Long & short is it went on for 6 months until in the end we had a repossession order served so we had to move out. With no where to go & my home still not done after 1 year the only way I could get in was to agree to signing I was satisfied with the work & accepted a check for £1400. It was only when we moved back we noticed that the house was falling to bits, shoddy workmanship etc. Then the landlord of the rented house wanted £5000 in rent, Nick would not pay it saying it was my fault as I kept changing my mind thats why it went over in time, (not true). I have been told because I signed off the work I have lost the right to sue him (He was given £48000 by the Halifax & spent about £20000 max). What I would like to know is could I still sue him for the rent as the landlord has now taken me to court for the £5000 & now has a 2nd charge on my home. It was not my debt the builder left me with this & a house falling to bits. It also happened in 2004, I have not done anything yet as since the fire I was left disabled & cannot walk without great pain if I take painkillers I end up asleep. Also in 2006 I lost my teenage son to renal failure then I have been in & out of hospital myself since. I just hope its not too long.
  6. Hi all I was talking to a cagger re my claim as I cannot get the forums spreadsheet to work & cannot get my head around working out the interest. I have put my claim onto the spreadsheet but cant get it to work it out I will try & add it as an attachment at the end if anyone can help. Now for the really weird thing I was working out my claim from the papers LTSB sent & for ages now I have owed £1263.85 & have tried to close my A/c down to stop incurring more charges. I was told I couldnt as I owed money. Today however looking at the final page to my statements I noticed it said "07 Aug09 CLOSED ACCOUNT" when I looked further it stated that on the "07Aug09 DEP TFR TO CDR" & UNDER THE COLUMN PAID IN £1,304.17 leaving me with £22.15 in my A/c then after 2 lots of O/DRAFT INTEREST @ 20.28 & 1.87 comes to exactly £22.15 leaving my A/c at zero. WHATS GOING ON? anybody got any ideas & what is the DEP TFR TO CDR mean. Even if theyve wiped out my A/c I'm sure they will still owe me. ps Tried to import Excel doc but I cannot get it to the forum, any ideas.
  7. Hi Landy alert Thanks to you & MB for replying as I need all the help I can get. I havent filed a court claim I was under the impression the banks did this, obviously not! You say it will be easy to amend my claim do you mean I just work it out & put it before the court & if so do I let LTSB know as well. Can you please explain how I put it before a court do I need a solicitor? or do I have to pay at the courts? I am unemployed. Also do my credit card claims go with this one or seperate. Is it worth waiting for more statements as I believe it is soon going to be sorted in the courts As for the loan following a serios housefire I was left disabled & the Insurance paid the LTSB nearly all payments. The insurance paid the last 6 payments into my debit A/c at a time when I had a payment for the fire from the Halifax so I ended up using it for furniture without realising, this is why I now owe the loan. So I dont think I can get anything back on the PPI. I shall follow your thread with interest. Once again thank you.

  9. Hi Landyalert, Just been reading through all your updates on the thread you started. I am relatively new to the site & a complete novice in chasing banks, so I was wondering if you could help me with my claim. Due to a house fire & then the death of my tennage son I let my a/c go under in 2007. I owed them £198 at the time & now I owe £1400 thanks to bank charges. I 2007 I applied for bank charges & they sent me £750, but since then they have been piling on more I wrote & asked for it back & like everyone elsr was told I would have to wait for the test case, I was given a ref No. Now 2009 & been charged all this on my debit/current A/c I applied for all statements back to 2001.Firstly I dont know how to work out the interest or how do I go about changing my claim as they say it already has a ref No. will it be with them or in a court? I HAVE 2 OTHER a/CS WITH THEM ONE A LOAN FOR £780 WHICH i'M PAYING AT £10 WEEK, THE OTHER A CREDIT CARD FOR £1600, can I claim for any charges on the credit card as I've only been paying £10 month for years so it has hardly moved. As for the debit/current A/c charges I have seen the sheets for working out but cannot get my head round it, or how much to apply. I have added below charges & dates I know its a lot to ask but would you possibly work it out for me, Thanks. :???:I have tried to upload my table from docs but refusing to come up Obviously i'm not that good with files etc. Got any ideas of how to get it on screen? cheers
  10. Hi I was wondering if anfone had applied a claim for interest on credit card a/c I have been unable to pay for about 3 yrs now & for the first 3 yrs was paying £10 per month on a £1900 debt. As you can imagine it never moved, & when I couldnt pay they applied more interest. It has now just stuck at 1 amount, can I claim anything back on this & how.
  11. Hi I was just wondering if United Utilities have the power to take money from benefits without asking me. I have a bill of £450 & I owe £220 from last yeay. I paid £50 last month & was going to pay £50 every month. This morning I got a letter saying they have written to DWP & are going to take it from my benefits, & they will let me know. Can they do this?

To clarify a couple of questions asked, my mother had her cats checked for FIP after the lady accused the death of her kitten on her cats, all tests were sent to Glasgow which our vet stated was the leading test place for FIP . All tests came back negative not only for FIP but also Fcov, which our vet said is what leads or can lead to FIP. The lady in question phoned my dad last night & gave him a real earbashing when he enquired about the solicitor friend . She was insisiting that she came today 5th Nov to talk face to face when my dad said no you have decided to include solicitors so I dont think its a good idea, she became really offensive & has now threatened to close my mum down as a breeder, & she can do it she says. My mum has a good reputation with customers some of which have bought several kittens for family members, good rep with fellow breeders & especially with the cat club with whome all are registered. Where do they go from here?
  13. Shywazz I think you may of misunderstood the content or I have not explained myself well. My mum received the phone call within 2 weeks of the kitten leaving, the kitten had a vet check the day it left & was perfectly healthy, my mum did tell the lady if she was worried to take it to a vet as it was covered by the 4 weeks free insurance she got with it. She told her if she was not happy she would refund her money & added it was a good idea with a pedigree to carry on the insurance. The lady chose not to. Since this my mother had her own cats checked for FIP all of which are negative, she did this to protect the future unborn babies and her adult pets. In my opinion she is trying to label blame & gone for the breeder when she should of sorted it out herself or carried on the insurance. I know having the funds does not bring your pet back, but neither does offering her another kitten or taking my mum to court replace her pet. So suggesting she gets a freebie to help her is neither here nor there if it is only the death of her pet that is at issue.
  14. Could this be true if the disease in question FIP can be contrcted at any time either by being a carrier or contracting it within the 12 months she owned it. If it had it as a kitten and stress is the factor for bringing it on there surely when it was re-homed the stress from that would of been evident as it is it appeared a year later & a 12 week kitten with FIP would certainly die within 1 week.
  15. Hi i'm sorry if I keep popping in differnt sections but I am looking for an answer to my bank charges. In 2008 I applied for reund of that year as I now owe £1400 in charges, since then I have received statements back to 2001 I want to also claim back on these. The Lloyds have given me a ref No. & said they will let me know after the test case but now I want to add more. Do I just write to them or is it more technical & how do I word it? I read somewhere that some cases have been turned down because they were worded unfair bank charges & should of been penalties or is it vice-versa.
  16. :rolleyes:Hi Dorabell I'm in the same boat with this bunch, I get letters from morrcroft on a weekly basis, for my Loan A/c, my Credit card A/c & my Debit A/c, On each occasion they have written I have said that all A/c are in dispute but still they come I dont know what elsr to do . Apart from letters from Moorcroft I get them from Solicitors Secchari & Clark I think & they too ignore the fact that it is in dispute. Perhaps they cant read
  17. I currently owe the Lloyds £1400 on my visa electron debit A/c, it has reached this much due to bank charges @£200 per month, from being only £190 overdrawn. I wrote several times telling them that I had lost my son, had a fire & been ill & would they freeze my A/c to stop incurring charges. They have said that you cannot freeze an A/c that is O/drawn. I have said in 2008 I wanted to claim charges back they have written & said it is listed with a ref No. & I have to wait for the court outcome. I have since received upon request ststements dating back to 2001 & want to retrieve these charges as well , where do I go from here? Do I just write with the amended amount I want back or is it more technical.
  18. Hi I have just managed to get statements dating back to 2001 from the Lloyds although they made me wait 76 days. What I am confused about is where I go from here, as I have told them I wanted to claim in 2008 & they said it had to wait until the court outcome. How do I now tell them that I want to go back to 2001, is it simply a letter or is it more technical.
  19. Re: Shop Direct I have been receiving letters fom a DCA for a debt I am supposed to have had with shop direct. I wrote to them on two occasions asking when & who the debt was for & sent them £1 PO They wrote back saying I owe £220 for Kays catalogue but no date as to when it was ordered or what was ordered. They are still demanding money. Now what? I sent a letter from the site I cant remember if it was a Subject access report or a CCA . On one letter they sent back in answer to my query was an unheaded letter with Balance on it for £255.27 saying original creditor Shop direct, brand name - Kays & annual statement period 1 Oct 2008 - 30 Sept 2009 If I did use a catalogue it must of been at least 8 yrs ago. & im sure I paid, Then at the bottom it says Phoenix recoveries UK acting on behalf of SDFS recoveries. On 8 Oct 09 I got 1 letter of Mackenzie hall Debt recovery asking for £135.63 for Shop direct & then the next day 9Oct 09 A letter from Credit Account Management Ltd asking for £255.27 again., for Shop Direct. Who is actuall chasing for this money? They havent sent any details of the existing A/c especially dates. I dont know where Im up to with them.

  21. Dear Sir/Madam I am looking for some advice for my elderly parents, who are breeders of siamese cats. A lady bought a kitten 16 months ago aged 3 months. A week later she rang my parents & said it was sneezing, my mum told her it was nothing but if she was worried she would take it back & give her a refund. This is something my mum has always done as she worries about the kittens not been wanted or loved & would rather have them back. The lady said she would see how it went. That was 12 months ago, suddenly my mum got a call saying the cat had died of FIP, & according to her the vet said it could of carried it from birth. Our vet has said that FIP can be contracted at any time & the cat could of caught it recently, especially seeing as though she has had it 1 year. She has now got a friend of hers writing letters saying she is a solicitor with the name of the firm but her own mobile No. my dad has checked the web & there is no one by that name working for the firm she says. She has also stated she is not working as a solicitor but as a friend for the lady who bought the cat. She did however sign it then wrote soliicitor. What I want to know is , is she acting illegally saying she is or is working for a solcitor, & ihas my mum got any comebacks after all this time, bearing inmind no one gives a guarantee with an animal except my mum who would take them back within a month if the customer was not happy.   22. I,m not sure about what steps to take now regarding Marstons as I am not sure what they are actually entitled to do. On the letter it says certified bailiffs & civilian enforcement officers. From answers to my questions it seems they have overstepped the mark in the way they acted but does that apply for CEO's collecting court fines.I have written a letter but dont know how to end it, should I try & appeal to their better nature! for repayment or give them all the legal technicalilties I have read, I'm just scared I may quote the wrong thing. Bearing in mind they acted wrongly demanding money from me for a fine that belonged to my son. My son told him he had nothing so he turned on me. Plus he wouldnt get his foot out the door, I had to sit on the floor as I'm disabled & he wouldnt go & lastly he lied to me so I would pay. He said I ould get every penny back if the Courts refunded the fine when we prove he was innocent. Now he reckons & so do the courts that he acted legally.

  24. Sorry bank fodder answered your question in wrong place. Thanks for your reply. I dont know wher my claim is right now all I know is that the TSB have said theyve filed my complaint, given me a ref No. & said they will let me know after the test case. I was assuming that it was with the courts, does this happen automatically or do I have to do this myself I am really confused about the whole bank charges & claims thing., & what do I do when I finally get the statements dating back to 2001. Do I contact the courts myself & if so how, the TSB is far from helpful.
