  1. Have you had a warrent of execution? The baliff requires a warrent of execution before they can do anything. They ge this froma county court which meens you would have recived a letter and soemthing called a defence pack (so you can put in a defence.) I to got a letter today from them (jacobs) about parking in maidenhead when i have recived no ticket nor any letters. I am trying to find which court they are registerd with so i can make a formal complaint as they are not allowed to make threats that they will ltake actions that they cannot legally make i.e take you car without a warrent of execution. I would say do not take the advice of dragon dennis to talk to them by phone it is higley suspect advice as baliffs want you to talk to them by phone so they can bully you into paying wihtout any record of it. Always do everything by letter so you have a record also its harder fro them to bully you into an agreement and send the letters recorded delivery. i would make a complaint if they have not got a warrent of execution.
  2. Well I have a reply back from experian saying that they cant remove without authorisation of payday and payday are strangley silent after my last e-mail pointing out ther silly request for something that they have had many times. Time for a complaint to the ICO.

Yes i have asked the CRA's to contact payday. i did end up sending that e-mail interestingly they went from replying to my e-mails very quickly (in terms of response times payday express have actually been the best company i have ever dealt replying in just 3-5 minutes) to not replying to last one. will let things settle for the monment and see what replies i get.   4. i have contacted the CRA and let them know. I have also e-mailed Payday Express (PE) and there now asking for an up to date Credit report before they can help. Umm you already have it that's what I'm complaining about cant see why they would need that to help so may just complain to the ICO straight away as they are playing silly buggers.. The below is my reply to them, depending on how they reply to this I will fire of a complaint to the ICO. Hi, I have had no previous dealings with your company. I do not had out personal information without good reason . I can see no reason you would need an up to date copy of my credit agreement to help me. You already have an up to date copy this is what I am complaining about. Please give a reason why you need a second up to date copy of my credit file as this feels like a fishing exercise than an attempt to help. Please explain the continued unauthorised searches on my credit file please ceased and desist these credit searches on my file. regards
  5. Well i did use them nearly a year ago for one month, but cant believe that gives them the right the look at my credit file whenever they fancy after i have paid them off. Whilst it did get me out of a tight spot I agree they should be banned it seems the way the behave in general is just unethical.

Just recently every other month or so i get an unauthorized search on my credit file by payday express. am i able to tel the credit reference agencies that payday express do not have permission to search and that they never will have. Also any ideas on how to get this search taken off as it was not authorised.
  7. Hi cagers, I have an MBNA Virgin card with £5000 on it. Lost my job and was out of work from august till now and i wont get paid untill the end of this month. I informed MBNA of this and that i would not be able to make a payment until the end of this month. Now i am getting bombarded with calls from them and have stopped answering but still they try despite them being fully aware of the situation and the fact they WILL get paid on the 29th Oct. As a result i have decided to see if they actually have the correct paper work and do a CCA request. Does anyone on here know a good contact name and adress for MBNA? Also if you could take a look at my letter below and see if it looks ok. would be much appreciated. Dear Sir/Madam Re:− Account/Reference Number ********* This letter is a formal request pursuant to s.78(1) of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77(6) will apply. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR). I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.   8. Yes i have one about payday express taking money that wasn't even owed to them. I had a loan with which was paid off then 3 months later they decided to help themselves to another £400.
  9. I am currently in dispute with PAyday express over an account i have never had with them. i now find that they have made a credit search without my permission. I have contacted credit expert who have contacted payday express and they say its accurate etc and that they can only put a correction and not remove the search. I belive payday express have done this to try and damage my credit file what action can i take against payday express\experian to get this removed from my credit file.
  10. Just got a very nice letter from my bank refunding everything payday express took! it seems the banks will take action but you have to be inisistant that they treat it as fraud once they do they take swift action. Thank you MRs Hobbit and Jamie.

Thank you all for the advice, NatWest are being much more helpful after I sent them a letter complaining about the first contact I made with the fraud department as the person who I spoke to on the phone completely misled me. I also told them to cancel the card and that I do not authorise any payments from that account. They have sent me a declaration letter so I will sign that and see how it goes, frankly I suspect incompetence rather than genuine fraud on payday express part but they probably won’t admit it until the bank gets involved. It goes to show that if you stand up to them and don’t accept their attempts to fob you off you can get the banks to do something positive.
  12. The point is i dont owe them anything i took out a loan paid them in full i have the bank statements to prove this. Now they decided they want more money and took it or they have messed up and dont think i have paid but as it has been over six months since i paid it off i doubt this.
  13. In oct alst year i took a payday loan (£250) with payday express and paid it + interest back the next month. In Feb i started getting calls from them saying i owed them £800 i told that that i had paid the original debt off and asked them to provide proof of this new debt, i recived no reply from them and the calls stopped. Sudenly at the end of June payday express took over £400 from my account. I have contacted natwest who after my badgering finally opened a fraud case but i was told i was unlikely to win. Anyone have any help or suggestions on how to get my money back from payday. needless to say they dont answer calls or reply to letters.
  14. I had a run in with that quality debt collection agency Lowell’s and for about 5 years they tried to chase me for a debt I didn’t owe on a credit card I never had. I finally managed to get them off my back by asking for proof of debt which unsurprisingly they couldn’t provide. The problem is it look they placed a default on my credit score with Equifax early on in the process (It doesn’t say who put the default on the file just that it was debt collection agency). My other credit scores with Experian and Callcredit are very good as they are accurate and I have always paid any debt owing on time. Is there anyway of getting this inaccurate default notice taken off my file and do I have any legal recourse against those who falsely placed it on there in the first place?
