UPDATE: Letter sent to council, they recived it, I called, chased, called,chased told them about the baliffs sitting outside. Reply: this was via an answer phone message. 'sorry cant do a lot its with the baliffs' I called back and she wasnt available, I told the guy to make a note that I wasnt refusing to pay this debt, which he did etc.... He said there is nothing that can be done until baliffs pass it back. I offered payments,asked them to take it back, said I would report them, they did not care. Its now been 3 weeks and STILL with baliffs, no more visits but its been passed now onto baliff number 3. I am so annoyed that I have to watch my back coming into the house and looking for cars when I go out. When will this get passed back to the council? Sick of feeling like a prisoner in my own home (my front door is straight into the living room, and you can blatenlty hear if tv etc is on) scared they will bank my door down. What is the next step?

if he comes tomorrow I certainly will call them lol, must remember to take his number plate down. He comes in a car. I complained to the council for the harrassment, will call 2moro again as no doubt they wont be back until next tuesday now. I am going to stand my ground this time, and if no luck via phone, will bring the kids with me next Tues and visit the council. Since day 1 I have kept a diary of every call/dealing with equita. Even names of the idiots I have spoken too. Strongly advise this to everyone as you will always have this as back up. Will keep you updated. The baliff dealing with the case is also 'head baliff' so it says...... physco baliff more like.

Update: Letter Received at council today that I wrote re: taking debt back. Should be dealt with by 15th. Also rang up today to complain of baliff harrassment, baliff was sat outside my house on 3 occasions today his shortest stay was half an hour!!! A memo has been fast tracked to head office (Birmingham City Council) and I should hear from someone within 72 hours

They have been threatening in phone calls and letters. I feel even better now 'no wonder councils ignore most complaints'

Letter yesterday you have 24 hours to pay hand delivered via baliff or he will take the goods. Obviously never called him, THINK he called today, my daughter heard the door and I saw a car drive away. Letter should be with the council 2moro, asking them to take the debt back, baliffs being threatening etc etc. Will the baliffs keep trying everyday? Or give up as I didnt react to the 24hour or else letter? Thanks in advance!

Thanks for the replys, I will write to equita and the council and send off 2moro, I will stress that I have 2 yuong children and it is causing me to be ill (white lie wont hurt surely) 1 question, how long before they give up? I have never once refused payment. They have just been stupidly unreasonable.

I really appreciate all your help thanks everyone i take you have been in touch with the council and the refused to take it back YES however there is nothing stopping you paying it direct to the council on line I SUGGESTED THAT IN MY LAST LETTER EQUITA SAID IT HAS TO BE TO THEM have you checked that the liability order of £600 that was passed to the bailiffs is correct YES CORRECT have you check with the council that you have been taken back to court (in my opinion they have not and it is the bailiff trying to frighten you ) NO NOT AS YETthe bailiffs chargers are defiantly wrong have they ever put anything hand delivered through your door or have they done it all over the phone or by post LETTER VIA HAND THIS MORNING, NO KNOCK ON THE DOOR

Sadly not in writing, equita said that they have noted the system, no letter about court again though. I wrote a letter beginning of march stating everything that had happened previously with the baliff, I kept a diary of every time I spoke to someone and wrote down everything I did and tried to do. Equita then had the case passed back to them from the baliff so I believe as we were getting letters we got before it was ever passed to a baliff. Thats when the agreement of 1st April came about as I said thats when I would pay in the letter. In the mean time it has been passed to another baliff, who is now demanding FULL payment in a months time

I spent a whole month trying to sort out payment with a baliff equitta, sent letters and hurrah they were accepting a payment on apr 1st. rang up........ passed to another baliff GUTTED Got a letter hand delivered today. Rang equita they wouldnt speak to me, snotty as usual. They transfered me staright to the baliff without me realising!!! Apparantly we have until 8th MAY to find £600 what we owe plus £173??? (god knows where that came from) He said the council have taken it back to court as we defaulted payment (we tried to pay no-one would speak to us as was with baliff) Can anyone advise what I do?? I have 2 small children they have seen me in a right state all morning, I dont want them to see all this!! They are acting like I never tried to sort it all, and demanding payment :confused: Please can anyone help me on what to do??? ps.... not classed as vunerable, my partner works

Hi pregnant Please dont worry. This is my advice up to you if you choose to take it of course. Write to EQUITA recorded delivery. Include an incoming and outgoing sheet and an offer of what you can afford each month to pay off the debt. In the letter tell them you have sought the neccassary advice and you were told that the £300 charges were wrongly added. Tell them you would like a breakdown of what these charges are for. I have been there with equita and they dont listen via phone, by sending a letter I have managed to get my case passed back FROM the baliff back to equita and have set up a payment plan. Dont worry, and try your best not to let the baliff in your home. I know it plays on your mind, I have a 3 month old baby and a 4 year old daughter so really didnt need the worry (Like yourself) Best of Luck Kerry x

After baliff threats, removal threats, people cutting me off via phone you name they did it lol. Equita would not speak to me as the case was now with the baliff. I wrote a letter containing a diary of events, when things were recived, what I did to try and sort it (called equita. called baliff he wasnt intrested etc) wrote every little detail down. I stressed how many times I tried to sort it and was fobbed off. The letter contained an offer of £40 per month on a £600 debt. Also included an incomings and outgoings sheet. Got a letter today this time reminder notice. Rang up and spoke to the first DECENT person I have spoken to from there. The case in NO LONGER with a baliff, it has been passed back to equitta and they are accepting our offer, all notes are on the system now thanks to the lovely lady I spoke to at equita. My point here is, WRITE EVERYTHING DOWN. CONTACT THEM IN WRITING. IT CAN BE SOLVED If you are not happy with the person you are speaking to at equita, ring up and speak to someone else. Good Luck

When you get traced via various sources, how accurate is the information? My other half has just had a letter come through from 5.5 years ago. Ideally would like to hold off until the 6 years is up (naughty I know) If we dont reply to the letter, will they just think he doesnt live here? Thanks in advance.
