  1. OK I understand that so I won't publish the recording. My mother ordered another PS4 from Kay's (http://www.kandco.com/) on a buy now pay 12 months later so that I could give my son his Christmas present and not have to pay for two of them until I sort this out and hopefully get refunded for one of them. The new console arrived today and sadly it is white and not black like the broken one or I could just have sent the broken one back pretending it to be the new one that I hadn't used. That said I don't really want to start doing stuff wrong as I believe I am in the right and don't want to give them any reason to make me look bad. I went to my mother’s house today with the recorder and she phoned the company. She verified her account and asked if I may speak about the PS4 issue which they agreed. I told them that I no longer wanted a replacement or a repair because I had replaced the console. I didn't say I had ordered another from them and they didn't ask although the information would be on the account. I said I wanted a return address to send the faulty console to and for it to be credited back to our account. The woman at Kay's said that we would need to speak to the electrical department for that to happen and said she would transfer the call. Ten seconds later she came back on the phone and said the line was busy but gave us a number to continue trying. We took the number but asked if we could hold anyway as we wanted to get this sorted out asap. She said that was fine and we would be placed in a queuing system. After a second or two we heard a ringing tone which for some reason sounded like an overseas ringing tone. After about 6 rings a recorded voice stated the line was busy and "do not redial this number"! I have never heard such a message before and after the line went dead. I then phoned the direct number for the electrical department we had been given to get another recorded message that I have heard before, "The number you have dialled has not been recognized"! I even double checked we had written it down correctly from the recorded phone call and we had. We again phoned back on the normal number, went through all the automated crap again before being answered. My mother asked to speak to after sales and her reply was, "Are you the lady about the PS4"! They put her through again and again I took the call with permission. I again told the woman I wanted to return the console and that I wanted a return address. She asked me if I had a reference number from the help centre. I started to get a bit [removed] now, the only help centre they had put us through to was Sony PlayStation and they confirmed to me that the console was faulty and needed to be sent in for repair. They didn't offer any reference number and I had no intention of sending in a brand new console for repair, at the time I intended to have Kay's exchange it so that is as far as I went with Sony. I told the [removed] that I had spoken to the help centre and that they did not offer me any reference number. She said that was alright and she would put me on hold while she got the reference number from them. I didn't see how she was going to do that as Sony didn't even ask me my name or for the console serial number etc. I probably should have guessed it was just another blow off after listening to music for ten minutes before I hung up. Well I am at a complete loss on where to go with this now. I think their customer service is disgraceful and the way they won't let me return faulty goods I bought from THEM without keep passing the buck to Sony. I have uploaded the terms from the back of a statement if anyone wants to read it.

  4. I recently purchased a Playstation 4 for my son for Christmas from my mothers catalog company called Kays. We bought it on credit at £500 over 32 weeks and have paid the first instalment. My son was unable to use it for four days during Christmas as the Playstation network was down. We have now set it up for him to find that the disk drive is faulty and will spit out the game disk or not accept it at all. I contacted Sony who after troubleshooting this with me agreed that the unit was faulty and that they would accept it for repair. I know from working with repairing computers and consoles that sending this back to the manufacturer can take weeks and often months to get it back. Beside that I feel as it is supposed to be brand new I didn't want a repaired console, I wanted a new working console, especially as I have paid £100 more than what they cost in the shop. I asked my mother to contact Kays and have them collect it and replace it. My mother did this and was told that we must return the unit to Sony as they will not accept it back if it has been plugged in, faulty or not! I feel this is outrageous as we did not buy it from Sony and have no contract with them and I have never been told I can't return goods less than 30 days old that don't work correctly and get a refund or replacement. So I wonder can anyone tell me if goods bought on credit from a catalog are subject to special terms where the creditor takes no liability for the goods they supply? I appreciate any help here as Kays won't budge.

  6. I felt the need to share this information with all buyers from eBay. I recently bought an item that cost £160 from a seller with a good feedback score. I read that the item would be sent by tracked parcel with Royal Mail so I went ahead with the purchase. After a week and the item still not arriving I checked the provided tracking number to find to my surprise that it was reported to have been delivered. I contacted the seller who was very unhelpful and stated that as far as eBay and they were concerned it had been delivered and that was that! He or she did say I should make a claim at my local post office for the lost item. I first went to our local sorting office to see if it had been returned undelivered but it had not. I asked the clerk if he had any forms for me to make a claim but he said that only the poster can make the claim as they took out the insurance when they purchased the postage. He also stated that if it was signed for the sender could get evidence of the signature used to sign for it. I emailed the seller again when I got home and asked if they could start a claim on the advice that the post office gave me and if they could request the signature card. Sadly the seller just stated back to me the tracking number and would not give me any of the information I requested or help in getting a copy of the signature card. It is only myself and my family that live at my address and I don't share a post box or anything like that so I thought if I had the signature I could look up the surname and see if I could match it to anyone in my street who may have had my item delivered to them in error. Because the seller declined to help me I was left with no options and had to start a dispute. I also decided to leave negative feedback stating that the seller would not help me with the information I needed to recover my parcel or my £160. To my shock eBay removed the feedback when the seller requested them to. When I asked eBay what was the justification in doing so I was told that it was likely an automated removal due to 'key words' being used. Just to clarify I used no bad or insulting language in the text whatsoever. Several days later and after no response from the seller other than to gloat how they had the negative feedback removed I escalated the dispute to a claim. The dispute was quickly awarded in favour of the seller as providing a tracking number is all they need to do to cover themselves according to the eBay decision maker. I have since found out that a tracking number can be bought for just £1.00 and the parcel doesn't need insurance or indeed to be signed for in order to have a tracking number attached to it. I am quite sure my seller did not insure the goods nor had them to be signed for which is why they were avoiding answering any of my questions. So there you go, when you're thinking you have eBay's 'buyer protection', think again! It just cost me £160 and I feel like eBay have not even considered a single effort that I have made or that the seller was in any way negligent for sending high value goods through (most likely) a standard postal service with no cover. I have appealed the decision but it looks pretty hopeless. I may very well take this to small claims just out of principle.
  7. I bought a Samsung Galaxy on Xmas eve for my partner from Argos. When she tried to turn it on it doesn't work or even charge up. Will Argos replace or refund me or will they repair it and I'll have to wait to get it back? Anyone know?
  8. I just did a search to see if the bailff that visited me is certified and it seems he is. However the other 2 monkeys he brought with him that were on my proprty are not listed when searching the company name. Is that of any use to me?   9. What does a warrent look like? I will upload the only paperwork I have from any of this to help clarify things. The baliff showed the police the same paperwork and they accepted it as legal though. I still can't find my car, have been sent no receipt for it or informed of it's whereabouts. The police only seem interested in charging me for criminal damage and won't verify I called them previously and was told it was a civil matter. The only solicetor I found to ring me back says in order to get back my goods and contents of my car I have to get the court case number from Sailsbury court then download an N244 form and start a small claim. He advised it would cost me hundrads for him to assist me, there is no legal aid, I got to pay around £50 to start the case off and that it will take months to go to a hearing date. All that stuff about baliffs not able to take work cars / vans seems to be pretty pointless when it happens as there is no one it seems to enforce it! May I say though that I really do thank you all for your input and comments. You lot on this website have been 10 times more helpful than everyone else I have spoken to put together.
  10. The bailiff was Empire Enforcement, Ferndown, Dorset. I did not break any of their equipment I at no point acted aggressive toward anyone What upsets me the most is the police saying they wouldn't get involved even if I took my car from the bailiff, the bailiff not reporting my car stolen the first time, further convincing me he was full of **** and getting arrested for breaking into my own car on my own property and being told by the police the car belongs to the bailiff if he lays his hands on it (and I'm expected to know that) after what the police told me the first time.
  11. LOL! Well that don't surprise me, I guess I'm just doomed with this! I'm not so great with writing. I did my best with MS Word so I hope someone kindly takes time to struggle through it and advise me:-(
