  1. I received an email about the entitlement, and its a large Ltd company. No idea about the employment contract as I don't have a copy and I've been trying to get one from the company.
  2. Quick question. I was given 747 shares as "free" shares by the company I've recently left. They were given to me end of last year. I left the company at the start of last month, and received notification today that I have 15 shares for being with the company for 0-3 years, which I get to keep. (They are worth about £10 but it will cost me £20 to cash them in.) The "free" shares given to every employee they have taken back. Obviously this is about £500 Im missing out on here. Is there anyway to argue this and demand that the shares NOT be forfeited ? I certainly don't recall any clauses stating I would forfeit the shares for leaving the company.
  3. The Bailiff pushed his way past your wife. So he forcibly and aggressively gained access to property without permission. Did he touch your wife at all ? Did you get the Bailiffs name ? If yes to all contact the Police and report it as assault against your wife, and forced entry. Point out that she is disabled, and was scared and the Bailiff was intimidating (Im assuming he was) and have the Police deal with it. If you are lucky he will be arrested and charged with a few things that will hopefully at the very least teach the **** to play by the rules or reap the consequences.
  4. Hi, I was advised to post here to get some advise. I (stupidly I know) had an account with Quick Quid. I found I couldn't make the payment plan so I restructured the payment plan. I made a payment to them over the phone with my debit card. The next month they took the entire outstanding amount and a £12 penalty late fee without my approval, and against my direct instructions NOT to take any payments without me being on the other end of the phone approving it. I agreed a payment plan with them and they just ignored it. I claimed the money back entirely from Visa/Natwest but Natwest didn't receive my later fax (although the fax machine I used confirmed their receipt grr) explaining the situation when QQ protested at the refund, so Natwest gave the money back to QQ. I now have to write a later to Natwests Fraud Department to claim the money back again. So I need as much accurate info as possible regarding the laws about payments and use of card details to make it as hard hitting as possible to ensure that Natwest will give me back my money !!! Anyone able to help ?

  6. Does anyone know the specific law/s that relate to an organisation taking payments from your card without your approval ? I know they exist but I don't the specifics of the law and I need to write a letter to Natwest about Quick Quid having done exactly that to me.
  7. No idea, as in I don't recall any minimum contract period. And I don't think that anything we signed was given as a copy to us. I need to have a hunt around at home though tbh.
  8. I cancelled my Fitness First direct debit (in fact it was the wife's DD but the account was in my name) and I've been getting nasty letters from C.A.R.S DCA. I've told them that it was a month by month pay in advance account and I do not owe them £180 (basically 6 months of membership) but they are being the usual dca gits. Now I have a lovely letter from them stating that they are going to go for a CCJ. Can they ? Im sure they can't as its not a credit agreement, but as I stated above its a pay inadvance monthly dd membership which is now cancelled and they've ceased providing the service as Im not paying. Anyone know ?
  9. Right, the letter demanding the PPI went off weeks ago and I've heard nothing from them. Any other steps I can try before starting court action ?
  10. Thanks Sillygirl, I'll get on that when I get home tonight Your post did make me want to put my little finger to the side of my mouth give a little evil smile
  11. I made an agreement with Quickquid to make a payment of £50 a month on the last day of the month to pay off the remainder of a £470 loan. (I emailed and phoned them, and got the usual rubbish over the phone.) Last Friday they took two payments from my account using my card without my authorisation totalling about £500. I've reported this to Visa as un-authorised withdrawals and they are sending the forms to claim the money back. However this morning I've noticed that Quickquid have taken an additional £100 from my account as well. Which means that even if I were to allow them to keep the money I owe them (which I won't as I can't afford to be without that money) they've taken £130 too much. Any suggestions ? I haven't bothered talking to Quickquid directly as their phone staff are useless phone monkeys who talk utter tripe !!
  12. I've rung QuickQuid today to agree a payment plan with them and they are thoroughly unhelpful. Demanded 3 months payment plan, said they'd take the payments at the end of the month, despite me telling them they had no authorisation to take any payments without me expressly approving it. Also the girl I got was the most morose and bored sounding individual on the plan. I joking said she sounded bored and she responded in a flat bored monotone. "No Sir, Im very happy today." Suuuuuuurrrreeeee dear, of course you are. Its got to be the early hours of the morning/night where she is in the US so Im sure she's loving all the mega fun she's having.
  13. Bugger I had the worlds oldest (he was wearing a cravat) and least switched on District Judge in the world today who despite the obvious evidence in front of him still found in VM's favour grrrrrrr
  14. Yep 8% from date of charge to date of claim (it was worked out a few days ago.) The first date of claiming 8% is the first date of charge after the actual finance and charge are paid off.

  16. I can email you the spreadsheet if you pm me your email address.
  17. So other than needing to add in the account numbers and amounts, the letters ok ??
  18. I have the spreadsheet, I was just wondering about the wording of the letter. I thought I might give them the option of coughing up now and they save them the 8% charge (which in my case works out to be another £500+ on top.)
  19. Im planning on sending the below letter to Welcome to claim back my PPI/MBI and overpayments. Any suggestions, tips ?? --------------------------------------------- Dear Sir, I purchased a car from Yes Car Credit, that was financed by Welcome Car Finance on the , included within this purchase was several insurances: Payment Protection Insurance Mechanical Breakdown Insurance Insurances Finance Charge The sales person stated that all insurances were compulsory and subject to the purchase of the car. I have been informed that this is not the case and all insurances were optional despite the claims made by the sales person. In addition to the PPI being mis-sold as compulsory, the Mechanical Breakdown Insurance was also claimed as a compulsory addition, which was never adequately explained. As both of these insurances were supposed to be single payments, they are thus not subject to a finance charge, yet Welcome Finance charged one without giving adequate reason or explanation for this charge. Welcome claim that my original agreement has been replaced with a second agreement. I have no knowledge or paper work for this, and you have failed to provide any evidence of this. I did previously request in the past a change of the monthly payment to be paid at a lower amount over a longer period but that was under the same agreement and most certainly not under any new agreement. I have calculated the amounts owed to Welcome for the Finance of the vehicle and how much I have paid. I have discovered that over payment has been made to Welcome. This is after deducting all of the illegally added penalty charges your organisation has added to my account. Especially including the charges for payments failing to go through on perfectly valid cards that would then go through on a second or third attempt. These charges fraudulently enrich Welcome Finance at my expense for equipment that is faulty, and is known to be faulty by Welcome branch staff. As a result I expect the below to be completed within the next 14 days. Expected Resolution * Refund of misold PPI equal to £ * Refund of Mechanical Breakdown Insurance equal to £ * Refund of Insurances Finance Charge equal to £ * Refund of overpaid amounts on the agreement equal to £ Failure to completed the above will result in me beginning legal action against Welcome to recover the funds. If I have to do this then I will add 8% interest. I will also be making a formal complaint to the FSA with regards to the credit/debit card payment failure charges as fraudulent charges. Yours Sincerely
  20. The only issue I have noticed is that this agreement dates back to 2003
  21. Thats why Im thinking of sending an LBA, give them a set period to respond and pay up, (probably 14 days,) and then begin court action action. Its had the quickest response from Credit Card companies who like to use the "blah blah terms and conditions we can do what we want" approach to writing letters. But they crap themselves when you start legal action against them.
  22. /MrBurnsMode Eeeeexxxcellent Clearly I shall have to tell the wife to look after the munchkin and get to doing some hardcore reading So an LBA with a threat of court action telling them to cough up or I add interest on a good starting route ? Or just demand the interest as well anyway ?
  23. Anyone know what this is, and can I claim it back ? As surely any car bought comes with a warranty as standard, and this Mechnical Breakdown Insurance is like PPI ?? http://img215.imageshack.us/img215/4484/agreement.jpg
