Thanks for the Links determindator, very interesting, I am getting different advice on the matter, some advise to write to ParkingEye LTD and other advice to ignore them as they have no right of enforcement in Scotland and that a reply gives them ammo to harass further. The Town we stay has never had parking charges from the Council due to a local bye Law, so as the Council cannot apply parking charges, surely private Land owners also cannot.

  3. I don't think the 6 years are re started, Offering them £1.00 each per month is an option, that would re set the 6 years, another option is to ask for CCA requests to find out if collection of the debts are enforceable or not.

  5. The oldest one that you have listed is three mobile, if you are in England, this will not be statute barred until December 2015. You could using the letters template on this site and ask Lowell to provide a copy of a valid Consumer credit agreements between yourself and the original creditors.

  7. Hi Richtegill, were your Creditors in touch asking for payments before you looked up your credit record, and have you any idea when you stopped paying them ?.

  9. Thanks ericsbrother, I will write to them tomorrow. I went in to Aldi today and explained that a purchase was made that day, the Manager said that the time parked and with no receipt they could do nothing, and that I would need to take it up with ParkingEye.

Thanks ericsbrother, I contacted Aldi customer services, Aldi own the car park and hire ParkingEye to collect money from non customers who park there and go somewhere else I was told that we should go into store with receipt, which we don't have and try and trace sale so charge can be scrapped, then the customer service rep asked my surname, then the line went dead as soon as I answered.

We note from our records that the previous two parking Charge Notices we have sent you, which refer to the Parking Charge issued in accordance with the terms and conditions for parking in the Aldi Car Park on 22/01/2015, Remain outstanding. The amount now payable is £70.00 * This payment is required within 7 days or further action may be taken. If this letter is ignored, further action may include instruction of solicitors to secure immediate payment or the issuing of court proceedings which could incur further costs which may be added to the amount owed. To avoid further unnecessary costs or action, please pay the outstanding parking charge amount as stated above or make arrangements for the driver to pay, in accordance with the parking terms and conditions. Yours faithfully Legal Department ParkingEye Ltd My Wife parked there to go into Aldi and made purchases in the shop, then left the Car there to go and pick up our Daughter from the nearby Dentist, A few days later she received a letter from ParkingEye with a picture of the Car and registration number, We have since ignored their demands. Am I correct that in Scotland that only Police and Local authority notices are binding and that private companys have no Legal enforcement right to collect, so rely on fear for collection ?.

My Wife got a letter of fine for parking in an Aldi car park in Ayrshire from Parking eye of £70.00, with an offer of £40.00 if payed within 7 days, she had been in Aldi for some of the time but did not keep the receipt. we have ignored the letters as we consider it an unenforceable [problem], the third letter mentions possible further action. Is this action legal in Scotland ?.

    I agree with you topcat, i was VAT registered untill last year when i de registered and find it one less hassle, a lot better for a small company.

I have never had a home visit and dont know anyone who has from a DCA, it is a threatogram, Go to the CAG templates Library and copy the Statute barred Letter and send it to them 1st class recorded delivery, In Scotland after 5 years since last payment the Debt no longer exists. Keep us informed to their reaction.
  16. I searched Noddle and came across My Credit Tracker and registered, they say you can view your Credit score in minutes online yet they are going to post details to me in 7 working days, i take it that is a welcome pack with log on details ?.
  17. Hi Florish, you are in the clear, what is Call Credit and Noddle ?.
  18. A Sheriff Court judgement would show on your Credit file and be there for 6 years, so as your file is clear, then no they have not took action. I believe that a claim against you without the correct address would not stand up in Court anyway. As for contacting them, probably best not too unless they got in touch with you, i beleve if they wanted your new address they would have got it, i doubt if you will hear from them again.
  19. You could check your credit file online, some of the Credit reference agencies such as Experian give a thirty days free trial. In Scotland after 5 years since last paying or acknowledging the debt it no longer exists.

    To be VAT registered you are supposed to have an Annual turnover above a certain Threshold, being VAT registered you can claim back some of the VAT by filling in a VAT return form, as by your post you do not yet know how to do this, then you need someone who does to help you, such as an Accountant.
