Hello I recieved this from the court granting tesco(incasso) a CCJ.It is for the exact amount that I pay into my DMP with paypal.What I dont understand is, payplan have just e-mailed me saying they have sent documentation to the court and asked for it to be heard at a local court. I have phoned paypal but they have gone now.I was just wondering what paypal are doing.Surely getting the same amount set by the court is a good thing.I was expecting the court to suggest something ridiculous.I an happy with the amount set,which is what I pay anyway. I just dont understand what Paypal are doing now and what they hope to achieve.I dont understand the system at all. I have blanked out a copy of the CCJ attached below. Thanks

  3. Hello , I requested a True CCA from th Halifax for my credit card.They sent the following.Its it enforceable.The letter says they dont need to provide one. Thanks

  5. Just like to add.I only ever recieved 1 letter from Incasso (tesco) solicitors. It gave me 7 days from the date of the letter to pay in full or I would be in default.is this right also. Thanks
  6. Hello, Yes I did let payplan deal with it.I regret doing that and wish I had sent the forms off myself. The point I am making is why did Incasso not reply to my CPR request.I requested that before I passed the court forms to Payplan. And my other point is Tesco never defaulted me, I have read on here somewere that they should have defaulted me before going to court for a CCJ. So I am just asking the forum for advice,could I appeal the decision, on the grounds of no CPR / never defaulted. Or is it pointless. Thanks Andy

  8. hello all, 4 weeks ago i recieved court claims from northampton court.They were sent by Incasso(tesco loan). I sent the forms to my DMP provider and they dealt with the papers. I now know i should have filed them in,and submitted a defence.Obviously payplan would have admitted the debt etc. However I asked incasso for a CPR and they never relied ( they signed for it) 3 weeks ago. I aslo sent the request to tesco just in case I needed to. I would like to also add that tesco have never defaulted me.What can i do about this now.I am happy with the amount the court says i need to pay(same as i am paying to Payplan). Incasso seem to have just tottally ignored all my communications. Thanks

  10. Just another update. I was sent blue court forms from northampton court, regarding a tesco loan.I informed Payplan about this.They asked me to send the original courts forms for them to deal with. They did this and I would have thought admitted the debt.In the meantime I sent a CPR request to Incasso(tesco solicitors).I sent it recorded delivery they signed for it.That was a month ago and they havent replied with it. Also Tesco have never defaulted me. I now have recieved a reply from the court sayinf i must pay each month what Payplan suggested. Has anybody got any advice regarding this.Incasso dont seem to have done this propperly Thankyou
  11. Thanks Ida, The second scan did have information on it,but I blanked it out.But the info was only personnel details, address etc.Nothing at all about apr's.payments etc.There was no finnancial information at all. Thnaks for the reply.

  13. Hello.I have started a new thread.i am getting mixed advice about the attached CCA from Amex. The latest advice is that it is enforceable due to amendedments to the sct,and the fact that it is an online application.The advice also stated that as it is all online that is proof enough of the debt. Could anybody clear up what happens with online applications ETC.

  15. Hello, on another forum.I have been told that as it was an online application they dont need an agreement.Something to do with the act changing.They said the fact that its all online is proof enough of the debt.More confuded than ever.Has anybody got any advice on the ammended act .Thanks

Hello all could you help me please,so stessed its nor real.basically I dont understand the CCA's process.Could somebody explain to me please. 1.is 12+2 ( is this 14 working days.not counting weekends) so counting weekends its 18 days 2.What does a credit card company need to provide if I applied online.( a couple of them say they dont need to send anything,something about electronic act). Any advice would be appreciated, i am paying my debts I just want some breathing spaces from the bullies. Hello I request a CCA from american express cards.They wrote back saying "the consumer credit act 1974 ( electronic communications) order 2004 resulted in there no longer deing a requirement for regulated consumer contracts to be signed by hand.Instead the order allows consumer credit documentation to be signed and sent electronically. All they sent me was about 10 pages of terms etc, nothing with signatures on,APR's.Basically no financial information at all. Could anybody helpThanks
