  2. Very sad to hear about your brother in law indi, my condolences. This is the last thing I am sure that would be on your mind. Does anyone think that maybe indi should be allowed more time with this case as she has had a close bereavement in the family? Very very sad for you indi
  3. I agree 100% andrew, and no that some people or some companies would rather cut off their nose to spite their face. About time the shoe was on the other foot............these companies have been driven by greed and words will never be able to describe the suffering that so many have gone through and still are. Trying to get any sense, truth, honesty information and even what your rights are from these companies is like trying to raise the dead..... You are correct that truth and justice always catch up in the end as we reap what we sow as Swift and many other creditors/lenders are facing today with so many being issued with fines from the FSA & OFT. Wishing you, sparkie and all those who have/are suffered by this company the very best of luck and hope that soon this will all be over and everyone can concentrate on trying to re-build their lives to some kind of normality that once was enjoyed. I am more than certain that there is much more to come from all of this, and things will not be as cut and dried no matter how swift try and make out.   5. When you receive a claim from the court I thought you were suppose to send the AOS first then fill out your intentions on how you want to proceed? When did you receive the claim form, sorry have not read it please remind me
  6. Hi honey, not too sure but is there not a counterclaim form that came with the N1 from the court? I think this one http://www.hmcourts-service.gov.uk/news/forms/docs/n9b_0406.pdf There is a section in there to what you admit you believe you owe and what part you don't..........hope that makes sense and is of some help honey.

Wonder which big lender will be next on the list to get a wolloping because if it is my one well that I did not take as a compliment when I requested some info from them to which they replied "WE OPERATE SIMILAR TO SWIFT" and after seeing all that info about swift above I should be panicking even more than I am, which trust me don't take me long LOL.   13. I wonder if the Claimants superiors are aware of this court action issued by the Claimant? may not be of any relevance but just a thought that if they did not then maybe indi could write and tell them what one of their people are doing.

  16. Well DG have advised me to agree to pay all of the debt, plus costs and interests and after I have they STILL will proceed to get a judgment against me. If I do not consent to their terms they will apply for summary judgment, maybe some one wrote this letter from their rear too?

  19. Hi honey yes it is true that DG can apply to lift the stay anytime but they cannot issue a CCJ against you without you knowing. There is a procedure which they have to follow and you must be informed of this before they do this. To get a CCJ against they could try to apply for a summary judgment........ they have to comply with their duties under the Civil Procedure Rules in order to ensure the overriding objectives thereof are being met by both parties in these proceedings in respect of their intentions to make an application to the court to lift the stay, If an application is made for summary judgment then the applicant [HSBC] must serve a copy of their Application Notice-N244 upon the Respondent [You] along with a copy of their Witness Statement and copies of any documents files in support of their said Application. If you wish to oppose any Summary Judgment, then you must file a copy of your defence to the said app (the defence is to be in the form of YOUR Witness Statement which should contain your legal or valid reasons why the claimant's app for SJ should not be permitted to succeed, you must also file copies of any documents/exhibits that you intend to rely upon in your opposition to the SJ. You must file your Witness Statement and exhibits to court at least 7 working days before any Hearing date and also serve copies of the same upon the claimant's Solicitors, again at least 7 working days before the hearing date. The claimant can respond to your Witness Statement within 3 days of the Hearing date. Service of documents - Monday to Friday only (these are working/business days), you cannot serve any documents upon the claimant (or his Solicitors) via email, UNLESS you have his or their consent to service by this method, Facsimile service is accepted as long as there is a fax number stated/quoted on any correspondence from the Solicitors. I was given this great advice from a great cagger, and hope it is some help and re-assurance to you. So don't worry too much.
