  2. Hi, I have now been sent a copy of the defence together with a "Directions questionnaire (Small Claims Track) with instructions to return by the 20th June and serve a copy on all other parties. I have completed the DQ obviously agreeing to mediation do I need to send these by recorded delivery or am I safe with proof of posting? I will post up the defence over the weekend, it utterly fails to address the particulars of claim and I think may even be an abuse of process. Thanks

Thanks Baza, so what is the next deadline I should be looking for, also at what point might I expect to see this “defence” it’s just that I claimed for 3 passengers on the flight, they paid for one but not the other two:???: so I can’t wait to see what tack they are going to try.
  4. Hi, Latest update, today (just prior to the deadline) AA have submitted a defence, MCOL shows the following. American Airlines filed a defence on 03/06/2016 A bar was put in place for American Airlines on 03/06/2016 DQ sent to American Airlines on 03/06/2016 Please could someone enlighten me in particular with regards to “the bar” Many thanks
  5. Hi All, Just to update since my last post have received a payment from AA, hopefully my e-mail reply makes clear what has transpired. Dear ************* Thank you for the payment of £221.21 received into my account on the 16th May 2016. I must, however, remind you that this claim involved two flights, therefore the total due was £446.42, this was clear in the original claim and was also reiterated in my e-mail accepting your offer 1st April 2016. As you are aware this claim and claim number ********** are now the subject of a county court claim and whilst I will accept the payment of £221.31 as partial settlement legal action for the balance of £508.42 will be continuing. Hi Andy, POC as suggested, I am claiming compensation on behalf of my wife and two daughters under article 7 of EC261/2004, pursuant to the Sturgeon judgment in the ECJ (Case C-402/07of 19 November 2009) which provides for €300 per passenger to be paid in the following circumstances. These were that American Airlines delayed their flight from Manchester to New York JFK on the ???? ???????????? by 3 hours and 38 minutes. This matter has previously been raised with American Airlines under references ???????????? and ???????????? and despite having acknowledged liability and offering compensation in the amount of €300/£223.21 per passenger American Airlines have failed to make payment. A final notice before action sent by recorded delivery to American Airlines on the ?????????????? has not received the courtesy of a response. Thanks Nosnibor

Hi BF, Yeah happy to provided details, A few years ago got into financial difficulties (loss of job) I saw it coming and knowing there would be insufficient funds in my Lloyds TSB current account to cover my direct debits I resolved to cancel them all so as not compound a bad situation. I was able to do this via on line banking with the exception of the direct debit for my Lloyds TSB bank loan their system would not allow cancellation of this DDM. I therefore wrote to Lloyds TSB by recorded delivery requesting cancelation of this DDM this was done well before the due date and they had more than sufficient time to action the request. They failed to action my request and debited my already overdrawn account with the monthly payment sending me further into overdraft. I then wrote to Lloyds TSB again requesting cancelation of the direct debit again by recorded delivery and again the request was ignored the monthly payment was debited and the current account went further into overdraft. I wrote a letter of complaint to Lloyds TSB and in there reply they fully admit to having failed to action two written requests to cancel the DDM and as a result refunded the resulting charges. It has since suggested to me that in addition to the refund of charges I should have been refunded the actual loan payments under the direct debit guarantee. This was the subject of my letter of complaint.
  11. Hi All, Well I’m back again despite their promise, 21 working days have now come and gone without any payment from American Airlines. I’ve now had enough and am ready to issue an LBA, however, would appreciate some guidance on the following. (I will recap to save people having to read through the whole thread) My wife and two daughters had a 3 hrs. 40 mins. delay on an American Airlines flight from Manchester to New York (JFK) We have two compensation claims with American Airlines one for my wife and younger daughter and one for my elder daughter. In both cases American Airlines have admitted liability and offered compensation but despite acceptance of the offers and promise of payment no monies have been forthcoming. My question is can I issue a single LBA and if necessary a single MCOL claim for both? Obviously this would be less hassle, less cost and would put the claim value above the level at which I could involve HCEO’s if it gets really silly. Many thanks
  12. Wrote a letter of complaint to Lloyds Bank on the 4th February 2016, letter was headed “Formal Complaint” and was sent to Gresham Street. I did not send by recorded delivery but did obtain proof of posting, I have had no response whatever. What should be my next step. Many thanks

  14. Hi folks Don’t seem to be getting anywhere with this, so could use some further advice. Timeline as follows 4th December 2015 Following Andy’s advice I issued to separate claims to AA one for my wife and younger daughter and one for my elder daughter. 7th December 2015 AA acknowledge claims and advise they will respond in due course. 25th December 2015 AA respond offering £300€ per flight compensation, I know this is the standard amount and was perfectly acceptable. They enclosed some forms which they required completed and signed. 4th January 2016 The forms requested by AA completed and returned by e-mail. 15th January 2016 I receive an automated e-mail acknowledging my communication. 1st February 2016 Having heard nothing from AA I send a further copy of the forms together with a polite e-mail asking them to address the matter and avoid the need for me to escalate. 2nd. February I receive an automated e-mail acknowledging my communication. Since 2nd February I have heard nothing from AA so it’s beginning to look like I will have to escalate this, but hopping for some advice how best to proceed. Many thanks
  15. Hi Andy.. Sorry if I was not clear earlier in the thread, when I refer to “a claim” this was a claim I made direct to American Airlines rather than a claim via the court system. Would this alter your opinion regarding time scale? Nosnibor

  17. Hi… A quick update and a request for a little further advice. Sent off 2 separate claims as advised by AndyT, American Airlines responded with the offer of 300€ / £223.21 per passenger. I understand this is the standard amount and is perfectly acceptable to us. American Airlines requested some forms completed giving bank details and releasing them from any further liability, these were returned by e-mail on the 4th January, American Airlines acknowledged receipt on the 14th January. Since then we have heard nothing further, any advice on how long it would be reasonable to wait for payment? Many thanks Nosnibor
  18. Hi Folks… Some advice please, in October wife and two daughters flew from Manchester to New York JFK, flight was with American Airlines booked with British airways. Outward bound flight delayed for 3 hours and 40 minutes, I understand we may be entitled to compensation and so I submitted a claim to American Airlines. After a month they have replied saying that I must send a power of attorney in order that they can deal with me. I fully expect that American Airlines will try their best to avoid paying any compensation and my concern is as they have provided no pro forma for the power of attorney will they simply sit on this for a few more weeks and then say it is not in the correct format or something similar. Would I simply be better to submit new claims from my wife and elder daughter and if so what should I do regarding my younger daughter who is a minor? Thanks in advance Nosnibor
  19. Hi… Lloyds overdraft, Lloyds still own the debt, Moorcroft collecting. Balance outstanding £450. Currently paying £1 pm. Have already had all charges and interest refunded. Shows on credit file defaulted October 2010. I know you guys are only trying to save me from been had over and it’s much appreciated, but if I can’t see a way out of this one and if I can be rid of this for say 35% I would rather draw a line under it.   23. I normally lurk around the debt forums and so not sure if this is to place to post, if not my apologies and perhaps a mod could move. Would like some advice about my rights in connection with a fault with an Audi A6 2006 I have recently purchased from Quicks (now Evans Halshaw) When I test drove the vehicle I noticed the radio would not switch off or mute and had to be silenced using the rotary volume control, however, given the dash of the car is like an aeroplane cockpit I assumed I was doing something wrong and been otherwise happy with the vehicle I purchased it for cash price near enough £7,000. Having used the car for 3 or 4 days and reading the handbook it became obvious that the on/off/mute button for the radio was in fact not working, I telephoned the dealer and made arrangements to return the vehicle for them to look at. Having checked the vehicle over I was informed that a) the radio fitted to the car does not turn off and the fact that the mute function does not work is irrelevant as the sound can be turned down using the rotary control! Now I have a problem with this on 2 counts firstly having taken the vehicle to an Audi main dealer the claim that the radio does not switch off is a lie and secondly having just handed over 7 grand of my hard earned for a car if it is fitted with a mute switch I expect it to work. Additionally I am annoyed by the attitude of the dealer which has changed from this vehicle is an outstanding example hence the top end asking price to more or less what do you expect from a 2006 car. I would be grateful for any advice for instance if I pursue this further is it possible that a court would consider the dealers claim correct i.e. it is a relatively minor fault which I should expect on a car of that age?
