  1. Gatecrasher, My first initial letter was via email - and the response I got back is a standard reponse - that many other here have received. Actually all responses I have received are standard! Anyway, my letters following, were paper simply because I trust hardcopys more than virtual ones. From reading here though - it doesn't really matter its just banks tend to respond via post.   2. Yesterday Virgin Credit Card tried to charge me £25 late fee for my “minimum payment” direct debit not being set up in time with them. I rang them yesterday evening and simpy TOLD them to remove it. I didn’t even need to quote anything / kick up a fuss. They refunded it - no questions asked. Ha! 8)

That makes it a lot clearer on both the claim issue and the fact I'm a girl with a lack of spatial ability and logical thinking, etc. I agree we do support our men very well indeed. lol I will try for the default judgement and if it won't let me will wait for the 14 days they say Lloyds have.   4. Hi All, I am a little bit stuck! My claim has been accepted by the court via moneyclaim. However it now has a section showing the following; Do you wish to enter Judgment by Default or by Admission? Please select one of the options below: The defendant has not filed an admission or defence to my claim (Judgment by Default) You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment. The defendant admits that all the money is owed (Judgment by Admission) If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request. Lloyds have not acknowleged my claim yet. I don’t understand if I should chose one of the options (as above). Can anyone advise what this means? Perhaps some of you have done this already? Thanks in advance! And sorry for being a girl! Just can't get my head around this part!

  7. Intersimi, Ok, the last 2 letters that I sent were the same one. The first gave 14 days notice before action. I then went away on holiday and as I had heard nothing from the bank before I went I then sent the same letter again giving a further 7 days (FINAL chance for them) and the date then coincided with my return from my holiday. I returned to find NOTHING from the bank. Hence 2-3 days following my return I have filed my claim. I hope this explains everything, anything else just ask.
  8. Claim filed this morning after working on it half the night! Darn that tiny "Claim Particulars" box! For those wanting to see the progress I will be asking to have the Case put in the Litigation in Progress section. Wish me luck!

  10. Morning! Me and Mrplan74 have just returned from holiday! Anyway, have received no reply from Lloyds following my 7 day letter before action so am reading up on the Moneyclaim site today and will be filing a claim by the end of the day today. Will keep you posted!
  11. This is my final request to Lloyds today and they have until Friday 10th before I take it to court.
  12. This charge does not fall into the category of punitive / penalty charge. The £10 per month charge for the account is for a 'service' and therefore you can't claim it back. I have a 'Select' account which gives me various 'perks' I don't want lol AA, insurance, etc. etc. and they charge me £7 per month for this. What you can claim for is charges for going over overdrafts, credit limits, being sent a letter, etc. etc. Read the FAQ and its explains it all there. Also you should not pay more than £10 for 6 years worth of statements - again read the FAQ. The template letter for requesting the statements under the DPA can be found in the Library.
  13. Providing you don't go silly with the amount of credit cards you have - there is absolutely nothing wrong in swapping your cards every 9 or so months to get a better deal. You must make sure though that you are not late with payments or THAT will go on your credit file. I have looked into this a lot (credit ratings, etc) during the past year.   14. I'm not doubting myself and I will be prepared to go to court - but it is in no doubt somewhat daunting and a little bit scary which I am sure that many others here will agree with. I certainly won't be backing down though. I plan to send the "letter before action" and give them 7 days before proceeding with filing a claim to get my money back.
