  1. Do you receive a default notice from the OC and the DCA? The reason I ask is my default notice is dated November yet my Experian credit file shows I defaulted in October? Any advice?
  2. How can a court justify making a full payment forthwith when they know you can't afford to pay?? What does it gain?

  7. Does it have the creditors signature on it? Is your signature on the terms and conditions page incorporating the prescribed terms?
  8. Best bet is to set up an account with photobucket. Google photobucket and then set yourself up, any probs come back here to get further advice about setting up a link on your thread to the document(s).
  9. Probably most people are in the same boat as me on here and their credit profile is shot. What I would like to know is when an account is in dispute has anyone put a notice of correction on their credit files advising that this is the case and most of all is it worth doing???

  11. Apologies to Lunar Jim again for invading his thread- But Pinky, I am not questioning you, but how does The Law of Property Act 1925 S136 state an NOA needs to be sent by recorded delivery?
  12. Halifax did me with their charges so I just went to a different bank and I owed them £1,000 when they withdrew my overdraft. Now I've seen this site I'm going to see about claimimg back my charges.
  13. Thx, but do they need to have sent me a NOA? I have had a lot of paperwork from RW and they have advised that HBOS will send statements etc. over too
  14. I sent a SAR request to Robinson Way re. an overdraft I had with Halifax. Admittedly I probably should have sent it to Halifax. Anyway all the letters Robinson Way sent were all dated the same date!!! Surely this is not right? Do they also need to have sent me a NOA and DN for an overdraft debt?

  16. I was advised by Eversheds, acting on behalf of a creditor, that it was acceptable to just send it by post. "Both of the letters attached to my previous email would have been sent by 1st class post, which is an acceptable method of service. There will, therefore, be no proof of postage. The notice of assignment was included within the attachments and is the standard format used by our Client." Be interested to know if this is incorrect!!
  17. Does a NOA have to be posted recorded or special delivery?
  18. Does the creditor have to provide an annual statement to show payments made and the current balance? Also could someone look at my previous post and offer some feedback. Thx
  19. Also received a Termination notice which was dated the 1st of December, from the solicitors, this is only 16 days after the date of the NOA & DN!! The solicitors sent the letter to me as a word document which IMO was strange, it did have the Arrow logo on it though. But have they sent it out too soon after the DN?
