  1. Cheers guys. It was through Northampton Bulk centre and I replied requesting accounts and a signed CCA. I will post up the CCA. Fairfax are acting on behalf of Santander and have not been assigned the debt.
  2. Fairfax Solicitors issued a claim via Northampton CC for a debt to Santander Card. I requested statements of account and the original signed agreement. I have received the signed agreement from 2003 which is signed by myself and the company which was then GE Money there is no terms and conditions and in particular no mention of fees for late/missed payments etc. Also the statement of accounts I have been sent are from 2005, 2 years after I opened the account therefore showing no opening balance. The statements from 2005 show a different credit limit to the application and also showing charges for account cover which I did not sign up for in the original application. Do Fairfax/Santander need to send me the statement of accounts from Day 1? Also how do I request these and the initial terms of conditions as if they prove the CCA is legit I want to claim for the fees I have been charged. Thanks in advance for any help.

  4. Thanks for the previous posts. Had a letter from the court today advising the case has been struck out, does that mean I have won, apologies for being dull!!!
  5. Bryan Carter have now issued a court claim I filed a defence but need an expert on here to offer advice on what is wrong with the CCA aatched, please!
  6. So does that mean I do not have to make a payment to the other side until my appeal is heard?
  7. URGENT- When filling in the N161 form am I asking for a stay of execution of judgment against me?
  8. How come the DJ in my case say then that he couldn't side with me as another DN would just be issued and it would incur more costs for me?
  9. Okay before I put this totally to bed, I need the following questions answered. Is an invalid default notice a valid reason for an appeal? Can another default notice be issued? I have been advised by a solicitor who specialises in CCA's that my CCA is not invalid and can be enforced in a court, therefore does that mean that my appeal will be declined and is therefore a waste of time?
  10. Got legal cover with More Than and they were my first port of call but they were useless and totally unhelpful!
  11. I've hit a brick wall, I don't have the funds to make an appeal and can't get a solicitor etc. to help. Looks like I'm going to have to throw the towel in on this one.

  13. Spoke to two solicitors now this week and they have advised me not to appeal as my chances of winning are slim!
  14. I'm determined to appeal just need to find the cheapest way of doing it!
  15. So do I not have to pay anything towards the debt to the other side whilst I submit my appeal?
  16. Thanks for the feedback from all of you. Corn, I can't afford £2k for a barrister but appreciate the help. My main concern with all this is the fact that I admitted the debt but on the other flip of the coin if the DN was invalid then they had no right to enforce legal action!!

  18. Although haven't had much free time I have attempted to move forward with my appeal since my hearing on Wednesday. I called the court who told me I couldn't appeal as the DJ didn't grant permission! I advised that I could raise an appeal with the CJ but basically I seemed to know more than them and that's not much!! Trying to see or speak to a solicitor who is able to help me is a nightmare and I don't have any spare cash to use or especially waste. I really want to appeal but feeling a little frustrated as need specialist help and don't know where to turn. As previously mentioned I don't have much free time as working so hard, aarrrggghhhh I don't know what to do next!!!
  19. If anyone is able to recommend a good (cheap) solicitor/barrister it would be appreciated. I'm not sure how much its going to cost me but I have to appeal.
  20. Don't give up, these people should be doing their job properly and are/have not. They cannot be allowed to get away with it!!!
