  1. I would suggest PAYG phones are subsidised by higher call charges. But, how can you advertise something at £60.00 but you have to pay £70. The telecom companies are taking up so much of my time I don't have any friends anymore, so giving the SIM away isn't an option
  2. :) Blood pressure dropping slightly . BUT............ Went to buy a new phone, seemed the easiest option!! Didn't want anything fancy so found a half decent one for £60.00. Silly me thought that was what you paid, leave the shop, put your old SIM in and off you go!!!! Nope, you HAVE to buy £10 top up as well, and in my case on a card I'm never going to use as I have a contract. So that sixty quid phone is actually SEVENTY. :-x Blood pressure back up
  3. What is it with telecom companies? Just spent 6 months in dispute with BT over a feature line contract that clearly states it is for 12 months, they insist it is 24 minimum. Ive even sent them the contract twice which they say they haven't received. Finally got the feature line taken off only to find the same day they started a new 12 month contract. If I don't pay they will cut me off and as it's a business line that is a bit more than inconvenient . Then this morning my girlfriend damaged her mobile, so phoned the insurance company ( she took it out when she got the phone ), it has £50 excess AND she pays ten quid a month, they can repair it in 7 to 14 days. That is just rubbish service. Phoned Phones4U to enquire about the fastest way to get the phone back working ( again used for business) and he said don't bother with the insurance, come in and sign up for a new 18 month contract and we can sort it out this afternoon. Back in the 'olden days' when your mobile broke they sent out a new one AND a parcel to send your old one back, they did that on a next day basis. Only went back to BT because of the dreadful hassle from NTL, changed to Vodaphone at phones4you because of the hassle with o2. Just have to face it. They're ALL rubbish. There would be a hell of a market if just one mobile or fixed line telecom company kept things simple, provided a good service and actually cared about the customers they already have instead of trying to get the ones they haven't. Rant over, but don't feel any better

    Lloyds tsb

    I checked my balance once before going to London to meet a customer, all was fine. Filled my car up at Fleet Services on the M3 and had my card declined, this was about half an hour after checking my balance so phoned Lloyds who told me they had taken money from the business account to pay off what was owed on the personal account. AND charged me £120.00 for the privilege. Not the first time I've heard this, one story even said lloyds took money from there childs account to pay off the overdraft on the parents. Looks like they can do this and even charge you a fortune for the privilege. Hope you are in the process of going through your statements and reclaiming every penny from this despicable organisation.
  5. GRRRRRRR:mad: Should be happy!!!! Had 2 phone calls from [problem] today, one to say they are dealing with my case this afternoon and a cheque will be sent out tomorrow and another to sk if I wanted it paid straight into my account now. I took the 'now' option and trotted off to my nearest Lloyds to withdraw the money after hearing on here that it is possible the ******** sometimes take it back. At my nearest Lloyds they told me they could not release the money and I had to go to my main branch and see the manager, oh, and take along your partner as its a joint account, oh and be there by 5, which gave me half an hour to pick up girlfriend and drive 15 miles in rush hour traffic. Well, we made it with 2 mins to spare and the manager was in a meeting and still they refused to allow a withdrawal on the account as the manager wasn't available, the message he sent through was we were not expected until tomorrow morning!! What time tomorrow morning is he expecting us I asked, he can see you at 2 o'clock tomorrow afternoon came the reply:rolleyes: . Ever had the feeling someone is taking the pee?? So came away with no money, even though the account is very much in the black and have to go back tomorrow ( another 30 mile round trip ) because some idiot at Lloyds wants to see us before we are allowed to withdraw OUR money. Just glad we have opened other accounts because can't wait to see this asshole tomorrow. So good news they paid, bad news can't get hold of the money. I really hate this bank.
  6. Wow, thank you for such a comprehensive reply. Yes the bailiffs who are dealing with this are indeed from the county court. Looks like it might take a little while longer then.
  7. Any ideas anyone??? The Judgement does say that goods may be removed and further costs may also apply. Has anyone else got this far and not received their money? I think I read somewhere that the bailiffs once turned up at a main branch and got the cash, but it seems this warrant only applies to Gresham St.
  8. The Bailiff who has been instructed by the court, I think it is City of London.
  9. So far won 2 claims, both at the court stage. My third claim has left me a bit lost!!!! Filed my claim with the court and got to the AQ stage and was just waiting for Lloyds to file their AQ but the deadline came and went, the court gave them another 2 weeks to comply and STILL there was nothing. I then asked for judgement which was granted and phoned [problem] to tell them I had judgement, but they really didn't care. So I applied for the bailiffs to go and collect and told [problem] the bailiffs were coming, [problem] STILL didn't care. I've spoken with the Bailiffs and it seems to be these warrants aren't worth anything. The bailiffs are only allowed into the foyer of Gresham St, from there they can do nothing. So even with a judgement AND a Bailiffs warrant I still have not received any of the owed money. Any suggestions as to what I can do next please??
  10. 24th Feb 07 Request for refund sent for miss sold PPI taken out in June 2001. Amount requested £1,100 + 8% = £1473.20 ( don't know how I got that figure!!!! 12th March Letter before action 2nd April Issued Claim Form to local court for £3090 :o . This figure was gained using the spreadsheets on here and after a couple of messages and advice from Hellhasnofury realising I could also claim the interest paid on the PPI (12.9%= £849.92) AND then add 8%= £942.65. Thanks Hell, owe you a beer:-D Then heard nothing until a phonecall on 20th June to which I replied :- Dear , Further to our telephone conversation this morning ( 20/06/07 ) regarding our claim for miss-sold PPI we write to clarify the following points. As you are now aware we filled this claim on 24th February 2007 and wrote in the first instance to the Complaints Department in Andover, a copy of which is attached. All subsequent correspondence has been filed through Tredegar Park, a copy of this is also attached for your perusal. As we only received the standard letters asking for more time to look into this claim we carried on with the claim according to the deadlines set out in our letters. We are not surprised that over 4 months later we have now received a telephone call from you stating you know nothing of this claim, despite a claim form being lodged at ******* County Court on 2nd April 2007, this claim is deemed to have been served 6th April 2007. As I explained to you on the phone I had 3 other claims running against Lloyds at this time ( one has now been settled in full ) and it is not unusual to receive nothing or hear anything from your company until literally days before these cases are due in court, this pattern is also true for hundreds of other cases that are known to me. As this claim has now been running for over 4 months and judgement has been passed in my favour we respectfully ask for the amount to be paid within 7 days. After talking with ****** at ******* County Court today I am now well within my rights to issue a warrant of execution to recover the money due to us, this course of action will of course incur further costs to yourselves and we feel we have no other option except to follow this route if this money is not received within the stated 7 days. The money now due to us stands at £3090.90 plus interest at 0.65p per day from date of issue, this date as set down by the court was 6th April 2007. We calculate at today’s date this was 76 days ago and therefore request an additional £49.40. I am writing to ask that you pay the amount of £3140.30 as ordered in the judgement within the next 7 days. I expect payment by cheque made payable to ********. If you fail to do this I will have no alternative but to apply for a warrant of execution to reclaim my money. I would like to take this opportunity to say how disappointed I am that you have failed to make any effort to resolve this matter effectively. All communication from you has been limited to template letters that seem to be aimed at delaying the process rather than resolving the issues. I further believe your lack of response to my claim shares this negative aim. It seems to me that the way in which Lloyds TSB are using the public court system to delay and discourage customers from reclaiming unlawful bank charges and miss sold PPI claims is immoral, and a complete waste of taxpayers’ money. Furthermore, I believe it to be a completely unnecessary abuse of an overstretched public resource. I expect your response before 27th June 2007. Yours Sincerely, 28th June SETTLED IN FULL :-D ( Has anyone noticed I forgot to add in the court costs, oh well, they paid amount of the Judgement, a loss to me of about £50) One thing I must say though, the girl I spoke to at Lloyds was very good and even phoned today to see if the cheque had arrived, so full credit to her. I hope one day soon that she finds employment in a decent company that deserves to have her. So once again, thank you Hellhasnofury and everyone on this site. Thats 5 claims settled in full, I love this site :-D . And of course a donation is on its way once the cheque clears.

  12. Hi Peter, I'm claiming on a business as well at the moment ( partnership ) and used the business template. The contractual interest debate will continue I suppose, maybe there will be a time in the near future when I wished I'd have gone for it, but for now the tried and tested route seems the favorite. I bet the spreadsheet is right!! Great isn't it, it's added a couple of thousand to my claims as well . I bet you've been in the same situation as me, loads of money due in from customers and in the meantime Lloyds taking every last penny they can!!
  13. It's one claim, so don't split it. I would go for the 8% interest rather than contractual, some will disagree, but to me it will be easier and safer. On business accounts we are told that a charge is going to be made and then it comes out on that date as charge advised. don't forget to change the wording on your letters to the business template as it is controlled by different regulations.   15. Acknowledgement of Service received today from Foot Anstey Solicitors regarding the business account. They've acknowledged 10 days early . No news yet on the PPI claim, was expecting to hear about that one today, probably coming from [problem] then:rolleyes:

  18. Lloyds filed Acknowledgement of Service 17th April indicating they intend to defend the whole claim, thus giving them another 28 days to file a defence. AND in the same post a letter from Andover updating me on my complaint, this is the standard 'we told you four weeks ago we would look into your complaint and get back to you in the next four weeks, this letter is to tell you we are no further forward and we'll get back to you in the next four weeks' it then thanks me for my continuing patience. I'll await my next two Acknowledgement of Service's in the next few days then and continue waiting patiently .
  19. My claim hasn't been acknowledged either, they had until yesterday. Perhaps the papers should read 'the defendant has 14 days to respond (unless they are really busy)'. I don't buy the 'busy' line either, its a delaying tactic. The thing that really infuriates me is they are abusing the court system to delay the proceedings and the ( usually ) inevitable outcome. By now we all know the banks have been in the wrong for many many years, so why are we still in a position where we still have to take them to court to get the money back, especially when they lodge a defence (at the twelve hour) and refuse to back it up. Has anyone tried to get judgement on this 14 day rule yet?
  20. But they never get to court, if the banks paid up straight away they would save court costs & interest, and themselves a fortune into the bargain. The point to this thread was to clarify what is written in the SAR, and I can see both sides, one, we only want our money back and two, we don't want to be seen to be a tight greedy bunch. BUT, do the banks care about us when bouncing a £10 cheque and charging £35 for doing so?? It is a tough one that is probably split 50/50 as to whether it should be reclaimed or not.
  21. Oddly enough I do agree, I just noticed that part of the SAR letter states that the £10 charge will be claimed back. Perhaps it should be removed from the template letters if it serves no purpose. ( PPMAN159We will agree to disagree. :o reminds me of my ex wife, I once replied "no, because I'm right" and NEVER lived it down, I think it was about this time we realised we couldn't even agree to disagree and split up;) "
