  1. Thanks, sending today.
  2. Well i have today received a letter from Beneficial Finance. It says that i have been unable to contact them regarding my account:confused: It then goes on to say they have experience dealing with people in financial difficulties and they intend to come and visit my address in the next 14 days unless i ring them. I have still not received a signed CCA.
  3. We have been getting hassled every day by Blair Oliver & Scott now. Despite sending the Account in Dispute letter to them and telling them all they have is an application form. Today we have received a Notice of Intended Court Action. It says they need payment by tomorrow and says it was posted on the 06/05/09 but we only received it today 12/05/09. Should we be worried or is this just a standard threatogram?
  4. Well today they have sent we a Default Notice. I have still not received my info i requested.
  5. But ive been told i cannot put the account in dispute if they fail to comply with an SAR, i can only do it after non compliance with a CCA request? If my SAR has the wording above then after 40 days can i put my account in dispute?
  6. I have posted this before but cannot get a definitive answer? The SAR template from this site states: This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. The CCA template asks for: A True copy of the consumer credit agreement section 77-79 of the Consumer Credit Act of 1974. Isnt this the same? Isnt an SAR that contains the above also a CCA request? If so should i send £11 rather than £10 or will the £10 cover it? Should i rerceive the CCA within 12+2 days or 40 and can i put the account in dispute if i dont? Regards Felix
  7. 'i bank with halifax are they same has rbs' No, Halifax are Bank of Scotland, RBS is Royal Bank of Scotland.
  8. According to todays Observer the banks are going to roll over the debt owed by welcome, they say to expect an announcement after the bank holiday. Also the banks will swap some of the debt for a stake in Cattles.
  9. In November, finally got my info in Feb and the defaulted me at the end of Feb.
  10. Well i sent an SAR already but the default went on just after, i take it i need to send another?
  11. Keep it! If Welcome ask just say that seeing as they owe RBS 500 million and RBS is owned by the taxpayer you decided it would just be easier to keep it.
  12. If they were going to close Welcome i'd expect them to do it whilst the shares are suspended along with any other bad news. I reckon we will be seeing it all come out soon.
  13. Thanks, ill send that off tomorrow.
  14. Thanks for the reply. I stopped paying as they didnt comply withing the time limit for the CCA request. Should i now start paying again whilst i wait to see if they comply with my SAR?
  15. Well they fianally sent me my CCA. I take it the fact it isnt a signed copy makes it worthless and the account is still in dispute? Apart from it not being signed would this be enforceable?
  16. FSA monitors Cattles after discovery of £700m black hole | Business | guardian.co.uk
  17. Any other opinions on whether this is enforceable?
  18. OK, thanks for the responses. Ill send out a F&F offer and see what they say. Felix
  19. Hi This is the response to a CCA request for my wifes old TSB credit cards? The T&C's were not very clear and also the page numbering doesnt seem to make sense. Any other thoughts on these? Are they enforceable? Card 01 The second card is slightly more recent and judging by the tear in the top of the page im sure this is both sides of the same page. However is it enforceable?
  20. So what everyones opinion on Cattles now? Do you think they will survive? Do you think there is more bad news to come? Whats happening with the newspaper/fraud stuff that was going on behind the scenes on here? Is it still looking bad for them? Could they be waiting for the G20 sumit to start so they can bury the bad news in the media?
  21. Hi I have a secured loan with Welcome Finance. When the loan was taken out i was given a 7 day cooling off period. The CCA states that i need to be given at least 7 days or it is unenforceable. I have been told that the actual rule is 14 days and my agreement is not enforceable as a result. Could anyone either confirm or correct this. Regards Felix
  22. Hi Were they given a cooling off period when they applied for this loan? If so how long? How did they apply, was it initially over the phone?
  23. So do they have to make an announcement with regards to their revised figures today or are they waiting for the auditors to finish?
  24. Hi alec, Its probably best to start your own thread as it will get lost in this one. It moves on very quickly.
  25. I think the fact that the share price has gone up after this news is just a sign of how little confidence the market really had in Cattles.
