  1. The information may have been put on originally by GE but is now being updated by CL Finance. Im trying to stop the account showing 6666's as my last 12 months history for the next 6 years after my last payment which is what CL have said will happen.
  2. Looking at my default notice I posted earlier. The gave me 14 days from the date the letter was sent out. It has been a while since I went through all this but shouldn't they have taken postage into account? Does this mean the DN was invalid and I should only have paid the arrears in the DN and not the full amount? I know I am clutching at straws but all I am trying to do is get them to record my actual payments I have been making on time every month for years.

I tried to argue this and they just said that this is their way of showing that I didnt pay the contractural amount and that once it went to them it would always show as 6666 no matter what I pay. I have the balance remaining and they have told me that even if I pay the balance in full it will still show the 6's and the last 12 months payment history of the account will stay for 6 years after the settlement date. All my others went to default and just show the default and say settled on them. Its so annoying that I have paid this off and I am worse off than I would be had I defaulted.
  4. I CCA'd them about 3 years ago and they sent me the agreement that I have posted up earlier. I dont mind paying them as they is hardly anything left on it. I just want to try and make my credit file look as good as possible after it is paid off. Am I able to argue that I should have been defaulted in 2007 when they sent the default notice, or is there a risk they can put a default on now with todays date which would look even worse?
  5. Im not sure, how would I find this out? You say they have already defaulted me. Shouldnt this then show as a default rather than payment history? All the other creditors put a default on my file and then I just pay a DCA every month but there is no payment history shown on my credit file. If they sent that default notice shouldnt they have done the same?
  6. Im worried they might default me if I stop oaying though, I dont know how bad the 66666 history is but a default would be worse id imagine.
  7. I will check my statements when I get home. I managed to get through to somebody that said they were a supervisor. She told me that because I wasnt paying the contractural amount it would always show like that. I offered to go back to paying the contractural amount and they told me its too late as its been passed to them. Surely until they default its is still under the original contract?
  8. This is why I rang them, however they said that reporting it as 6 months late every month was their way of showing that I was paying an arranged plan. They also said that paying the original monthly sum or paying off in full would still not bring it up to date. It will basically stay as 6666666 until 6 years after the last payment. I tried arguing with them but they just kept repeating that they are unable to change the way they report to the CRA.
  9. It was a store card so the original payments would have been a monthly minimum payment based on the balance. We have been paying them £10 a month (Pay around £350 a month to various DCA's).
  10. Hi The original crditor was GE Capital. I will check to see whether I have been getting anual statements but I do get a letter each month with the amount paid/owed etc. The agreement and NOD is below.
  11. I have just looked through my file and seen a default notice from them in May 2007. I can work out whether it is a threat or an actual default. Would this make any difference?
  12. Thanks for looking into this. I was told they would remove it once settled, two years ago. Unfortunately it was over the phone and I believed them. I would have settled then if I new it would stay for 6 years as thats why I had rang them. The original debt was a £500 store card. Out of all my debts it was the smallest and now all the others are close to being settled and coming off my file yet this will hang around for 6 years. There is only about £80 left and I could settle it now. Is that my only option? To settle now and start the 6 years rolling? I haven't checked on any charges but I could. Im sure there were many. Would this affect the DCA though or would it be with the original creditor?
  13. No, it wasnt defaulted. I wish they had as that would be gone in a year. They have told me that the 6's will stay for 6 years after the account is settled as this is the last 12 months payment history. Even though I paid the agreed sum every month on time.
  14. Hi I got into some difficulties a few years ago and now have some defaults on my file etc. In about a year all the defaults will go due to being 6 years old. I am paying a few things off to different DCA's via various payment agreements and the balances are all slowly coming down. One company CL Finance show on my file as a payment history of 666666 instead of just defaulting me at the start. I spoke with them a couple of years ago as I was concerned that this would stay on there for 6 years after the last payment. I was told at the time that once I made my last payment to them the whole record would be removed from my file. I have just spoken with them again as I was going to settle and have the record removed and they are now saying it will remain on there for 6 years. I would have been better letting it default 5 years ago as it would be removed along with all the others. Instead I have been paying them every month on time and reducing the balance and as a result will suffer:-x Are they allowed to show this as 6 months late every month even though I pay the agreed sum on time? Surely this is not accurate reporting? I offered to settle today if they would remove it and they have said they are unable to do it.
  15. Hi This is still dragging on. They have now sent me a copy of the agreement which is identical to the one i posted earlier but with my signature on. It is now with Robinson Way. How should I proceed considering the dodgy default notice I posted. What effect does that have on the account? They are threatening further action in 10 days. Regards
  16. I already have a thread running and Lee has has looked into this. He was very helpful and even said the price plan they sold me over the phone worked out that I would be paying more when they guy that rang me told me it would save me money. Vodafone however will not wipe off the balance owed and as it has already been sold to a DCA they said there was nothing they could do. My issue here is about them accessing my file. Does the original agreement that would have been a years contract, allow them to still check my file when i renewed over the phone? I dont understand how some DCA can have an automatic link to the CRA's and just be able to view anybodys file without requesting it and sending proof of ownership. Surely this could be abused.
  17. Hi I have an old Vodafone bill that I dispute and which will not go away. It has been passed from DCA to DCA over the years. I received a letter last week from some legal company which i think is part of RED collections. In this letter they said they are going to obtain a copy of my credit file and see how I could afford to repay the sum owed. i thought this was another bluff but today I received another letter saying they have my file now and are looking into ways in which I may be able to clear the balance. What right do they have to do this? The bill is owed from a contract that was renewed over the phone so I will not have signed anything on renewal. I may have signed initially when I took out the first contract but definately not when I renewed. I dispute it as it was mis sold. Can an alleged debt be passed from DCA to DCA and still give them the power to get my credit file? What kind of proof would Experian etc. ask for from them before releasing it?
  18. Hi I have three old HSBC accounts that were passed to Rockwell a few yews ago. I have been paying these and keeping up with payments etc. They have now suddenly sent letters out for all three accounts and are asking for thee whole sum to be paid in full with 7 days. They have also been phomning me and seem very keen to collect. Why would they suddenly do this when my payment history with theem is good. I may go down the CCA route although the accounts were only taken out in 2006 so should be o.k. but I may do it just to be awkward with them. Are they in trouble financially and are trying to get as much cash in as possible?
  19. Hi I had a mortgage with Halifax a few years ago. In 2005 I refinanced with them and have just been going through my paperwork. On the mortgage statement it shows the extra borrowing being added, it then show an advance fee of £150 but also on the statement there is a charge of £1615 which just says sundry. Looking through the original mortgage fee the i noticed that there was an early repayment charge of £1615. Surely I would not have been charge an early repayment fee if i refinanced with the same company? Is this legal? It may just be a coincidence that the figure is the same in which case what could 'Sundry' mean? I think i will SAR them and get all the info.
  20. Hi I have been going through some old documentation for old credit, I found my credit agreement for a £12000 secured loan with iGroup that was taken out in august 2003 and paid off in 2004. I have noticed that this loan was arranged by a company called dial 4 a loan and the agreements, although igroup documents were sent to us by Dial 4 a Loan. On the CCA it says £00.00 under broker fee, surely they would have been paid something for this? Also it says £456.00 optional protection insurance was added to the loan. Can i try and get this back? I didnt usually take out PPI so have not read up on the whole PPI reclaiming thing. Felix
  21. Yes, i was in touch with them before xmas and they asked for all my details, i haven't heard from them since though despite chasing them up, then the letter from Hamiltons came. I dont know if this was sent via vodafone or Lowells.
  22. Hi I sent the letter to lowell and contacted the vodafone web relations team who said they would look into it. I have now however had a threatening letter from hamilton legal demanding payment. I have sent my details to the web relations team and aksed them for some kind of update but they are not responding.
  23. Hi I have had an old Default from Vodadone. The default notice is not correct in terms of a normal CCA. I have been told however that mobile phone contracts do not come under the CCA. If this is the case how can i get a default and how is it regulated? Felix
  24. Should i have been given 15 days for this or is it different for mobile phone contracts?
