  1. well it seems it hasn't taken RBS that long to get through the Hardship cases after the courts decision http://i47.tinypic.com/69nw47.jpg Can anyone please advise on what best to do, i was repaying RBS £10 a month to reduce the balance with interest frozen under Hardship, seems they are now taking this away, can they do this by law? I can stretch to £20 a month but no more but with interest I'll be back in the position i was in the first place with them! arrahhh!

I shall remove the part about contacting solicitors ect Re account no xxxxxxxxxxxxxx Unlawful Rescission. I refer to your Default Notice dated xxxxxxxxxxxx 2009, posted second class and received by me on xxxxxxxxxxxxx 2009, and your subsequent actions confirming your previous written intentions to terminate the agreement. Notwithstanding that the default notice failed to give me the required statutory time in which to seek legal advice and/or remedy any alleged defect, as laid out in s87 of the CCA 1974. Your actions have resulted in insufficient time for me to even obtain an appointment with a solicitor let alone remedy the alleged default. The default amount is also grossly misstated. Your actions have lead to you unlawfully rescinding the agreement. By way of this letter, I accept your unlawful rescission of the agreement I note that you are now entitled to claim those arrears genuinely due at the time of the termination (not including any unlawful charges ) and I would be obliged if you would advise me of the exact amount of those arrears, against which will be a claim for unlawful rescission I look forward to hearing from you. I'm pretty certainly if the CCJ's were issued correctly (i.e you received them and contained the correct prescribed terms) the only time they can be withheld from your credit file is if you paid the demand within the time scale required, usually 28 days. After this and you paid the CCJ over the usual 28 days the CCJ should be marked as 'satisfied' on your credit file and will fall off after 6 years. More info here; Credit Reports: CCJ Removal If you are in the processes of cleaning up your credit file and will be CCA'ing current creditors i would strongly suggest you continue to make minimum payments whilst going through the process as creditors have no problems issuing Default Notice's even when an account is 'in dispute'

  6. fab letter dicky, but my main claim against them (Barclaycard) now is the defective DN, should i mention that at all to them?

  8. letter was received by Barclaycard on the 10th Feb, no reply yet. I had been ignoring the DCA Debt Managers LTD untill this letter came today, 4 days ago i had another lettering asking to ring them to get a lower agreement on the account, but tus on has me slightly worried about CCJ ect http://i46.tinypic.com/191cie.jpg should i reply that account is is dispute since such and such date and do i mention defective DN that has been accepted in writing by me to Barclaycard and provide tracking number? thanks
  9. cheers again, I'll await termination then send letter off to M&S Might be getting ahead of myself, but obviously been turned down for a Credit Card today, would i have a case for damages against M&S for placing a default on my account that was defective?

  12. oh, i thought you only counted working days i.e monday-friday? not to worry, in safe place now till termination but from royal mail it states delivered by 3rd working day? http://www.royalmail.com/portal/rm/jump2?mediaId=400030&catId=400028 i did not receive till today on the 4th day after posting from 8th February.

I have two accounts with Barclaycard one is in dispute due to lack of CCA and now defective default notice the second was in £1 something credit last time i check, i now no longer receive statements on this account and they say they have blocked the use of the account due to the nature of my other account, can they do this? thanks

Had a letter from M&S saying Door Stop calls letter i sent them had been 'noted' A new DCA has taken on the account, how exciting i thought, i ignored ther first letter, but now they are demanding full amount to be paid with in 7 days, should i write to M&S accpeting unlawful termination due to faulty DN yet or leave it a bit longer? http://i48.tinypic.com/mukdfp.jpg
  19. I shall modify slightly what you wrote Dicky, the CCA they sent me has flaws in too. I presume just any address to Barclaycard? I have plenty of names and address i can use from all the letters they have sent me over the last 6 months!
  20. cheers Dicky i get it now, was worried about losing the DN whilst reading it but now found, knew it was too safe, have put it in the safe! lol I now have both Calder Financial demanding full payment since Jan 2nd 2010 and now Debt Managers LTD demanding full payment and advising me that Barclaycard will no longer be sending me another further statements and charging me 1% interest, heres letter from them dated 13th January; http://i48.tinypic.com/21pswo.jpg
  21. thanks Dicky, i have read through that very helpful post so if i accept the termination which i guess can be presumed due to 2 requst for full payment they can only issue a second DN on this account if i fail to pay the arrears? I'm a bit worried now, for some reason i can not find the original DN, i have a copy but god knows where i put original, i kept it so safe i can'nt now find it! Think i'm in the ****e ere!

  25. Hi all, i took out a student account with HSBC in June 2004 as i was going to uni in September 2004 I graduated in July 2007, and my account switched to graduate account, does this graduation account last 2 or 3 years from date of graduation? thanks
