  1. thanks, i was ill last year, split up with ex partner and lost job, currently on JSA and finally getting sorted out again, but have debts of around 6k on £242 a month including RBS overdraft of 2K in which they keep chareging me £38 in fees for direct debits i could not pay this month, so i think i might have a case, hopefully. P.S I have done the letter and expenditure form found on ere, made us a bit sick doing it actually, but no choice at the moment, need to get sorted but chargeing me £38 for a failed DD when your on £61 a week to survive is a joke really!

  4. Hi all, i bought some t-shirts from play.com (Jersey based company) and they arrived in non resealable bags, so obviously i had to open them to try and them, and there to big! Have asked for a simple exchange, but they can only do refunds, but just noticed that it states they will only refund if item is sealed? How the hell would i beable to try the t-shirt on without opening? Can anyone advise? thanks

  6. alleged debt is regarding a Paypal account which was closed, and then a charger back issued after account was closed! To which obviously i could not dispute because account and e-mail address had been closed down! They have sent me a letter saying nothing more than they do on the phone that i owe £30 to them for paypal, they have no other details than that and obviously can't put them in writing because they don't have them! So do i need to send them letter requesting signed copy of credit agreement? I was of the understanding that Paypal don't offer credit? thanks
  7. thanks azmol, i have read the whole thread, but not sure how requesting credit agreement will help? If it does can payment be in form of postal order as don't fancy giveing these muppets any bank details at all!
  8. can anyone advise on which letters i need to send NCO? Because they: A) Say i owe a £30 Paypal debt that i have no idea about, i have requested full details in writing of the debt 3 times but they never supply anything in writing to me! B) They keep calling me about the surposed debt and i'd getting sick of it now! thanks

Thanks Paul, very helpful, i have read it all the way through, but because he was made bankrupt before May 2000 the new legislation does not apply and seems as though the trustee could continue to take monthly payments until death or end of pension. However the trustee was released from his duties on the case in March 2005 and handed back to the insolvency service, so does that mean he is entitled back to his pension from that date? Its all very confusing to be honest and seems very wrong that there was never any legislation in place for this kind of event before May 2000. thanks
  10. Hi, a member of my family was discharged from bankruptcy in November 2002. His pension was still being taken by the trustee appointed\insolvency service until 1st April 2008! £211 per month minus TAX (can you get taxed on money you have'nt recived??!!) This seems bizarre and has taken going through his local MP and various other chanel's to get an answer which is still not clear. His questions is: "After discharge from bankruptcy how long can the proceeds of a pension annuity be taken\collected by the trustee appointed\insolvency service?" Many thanks
