Whiskey I think you will be very hard pushed to find anywhere in any paper work or taped telephone calls any information that actually told you the full cost of the loan - and more specifically the PPI element. Your original contract will show the total of your loan and then a total for the PPI which will go a long way towards that amount. If you havent already, then ask for a full S.A.R - (Subject Access Request) which should come back to you with tapes of all conversations, and will give you a better view of your situation. best of luck BHB
  2. Feebs, First Plus did not tell me about the interst on the full term and so the full cost of the PPI, and the tapes I have agree. However FP are still disputing that any misselling occurred and I am currently waiting for the FOS to make a ruling on my case. BHB
  3. Evening. For the sake of £10 I would prefer to have everything. As you were "introduced" it is entirely possible, depending on how your conversations went, that you bought PPI of either party. In my case, we rang FP direct so don't have this issue. Good luck and don't give up!
  4. Surely this kind of information should be in the SAR documentation. If you have a claim against anyone, and Firstplus are "referring" any claim to what we see as a 3rd party, then any reference to the company has to be in the terms and conditions of you agreement. I might be wrong, but if there is no mention of the Company in your agreement for the loan or the policy, then I believe they are playing the delaying game. Have you sent a SAR before claiming ?
  5. When you ask for the S.A.R - (Subject Access Request) make sure you ask for all details relating to both loans. Its up to you if you want to cancel the PPI before claiming, but I think you will be surprised at how little it actually reduces the monthly payment. What they refund you from the cancellation of the policy is only a small fraction of what they actually charged you at the start of the loan. They will also not be refunding any of the interest that they have charged you on that PPI. Good luck with whatever you do . BHB
  6. My partner has received a letter from FP telling us that our loan will not be affected in any way and will continue as normal. Am therefore assuming is only new secured loans that will not be offered.

  8. My understanding, based on my own documentation for two loans, assuming your T&C's are the same, are as follows :- Main Applicant Covered for Sickness, Involuntary Unemployment and Death. Additional applicant(s) Death. Hope this helps. I do not believe the "Self Employed" element is an issue on this occasion.
  9. Thanks all for the comments. Not too sure what costs there are, i've only spent £10 on the SAR, £6.99 on a tape player and a couple of Recorded Delivery Letters. Absolute Maximum is about £25. Not to worry, if the FOS do respond and say they can't help, i'll be off to the courts for a couple of hundred quid. I'm seeking refunds of thousands.
  10. Evening Caggers. FOS have updated me today to say they have passed the case to an adjudicator. I guess it's a waiting game now. It will be interesting to see what else Firstplus use to reject my claim next. FOS Said to send them everything, so I did, every single page from the SAR and the correspondence. I have nothing to hide and everything to gain. Any further updates, i'll let everyone know.
  11. We did the following :- S.A.R - (Subject Access Request) - we got most of it. Sent them a letter claiming mis-sold - then got a standard fob-off letter. Rejected their rejection - received a standard increased refund offer. sent claim to the FOS who are now looking at the claim.   12. It's your decision to make Finlander, you need to weigh up the pro of getting possibly a quick result for some cost, or waiting longer and getting the result for free. Not sure if the possibility of a win is any more likely one way or the other ? (might the FOS remember the number of complaints they have against FP??) If you are in a position to wait it out then that's what I would do. That way you still have the court route to fall back on. (Obviously they would say its quicker if it means they get some cases off their list and onto someone elses, or maybe I've become to cynical!! ) Best of luck which ever you decide. BHB
  13. Thanks marshallka. In a nutshell, i'm claiming they sold me two policies id neither needed or wanted as the policies were not required, did not cover me correctly and were missold on the benefits package associated with the loans. We have supplied FOS the entire correspondence and copies of every single page from the SAR. So as far as i am concerned, the only thing they do not have is copies of the tapes. I will challenge the use of anything other than these tapes that are not included in the SAR, as they will be in breach of the SAR if they do so. Not that i'm thinking there is anything else for them to send, except of course any other additional documents they claim to have sent that we have never seen before. I'll udpate all as and when the FOS respond.
  14. FOS even send acknowledgment letters within 24 hours. Lets hope the rest of their service is as good. Based on a previous call, i'm not expecting anything more for 3-4 weeks, but will keep all informed. Any more advice on our claim appreciated, but genuinly looking forward to the FOS decision, irrespective of how long this takes. Could be a cracking Christmas...... Fingers, Arms, Legs, Eyes and a few other bits Crossed.
  15. Blimey - two final responses received today rejecting the claims but offerring enhanced rebates of a couple of grand in total. Without prejudice and without admitting anything. Specific mention of the the fact that if we are not happy we can go to the FOS, but they probably won't help due to the age of the loans. Thank's for that Firstplus, always useful to receive informed and valuable information. Guess it has to happen now and again. What's that? Phoned FOS this afternoon who said they would look into the claim, gave me a reference number and everything. Firstplus in the wrong again, never !!! Downloading forms as we speak and the copier is getting warm copying all 148 pages of correspondence to date. (This does include the SAR Stuff. FOS said copy all of this as well, we then can't be accused of hiding anything then.) Hmmm, a couple of grand or the chance of letting the FOS receive another Firstplus claim, which I believe nails Firstplus to the wall for well over £20k. Guess I'm off to the post office in the morning then. Let battle continue !! Anyone received any form of acknowledgments or timelines from FOS re Firstplus ? They did advise they have started looking at claims received about three weeks ago! So expecting a month before we get an acknowledgement.
  16. Woohoo, we have a holding letter. Thanks Firstplus for clicking that button, well worth the hourly rate.:o Guess I'll have to wait, AGAIN ! Or, I could spend the next week or so completing the FOS Paperwork anyway. They have said they will look at the cases once we have our final responses. So about a fortnight then !

I sent a SAR request to Firstplus and asked for all details of all loans, I didnt have any information regarding my first loan, other than the fact that there was one, and they still managed to send me all the required information. ( my loans were secured too, so dont worry about that part). So, send off your SAR request and wait to see what you get back. Good luck with your claim BHB
  19. Blimey Finlander, I thought I was in a bad mood. I do however agree with Goldlady, i'd be reluctant to call Firstplus a "SPIV" when you are asking FOS for their support in a claim. The fact that they are "SPIV's" will be absolutely clear to the FOS, especially as they are going to get my claim in a couple of weeks as well, the way things are going, anyway. Should we be starting a "STANDARD PARAGRAPHS REFERENCE LIBRARY" just so that we can all respond to firstplus's letter quick and easily. For Example, Thank you for your letter of ?? June 2008, the contents of which "PARA 1". PARA 12, PARA 14, PARA 17, PARA 19. Yours sincerely..... Come on, we all get the drift, two to three hundred of us can play at that game as well !!! HANG ON ! Changed my mind, Why don't we prepare all fiveletters, Letter 1, Complaint to Firstplus, Letter 2, Their standard response, Letter 3, Rejection of response and further complaint. Letter 4, Standard Final rejection with BAU Offer as a Gesture of goodwill. Letter 5, Warning that we are going to FOS/Court LETTER A Dear Firstplus, Please find enclosed letter 1 through 5 detailing the next 2-3 weeks correspondence. In order to save us all a little time and postage, I've pre-writen your responses, refer letters 2 and 4. Should you dumbfound me and actualy read my complaint, please forward you cheque by return, alternatively, please sign the attached rejection letters, which I will immediately forward to the FOS.   20. Finlander, This is standard reply number 4 (lol) as it is word for word what I received from them - except for the amount. It shows how much they have actually read or noticed about your claim that they are keeping monies back for future claims when the loan and the PPI have been settled. Basically taking as much care with your complaint as they took with looking after our interests at the start of the loan. No wonder no-one is surprised by it.

Perhaps you should start your own thread rather than posting here as your case will be more easily followed on your own thread and may be lost inside the goings on of this one?   22. Thanks everyone, the support here on CAG is superb. Needless to say the letter will predominently focus on their rejections of our claims, the specific points where they state we were told etc etc etc. I'll be tagging the SAR Failure as a little extra point that despite their best intentions, they fail in every regard. I'll be wording it along the lines of in the absence of a sensible response, I intend to ensure I have every single document known to man, before FOS and potential court proceedings commence. At least this way, there are no little surprises waiting in the dark.
  23. What the heck, I dunno, I thought all of these groups had to have three letters in their acronym. FLA, FOS, FSA, OFT, CAB, BBC, ETC Guess I can copy my docs once more.:grin: Come of Caggers, lets get PPI nailed down once and for all.
  24. Agree with comments above. One word to the wise, I'd avoid posting anything Firstplus can track back to you. The more claims I read the more convinced I am that they have staff trawling through the CAG frequently, to check who is getting what assistance. As for the payments, you should see a significant reduction, assuming they do it properly. Only cause for concern in comments below, is if you cancel the policy and then lose your fight, you lose the refunded premium. It's a difficult decision but one you need to make alone. I guess the question is; are you going to fight your case as far as necessary and are you prepared to speculate to accumulate ?
  25. Still ongoing, but the longer it takes the more determined I get. Bring it on !!! When you get your SAR paperwork back, make sure you check through it. They missed loads of pages and letters from ours.
