  1. "he did not get any of the money they get." Which disproves ANPR's signs that say every time somebody breaks the "rules" then ANPR are in breach of their contract with the landowner and have to pay them £100.
  2. So it is worth complaining to the CO-OP's head office and their CEO. There is a very good chance that the company will pay it for you. As I said, good news for the individual motorist, but bad news for the "divi". Saying that, I have heard a rumour that the the CO-OP are taking steps to recover that money from CEL by other means.
  3. I thought you said it wasn't in a CO-OP . But now you are saying it is.
  4. Was this at a CO-OP store? If it was then many people are finding that if they write to the store's head office then the CO-OP will pay the £165 over to CEL to drop the case. Good news for the motorist, but bad news to CO-OP members who will lose on their dividend.

  7. I've passed the message on. Update. It appears that only the judgement was recorded not the actual hearing . So probably not worth the effort. As a side-note, the "defendant" was Professor Rachael Finn - Director of Postgraduate Research Professor of Organisation Studies at Sheffield University Management School. So VCS seem to have picked on the wrong person for a fight.

  10. Hopefully Parking Prankster might use the funds raised by his guides to fund a transcript. He's done that in the past, especially as this seems to be an important case, concerning both GPEOL and multiple tickets.

  12. Vehicle Control Services (part of the Excel empire) have lost a court case in Sheffield today. What was interesting was the judged ruled on GPEOL and that VCS's calculations of loss didn't bear any relation to the parking incidents. £95 costs were awarded to the defendant. ​Sheffield County Court Case No. 3QZ64216 VCS v Rachael Finn Claim for £732.81 + Court Costs (multiple tickets)
  13. This is a growing trend amongst a lot of PPCs' As soon as you put up a strong defence, they just throw in the towel. Unfortunately there are enough people out there who will get taken in by PPC's threats and just pay up. So it's a numbers game for the parking companies.

  15. In fact PE have now given up on POPLA appeals when GPEOL or contract are mentioned. They just don't bother to submit evidence thus giving a win to the motorist.

  17. First you must establish from the council whether this is a private road or part of the public highway. Even if the former then you do not owe VCS a penny as they have not suffered any loss. and that's all they can claim for.

  19. This not bothering to submit paperwork is happening time after time not only with PE but with other PPCs I suppose they now know they are flogging a dead horse.
  20. It just shows that even when a PPC employs a QC cases can still be won when you know you are right and the PPCs are wrong.

  22. This "spend £30 and we will refund your ticket" is a blatant hidden clause in their T&Cs which is not visible on any of their signage in either the car park or in-store. Thus it would be ruled as unfair in any court of law. That's before you start considering the whole question of what actual loss that either Parking Eye or Aldi have suffered. Luckily both the courts and POPLA are now seeing through their whole shaky business model and are finding in favour of the motorist.
