  2. Hello lilal, I sent GE Money another letter yesterday asking them to look at my claim again and informed them I will be reporting them to the FO, FLA and the ICO. Have you had any luck with GE, have you had a Court Date yet?
  3. Good luck for today, I hope you get the result you want. I am watching with interest as I intend to make sure MBNA refund my mis-sold PPI also.
  4. Hello Hellhasnofury, I am not the greatest on the computer. Do you mean scan the documents and download by using the insert image icon? Looking at the application form I applied for this card on the 28.11.01 it was a Thomas Cook MBNA credit card then but has sice changed to just MBNA. Looking at the document titled 'Credit Card Agreement Regulated by the Consumer Credit Act 1974' (This must be the 'Terms & Conditions' under Key Information it reads : If you break this agreement, you must pay the following default charges. £12.00 each time that your payment has not reached your account in cleared funds by the date your payment is due £12.00 each time a cheque, direct debit, a credit-card cheque or other item for payment is unpaid £12.00 each time the account balance goes over your credit limit ..... Is this what you mean? I have just looked at the last 6 years statements they have sent to me and the current terms and conditions on the 6 Mar 08 and the 'Terms and Conditions are exactly the same as what they have just sent me! Also looking at the transactions on the infomation they sent me, I was charged late payment fees of £20.00 in 2002, unpaid direct fees of £20.00, Returned unpaid direct fee of £35.35, in 2004 £25.00 for late fees and Over Limit Fees £25.00. In 2007 my late fees were £12.00. I have paid around £250.00 in fees I will send them a letter requesting these also. I have only been concerned with PPI I have paid a few hundred quid. So looking at these documents they cannot be 'True Copies' as the default charges do match what I have been charged! What shall I do no? Your advice is very much appreciated. Sorry this has been a bit long winded.
  5. Please could I have some advice on my next step with MBNA. I have today received from MBNA original credit card application form and agreement and terms and conditions. How do I know if this is a true copy of my credit agreement? Do you think the court route is now the best bet with this. If so, is there information on this site that will help me to step-by-step with the court application form and advice. Good luck Oggy1 with your court case please let me know the outcome. Any advice from yourself would also be appreciated.

Any advice please, I sent a letter to MBNA on 17.3.08 containing the following paragraphs (as per hellhasnofury advice re letter N - Thank you.): With reference to the above agreements, I would be grateful if you would send me a true copy of these credit agreements. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of the credit agreements on request. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. I understand a copy of my credit agreements should be supplied within 12 working days. I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act. I have not had a reply from MBNA yet though they did cash my cheque on 3.4.08. Any advice on what to do next would be much appreciated.
  8. I have now received a letter from NatWest offering me a refund of £724.96 which is the past 6 years premiums plus 8% interest. I am very pleased. I could not have done this without help from the Consumer Forum. Thank you to Hellhasnofury who has helped me.
  9. I have had success with Alliance & Leicester PPI. I hope I am posting this in correct place. I sent S.A.R. letter 27.2.08, received documents back for the two loans I had previously. 11.3.08 sent letter informing A&L I was mis-sold and wanted full refund off PPI. 27.3.08 received letter from A&L offering me a refund of £1556.76. I accepted this and the cheque goes in the bank today. This money is very much needed to help me settle other debt. I am really pleased and The Consumer Forum has helped me to get to this result. I will be making a donation to the forum. I still have to pursue Lloyds TSB, MBNA and GE Money. These are proving difficult I will be needing advice on these and hope The Consumer Forum can help me again when I post my new threads.
  10. Hello, Thank you for all the replies, I have only just read them, been on holiday. I did send a S.A.R. and they said they were sorry they were not able to get me all the information I require. I will send a letter to the Information Commissioners Office.

  12. Hello Hellhasnofury, Thanks for replying. I dont really want to go down the court route with this one, they owe me about 150 quid may be less, I am not sure because I have missing statements that they could not provide. The form they sent me was the pre-contractual application form that I filled out in store. The also sent me a copy of GE Money Account Cover Policy Document.
  13. Please could you advise me if possible on how I can respond to GE Money. I have received a letter back from GE Money informing me that they will not be refunding my ppi. They included my copy credit agreement on which I have signed next to the cross the sales assistant marked for me to sign and my copy account cover policy. They have written that recent fines by the FSA relate to policies purchased after Jan 05 and mine was purchased March 03. They wrote the process they had in place at the time of the application was to make it clear the policy was not compulsory and I had 30 days to contact them and cancel if I wanted to. (At no stage was PPI discussed during the application). They also stated that following my DSA request they were sorry they couldn't provide me all the information I requested and if a refund were appropriate they would estimate the unknown premiums paid by using an average of the known premiums paid. GE Money end the letter by saying I can contact the FLA if I remain dissatisfied. In the letter I sent GE Money I said I wanted a refund due to following: having recently looked at the paperwork for my store card I now realise that I have been paying for insurance that I did not know I had taken out so could not have been explained to me. your salesperson did not discuss account cover premium with me at all or inform me that the policy was optional. The application in store was a very quick process where by the sales person asked my name address and phone number and then asked me to sign next to the sections marked with a cross. Your sales person did not tell me in store I was signing for Account Cover Premium. I believed I was putting my signature to an application for credit. I am concerned the sales person that sold me the policy has no financial background and the policy was not sold in my best interests. Also due to the fact GE Money have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests. Any advice please.

  16. Please Could Anyone Let Me Know If I Am Wasting My Time Trying To Pursue Mbna. I Have Received A Letter From The Saying They Will Not Refund The Payment Protection Cover Applied To My Account From 2001 To 2007. They Say The Letter Is Their Final Response And I Contact The F.o.s. If I Want To. They Attached My Application Form On Which I Had Ticked The Box Selecting It. They Also Say It Was My Responsibility To Ensure The Policy Met My Requirements And I Have Had Many Opportunities To Discuss The Details Of The Policy. Does This Mean I Have No Chance. When I Applied For This Card I Didn't Have Understanding Of Ppi, I Though I Best Tick The Box Incase I Ever Got Made Redundant. I Now Know That The Payment Protection Was Optional And Had No Real Understanding Of What I Was Signing Up For. Does This Mean I Have No Chance Of A Refund Now Because I Was So Careless And Financially Ignorant. I Cancelled The Ppi On This Card In June 07 After Someone Telling Me Ppi Was Optional. I Had No Idea When I Cancelled It That It Was Possible To Claim Back Ppi. I Have Only Found This Out Recently Due To The Consumer Forum. Can Anyone Give Me Any Advice Please.

  18. Yes I will send a S.A.R. I did send them £10, to get the information I have received,I don't really want to send them another £10. Should I let me know I wont pay again as they should have provided me with all I needed to know at my first request.

This is a paragraph from the letter I sent, is this similar to a S.A.R.?: I am writing to request a fully comprehensive list of all the insurance charges added to my account(s) with GE Captial Bank Limited. If you are unable to provide this data, I will accept copies of my statements. I understand that statements on their own are not covered by the Data Protection Act, yet I’m not requesting the statements per se, but the charges, which I’m entitled to. Also I would like to request a copy of the terms and conditions that were applicable to the above account(s) at the time I took out my agreement as I no longer have a copy and would like to check some of the details. They have supplied me with some statements, they did not send me the terms and conditions I asked for either. I am going to write another letter today asking for the terms and conditons I asked for and the exact reason why they no longer have the data for my account.
  20. HI, Please could anyone advise. I have received some of my Dorothy Perkins statements back from GE Money along with a letter stating they have no data for various dates which add up to 13 months of missing statements. I had this card since Mar 03 and have been paying Account Cover Premiums since then. I want to claim back the monies I have paid, should I just estimate what I think I have paid on these missing months. Any advice would be appreciated. Thank you.
  21. Hello Hellohasnofury I Didn't Think You Were Sticking Up For Nastywest Not At All. I Have Sent A S.a.r. And Have Received An Ackowledgement Letter To Say They Will Contact Me In 14 Days. Another Week To Go. They Have Cashed My Ten Pound Chq. I Can't Even Remember Signing For This Ppi Although I Must Have Signed Something All Those Years Ago. I Dread To See How Much I Have Actually Paid Them Over The Years. Thank You Again.
  22. Hello hellhasnofury thank you for your reply. I am not very hopeful that I will get any joy with the Natwest but I will await their reply. If I am not happy with their response I will inform them that when I applied for this credit card I was never informed that PPI was optional. If I had been better informed by Natwest Access I would not have purchased this PPI. For the £25.00 a month I have paid for much of the time I have had this credit card, I could have purchased an Insurance Policy elsewhere which would have provided security for all my debt if I was every unable to work. I have recently applied for credit with the Natwest and they were very clear in stating the PPI was optional. I didn't even know I had PPI on this card until I was made redundant and looked at my finances. Maybe you think seems like a lame excuse for claiming but I really feel like I have been robbed of this money. If you can think of any other arguments I could put accross I would be grateful, otherwise I will go with this, I have nothing to lose they have already had my money for over 13 years now.

I Have Just Remembered About 13 Years Ag0 I Was Made Redundant And Did Claim On This For About 12 Months Payments. Am I Wasting My Time Trying To Claim Monies Since Paid. Thank You For Any Advice.
