  1. Well done on getting your money back. I had written to them asking for my fee to be returned which they had charged when I had moved my mortgage to another lender (£250). They said they were entitled to charge this, but I did eventually get my money back. Keep on keeping on and it pays off eventually.!
  2. Could you please post the model number of your dryer. I have a CTD00G which was making a terrible noise when it was under warranty. engineer came out and said there was nothing wrong with it. machine broke down completely when outwith warranty and hotpoint will not come back out without charging £99 for call out and repairs. I have found several reviews of this model on the net, all of which have the same problems (drum not turning, burning smell, humming noise, water on floor). Needless to say, they do not have this model any longer.

If anyone else has tried to reclaim late mortgage fees, I sent BM Solutions a letter based on a template on this site stating I wanted the £225 which I was due from them as I felt their late payment fees were unfair. Received letter back from them offering me £112.50 as a goodwill gesture, but not accepting liability. Wrote back to them stating this was not acceptable and that I would accept £200 in order to settle the disagreement quickly. They wrote back stating they would repay me £225 as a goodwill gesture, but not accept liability. Needless-to-say, I accepted and received the cheque yesterday - RESULT for the little guy. IN SUMMARY - GET YOUR LETTERS OFF TO THESE PEOPLE, they may fight, but this site shows the success stories.

Extending the credit term and reducing the payments might seem a good option, but credit companies can add a huge amount of interest onto this sort of thing (experience of this with The Funding Corporation and their "rescheduling" of a loan). Call again asking to speak to someone in their credit/payment centre rather than general customer services who tend to give you the general scaremonger speel to avoid you not paying them. It is basically not worth the trouble for the company to take back the car, sell it at auction and then chase you for the money when you have already told them you are struggling. Try telling them that your current financial situation is temporary i.e. for 3-6 months and could you reduce your payments for that period of time, telling them you want to avoid any action and thereafter the cancellation of your agreement. They may agree to this with a view to reviewing the situation say after 3 months. By saying 3-6 months you have room for negotiation and most of the time companies will try to accommodate - most of the time it is getting to speak to the right person. Good luck
  6. INFORMATION-My van failed MOT due to wishbone arm needing replaced. Wishbone was still under manu warranty due to being replaced within the last year. Took it back to garage who fitted it and was told manu warranty only covered part and not labour to fit it (would not even come to an agreement over reduced cost for labour) - paid labour, but made known I was very unhappy and wanted manu contact details to try to reclaim labour charge as was not my fault part needed replaced. Part sent back to manu through autoshop who supplied garage. Manu agreed part faulty and autoshop have paid me back my labour costs with no argument from either them or manu!!! IN SUMMARY - IF THIS HAPPENS TO YOU PRESS FOR YOUR MONEY BACK, PART NEEDING REPLACED NOT YOUR FAULT. Once I took the problem outwith the garage and their "nothing to do with us" attitude, I have not had any trouble. BTW just to top it off, I had the usual "what does a woman know" attitude from the garage!!!!
  7. Thanks for the comments. I used Martin Lewis' link to a group in Govan which has a template for writing to mortgage lenders re late payment charges. I was claiming £225 and they wrote back offering £112.50. I rejected this and have said I would be willing to negotiate - they have wrote back to say it has been passed to their second stage complaints department (someone else's mail tray probably). I will keep you posted on the outcome.
  8. If the car was on HP you can voluntary terminate your agreement when you have paid half of the overall amount due. If the car was on a motor loan this is not secured on the car, but merely used for the purpose of buying the car. My agreement was for a motor loan and so I was able to sell the car. Did the Funding Corporation provide you with a figure for final payment prior to acepting the car back? I had volutary terminated an agreement with another company and was half way through the agreement, but was one payment short of half-way, they accepted the car and I was liable for the last payment and collection fee only - Black Horse was the company and although they are a nightmare for loans, their voluntary termination department were excellent. I would strongly recommend that you contact the Consumer Credit Counselling Service (Google the name for their number) who are a free advice service regarding debt management (like Payplan only better) and will provide you with the reliable information you need - I followed their advice and my situation was resolved well.   9. Got a motor loan from them - not secured on car. Sold car due to financial difficulties and kept up the payments on the loan. Missed a couple of payments on the loan and I agreed with them to take reduced payments. Got a statement of the loan through and the amount had increased by £2000. Called them and they said the loan had been rescheduled which meant more interest as it was over longer period of time. Person who agreed reduced payments did not say anything about "rescheduling" or more interest etc. I have not signed any paperwork for this (it is in my husband's name, but he has never spoken to them). Does anyone know if this is legal? Should my husband have been asked to sign some paperwork? If there is no signed paperwork will the loan be void and return to the previous amount? Can I claim for the charges through Small Claims? I live in Scotland and am desperate from some sound advice - please help.

  11. Is it true that in Scotland I can only claim for charges in the past 5 years - is that 5 years from when I post my first letter to them or 5 years from the date it goes to Court? 1 of the accounts is in joint names with husband (now separated)
  12. I wish to claim charges from more than one bank account, even though the accounts were all with the Bank of Scotland and Halifax/Bank of Scotland. Do I put all the charges into one claim or do I submit a claim for each bank account. I live in Scotland.
  13. I had missed several payments to my mortgage provider and they added fees to the account. I had been paying the backdated amount at £10 per month. I have just changed mortgage providers and wondered if I am able to claim back the mortgage provider's charges (i.e. late payments fees etc). I live in Scotland so I am not sure how the law is different to England. I was also charged £150 vacating fee, but they are refusing to give me that back even though my F.A. has instructed me to ask for a refund.
  14. Am I correct in assuming that this company must hold a new Credit Agreement (which must have been signed) in order to make any changes to the term and amount of the loan.
  15. Thanks for this. The extra monies added does not seem to be charges, but they have explained this as being a bit like a "revised" agreement where it is taken over a longer period and so interest is added. They have never previously indicated any of this and I merely thought they were accepting a reduced payment. Excuse my ignorance, but what is CCA?
