  1. Just recieved my reply today from capquest that says..... Further to your recent contact with our office and request for further information we would confirm that your account is on hold for 28 days whilst we obtain the information required. If you have ANY PROOF OF PAYMENTS OR CORRESPONDENCE that would assist us with your enquiry please forward the documents with a covering letter to our collections department so we can resolve this matter. Yeah right...I take it that this must be a old debt then that is statute barred and they want me to provide them with some proof that contact has been made in the last 6 years, well I dont have anything because I dont even remember the debt so it must be quite old!!
  2. If capquest took over the debt then the name on the default automatically changes over to them. I wouldnt worry too much it looks like it may fall off your file on the 1/04/2008 anyway

Honey, I have read all this thread, I was not in this situation with husbands cap1 card, they only sent application form and it has been passed to cabot dca, they just gave up chasing it once they knew they had no cca. Sorry cant be of more help:( but I suppose someone on here will continue to advise you.
  6. I have just wrote this letter myself, do you think this will do as 1st contact letter then maybe when they provide me with details I can send them the statute barred one? Dear Sir/Madam, I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY After recently obtaining my online credit report from equifax I was concerned to see a search from your company. As I do not have any outstanding debts I rang your customer service department immediately to see why you have done this enquiry . I was told it was for a Shop Direct debt from many years ago, I do not recall ever having an account with Shop Direct. I also notice the search was done in the name of xxxxx, my maiden name is XXXXX, therefore spelt differently. I do not know where you have obtained this information and would therefore be grateful for you to provide me with any details that you may have about me. I would like you to provide me with the following: 1.The date the account was opened 2.The date the account was defaulted 3.The balance of the account 4.The address where the account was obtained. Once I have this information I may be able to help you further but in the meantime I do not accept that this debt belongs to me.
  7. Can I still send the statute barred letter even though I dont believe the debt they are chasing is mine?
  8. This is breach of OFT guidlines. The following is information is from the OFT that debt collectors should NOT do! j. acting in a way likely to be publicly embarrassing to the debtor either deliberately or through lack of care, for example, by not putting correspondence in a sealed envelope and putting it through a letterbox, thereby running the risk that it could be read by third parties. --------------------------------------------------------------------------------- I am in dispute with Welcome finance and believe me they break all the rules. Before my dispute they called at my house 3 days before my payment was even due at 8.30pm to obtain my debit card details as they knew my old card had expired.....I refused and told them to leave and closed the door in there face!

  11. I think that if I do have a debt, it would definatley be over 6 years old as I cant remember it, also as I had a default in 2002 from activ kapital I have been unable to obtain normal credit for the past 6 years.
  12. Thats the strange thing though, there is no account on my file, they have just ran an enquiry search yesterday. I only rang them to say "why are you doing an unauthorised search on me and they tell me I have a debt. I am wondering if they can add it to my file?

  14. Thanks. I dont know when this account was from as I dont even remember having a shop direct catalogue. I have just moved house and was in my previous address for 4 years and I never had anything on credit there at all. The last catalogue I had was studio in 2003, this has been settled. I am thinking if it is mine it must be from a long time ago, but why havent they chased me before now? I am always on the electoral register so I have not been hiding!

After getting rid of my final debt and defaults at the beginning of the month I was shocked to see on my equifax online report today that a dca called capquest has done an enquiry search on me yesterday. Not knowing what it was for or wanting to get any adverse credit I rang them straight away, they tell me that it was for a shop direct account from years ago and that I owe £577:eek: , I do not remember ever having a shop direct catalogue and I think I would remember owing someone that much. Also I noticed on the search my surname is spelled incorrectly. I have told them I have no idea what they are talking about so they told me to put it in writing....any advice please?
  16. I had a default from Aktiv Kapital that they refused to remove so I emailed all 3 CRA`s asking them to remove as I had never recieved a default notice. They responded by saying they would contact Aktiv on my behalf and dispute it. Aktiv only replied to experian to say it should be there but they did not reply to equifax or call credit so they just removed it from my files anyway...... its worth a try! Unfortunatley it remained with experian but dropped off my file a few days ago as the 6 years was up.
  17. I wanted to know this as I had just sent the data protection letter to studio to remove a satisfied default......and they have removed it. I can email you a copy of the letter I used if you like, I wrote it all myself!
  18. Success!!! :D After trying to get this company to remove default since November, and they had refused, I sent them the data protection letter last wednesday. Just logged on to equifax..........and its gone!!! It just goes to show if you persevere you will get there in the end.

  20. Lol:-D Ive been counting the days since November when Activ Kapital refused point blank to remove it:mad: I think a balance transfer from my 39%apr capital 1 card is on the horizon now I`ll have no adverse credit!
  21. Thanks, I am having a good day today and tomorrow looks good too because it will be 6 years to the day that I was issued with the only default on my file so you know what that means......:grin:
  22. Try ringing back to see if you get another person, the woman the other day was adamant there was nothing she could do. The woman today was lovely and said as it was the first time this had happenened on my account she would gladly refund it for me:grin: I think it just depends what mood thier in when you ring.
  23. Result! Spoke to nat west the other day, the woman I got would not help at all with charge. Rang back today and got the most helpful, friendly woman who apologised and has refunded the £38 back to my account!!:grin:
  24. I suppose we would all like to run our accounts responsibly, but sometimes we can forget about things in our hectic lives! :-? And actually this forum does provide Great Consumer Action, but you already know that otherwise you wouldnt be a member......would you!

Its robbery, no wonder so many people are in debt, they should not be allowed to take your benefits (mine come out of my tax credits) I rang them up and they said there`s nothing they can do about it because the charge has already been taken:mad: this is the first charge I have had with the natwest
