  1. Thanks I`ll do that now. Just realised the letter I wrote to them was a request for my credit agreement. My letter basically said "due to the ongoing problems I was having I would be seeking legal advice and therefore require a copy of my credit agreement. Do you think this is good enough as a cca request because I understand from here they only have 12 days to reply and I sent it 28th sept so the clock is ticking but I suppose it could be stuck in the post with this strike!

  4. Do I just say on the S.A.R I also require a consumer credit agreement, sorry not very good with this! Is the cca not what I already have?
  5. ok,I`ve just read the small print. (Description of) option fee - you may exercise your right to buy the goods by paying the option fee, if you do not exercise your option you must return the goods in good condition no later than the final payment date.

  7. agreements states M -cash price of goods - £6,700 N -insurance - £245 S -Acceptance fee - £195 T - Finance charges - £4,688.84 U - Option fee - £100 V -Charge of credit for goods S+T+U = £4,983.84 W -Charge credit for insurance - £166.84 Total charge for credit V + W = £5,150.68
  8. They have not charged for ppi just gap insurance and admin fee and option fee, these are on the agreement before credit charges added
  9. LOL! I`m just worried about getting a default as I am just currently rebuilding my credit and dont want to ruin it for another 6 years!
  10. they charge me £25 to send a letter, also when I ring them they say they have been trying to ring me, but I have no calls from them. I aked them what number they are ringing me on and they told me a number that has never been mine!
  11. oh no, i`m glad I found this forum...I was going to agree to the voluntary termination just to get rid of the car off my driveway but I think I will fight them now!

  17. Will try to keep this as short as possible. Bought a car on (high rate) finance 18 months ago. It broke down within 3 days was "repaired" went back to the garage 2 wks later when it broke down again and then again 4 months later. It was again repaired and was fine for 3 months although it never had no power then it broke down again, took it back the garage and the garage was closed down. Last xmas I rang the finance company who told me to put it into a garage of there choice where it was inspected on 4 occasions they said they could not pin point why it was breaking down and agreed with me the car had no power and was shaking. I then paid another garage to replace the coils and fix the electrics to see if this would help but it still was running badly eventually in april this year it broke down completly and has been on my driveway ever since. I have made no payments since (although have been in full contact with the finance company) they have not defaulted me but said the car is my responsibility to repair and all they can offer me is a voluntary termination with me still being liable for £4000. I think this is unfair as it was obviously faulty from day 1........can anyone offer me some advice please?
  18. Hi, I have recently obtained my credit file from experian and there was a default on it from a company called aktiv kapital. I contacted them and they told me that they have bought a debt for £177 from a extended warranty I had with scottish power in 2001 from a previous address. I thought when I cancelled the warranty it ended but apparently I had a signed a contract that states I had to pay it all. I aked them to send me a copy of the agreement along with a copy of the default notice (which I`ve never recieved because it went to my old address) and they said they dont have them because scottish power defaulted me, not them. He then said I can settle the debt for £105 but they will not remove the default even if I pay. I have since emailed them and have just received this reply: -------------------------------------------------- We acknowledge receipt of your request for information under the Consumer Credit Act 1974, however, we are not the original creditor nor did we provide you with the original credit facility. We purchased your outstanding debt balance and right to collect that balance, together with the right to apply interest in accordance with your original Credit Agreement (where appropriate). We did not purchase your actual Agreement, consequently we have no obligation to provide you with a copy of that Agreement. However, as a matter of good practice, we will seek to obtain a copy of the original Agreement from the original creditor and if it is available we will forward a copy to you as soon as possible. In order for us to comply with your request, please forward to us payment of the statutory £1.00 fee. Please note that Aktiv Kapital did not place the default notice on your credit file. The default is changed into our company name upon assignment of the account. The default was placed on your credit file on the 7th March 2002, Aktiv Kapital was assigned your account on the 23rd August 2004. We do not hold a copy of the default notice, a copy would have been issued to your address for your records. Can anyone offer me any futher advice on what I should do next please?
