I don't have any insurance on the personal loan but I do have gap insurance on the car loan, the gap insurance worked out at like an extra £3 a month on payments which isn't bad for the cover you get IMO. I just have a really crap interest rate, 40% or something like that. The car loan is a hire purchase agreement. I don't want to refinance with them, I definitely don't want more money off them I just want to try and lower my monthly payments by £50 or so.
  2. I can't see a customer signature on that credit agreement? Surely that means it is null and void? Quick question, say you successfully challenge a credit agreement and it is shown to be incorrect, do you have to give the car back OR do you keep it?
  3. We've been with welcome for a couple of years now. They've been mostly OK, we pay on time so we never really hear from them. The rates are rubbish but then we knew that when we signed up but we were desperate and we just rushed to get the money/car. We are currently paying £195 a month over 5yrs for the car loan and £75 a month for an unsecured loan of £1100 over 3 years. As it stands it is becoming more of a problem every month to meet the payments. Has anybody here ever successfully negotiated paying them a lower rate every month? We've not asked them yet, we are a bit concerned we'd lose the car which we really need ATM/
  4. Hi, Due to an ongoing issue I need to have a declaration witnessed by a Commissioner for Oaths, I understand this to be a Solicitor and that the charge is £5.00? Do I just ring round a few Solicitors and ask them to witness my oath? Can I get it done at a court? TY:p

  6. It seems they are sending an awful lot of them out. It may be a scare tactic but it's a pretty low tactic even for a DCA. Has anybody here here ever been bankrupted by them?
  7. Hi, Today I received a statutory demand for Bankruptcy from a DCA (Capquest) in relation to a debt owed from Halifax. Now I dispute the amount of the debt owed (the debt is for £3000 which relates to an unauthorised overdraft and fees), I've already sent off a CCA and SAR request prior to this stat demand which was ignored, I believe this is grounds for setting aside the stat demand. I believe the stat demand to be simply a scare tactic however I don't want to take the risk so I'm looking to protect myself. Now, with that in mind could anybody talk me through the process of setting aside this demand? I've looked through a few threads here but I'm still not clear how to fill in the court forms and when/how to present them. Here is what I'm confused with: I'm aware that I need to fill out forms 6.4 and 6.5 from here; Forms My questions are in bold and relate to the forms - Form 6.4 (a) Name & address of person to attend hearing --> Is this me? Attend before registrar as follows (Date, time, Place) --> What do I put here? The court details? (d) State the names and address's of the persons to be served --> What do I put here? (e) State the applicants address for service --> Is this my address? It says "Signed (Solicitor for the) Applicant" --> Do I need it signed by a solicitor? Form 6.5 Sworn at --> What do I put here? Now, do I need to make a photocopy of the stat demand sent to me and present it along with the above forms at the court? Do I need to mark it up as anything? It says in form 6.5 to mark it up as "A"? What grounds am I disputing the debt on? I know my reasons but is there some kind of legal definition for it? Also, do I just walk in to the court? Don't I need to make an appointment and do I need a solicitor? I can't afford a solicitor. What happens after I've set the stat demand aside? Can they try again? Thanks for reading and I'd welcome ANY help (or can point me to any guide which answers my questions), I'm really confused about all this and I'm trying my best not to get stressed out!
  8. Hi, I was wondering if anybody can help me with this: I was paid my wages directly in to my bank account on Friday. I noticed my wages were very light especially as I was expecting a Xmas bonus. I thought I'd been underpaid but upon contacting HR in work I was informed that I had an attachment of earnings placed on my wages by Warrington Borough Council for just over £1000 for a 3yr old Council Tax bill I was liable for (although can part dispute). I was a little confused over the amounts and the HR rep in work told me there were too orders - One for £300 and one for £700. I was told the money would be taken at 12% each month until the amount was cleared. What I wasn't told was that BOTH order would be taken at the same time!! I recieved my payslip in the post today and it broke down like this: _____________________________ Payments; Basic Salary: £1212.92 Bonus: £289.89 Total payments: £1502.81 Deductions; Income Tax: £199.80 NI: : £115.48 Court Order C4: £142.50 Court Order: £125.40 Admin Charge: £2.00 Total Deductions: £585.16 Net Pay: £917.63 _____________________________ OK, now as you can see they have taken out one order at 12% (£142) and then hit me again on with the next order at 12% of what I had left (£125) - Is that legal?? I thought it was law that only one order could be taken at one time and that only a set percentage of a persons wage could be taken in one go? As it stands I'm looking at total deductions through court orders of 22% of my net wage. It's going to cripple us, we are struggling as it is, losing 12% of my wage is devastating but 22% is too much. I can't afford it. I don't know how I'll cover it. So if like I think taking two court ordered attachments at once is not allowed then who is to blame? Is it that my HR department don't know the law or is it the Council telling my employees to take both at the same time? Can anybody link me to any info on this that I can show my HR department? Thank you so much for any help. This isn't how I imagined Christmas starting:(
  9. Hi, I'm looking to get on the housing ladder. I've spotted a few properties in the price range of what I'm willing to pay and I have a 25% deposit so the mortgage I need is not huge. The problem is myself and my husband both have a poor (well bad actually) credit history. We've both had a good few defaults and built up arrears when times were harder. I believe however that our credit rating has improved, I have car finance which I got easily and have never had a late payment on and my Husband was given a 2.5K overdraft by Natwest last month - so we are at least worthy of some kind of credit but enough for a mortgage? Will having a substantial deposit help getting a mortgage easier? There are lot's of companies on google claiming to broker bad credit mortgages - are there any reputable ones? Are these companies any good? Any help will be most helpful!! Thanks!
  10. I've been waiting a week for it, the scheduled delivery was for yesterday - I've just been on the phone to littlewoods and they have told me the item I ordered has been lost I've now got to re order it and wait another week and then go through all this again.

Well the item was due to be delivered today and it never turned up, I phoned Littlewoods and they said they can't say when it will be delivered and refused to give me the courier details so I could chase myself. I phoned the HDNL couriers they use but they wouldn't deal with me because I don't have a tracking number because Littlewoods wont give me one:cry: I could so easily just ring the courier and arrange to pick the item up from the depot myself but for some unknown reason Littlewoods wont let me do that. It's ludicrous to treat customers like this:-o
  12. Right - thanks guys I'll look in to contacting the Customer Services again and see what happens. I didn't think they would be using these personal couriers but it makes sense. I don't really like the idea though. Thanks again.
  13. Hi! I'll be quick with this as it isn't a huge issue. I'd like to know which Courier Service Littlewoods Direct Online use when dispatching their orders. You see I live in an apartment block with electric gates so couriers usually can't get passed the electric gates to leave me a missed delivery card so what I usually do is call the couriers and arrange for me to pick it up at the depot. However upon emailing Littlewoods to get tracking details etc I got this odd reply: ________________________________________________________________ Thank you for your e-mail regarding the delivery of your order. Unfortunately we are unable to provide you with the carriers details for security reasons as the carriers do not want their details given out. If the carriers are unable to deliver they will contact you. We look forward to hearing from you soon. Kind Regards Customer Support Littlewoods ________________________________________________________________ I find that hard to believe! Does anybody know which courier service they use from past experience so I can sort this myself? Thank you!!
  14. Well the TV I ordered was delivered today and the bank also rang me. The bank (Natwest) told me that it appears Goodmans have lost the transaction details which is why they never claimed the money despite authorisation being given, this is why the bank re-credited the money back to my account. I asked the bank if they could do anything and the lady from customer care basically said there was nothing they could do or indeed would do as it was Goodmans mistake and it is up to them to liaise with me and rectify the problem. So I phoned Goodmans and got through to the Indian call centre again - I tried to explain to the customer services agent but she kept on saying there was no problem, payment had been made, accepted and the goods dispatched. She told me it must be a problem with my bank. Neither the bank nor the retailer wants to know despite my best efforts. I guess I'll just keep the money available in my account for a month ready for them if they wrte or something other than that I don't know....

  16. If I were you I'd put up a fence and reclaim the land being used as a communal bin area. It wont help with getting your money back but it will stop it happening again.
  17. The problem is what if you pay on the day but then after that they also reclaim the payment on your account (due to the confusion, not on purpose)?

Come to think of it this may have happened to me before, sometimes I've noticed that there was ten or twenty pound more in my account than there should of been but upon inspecting my statement it balanced up which it would do if all record of the transaction had gone but I was sure I had less money than that but I put it down to being forgetful and the fact my account is quite busy - now I think it could be down to this.....:-?
  19. Yeah - that is exactly what has happened to me! I'm now in limbo! Say if the TV does turn up what do I do? Try and pay Goodmans again but then I have this threat of an authorised payment hanging over my account so I have no idea! I'm sorry to hear I'm not the only one this has happened to (although glad to see it isn't just an unheard of problem!)
  20. Hi, I would like some help with this as I'm a little confused. On Monday I bought an LCD TV from Goodmans Direct, they were having a one day only reduction on this TV, a saving of £100 so I bought it and scheduled delivery for tomorrow. I paid by Natwest Solo debit card. The money appeared to be debited from my account immediately I checked via online banking shortly after I paid. However when I checked my online statement today the transaction had vanished, no trace of it whatsoever and my account had an extra £199.99 in it (the exact cost of the TV) I tried to track my order via the couriers who Goodmans said they were sending it with using the details Goodmans provided - I spoke to the couriers (Amtrack) and they could find no trace of it so I phoned Goodmans and after 15minutes on hold I got through to a foreign lady on a bad line who had no idea what I was talking about which was frustrating. All she could tell me was that my I had requested my order to come tomorrow and nothing else really. She had no idea and we could barely understand each other. So I phoned Natwest and got through to a customer services agent, he could find no record of the transaction either but after looking into it he said it sounded like this has happened: I make payment via Solo. The retailer contacts the bank to ensure their is sufficent funds to make the transaction. The bank confirm there is sufficient funds an authorise payment whilst placing a hold on the specific amount in my account. The retailer then has a set period to claim authorised held funds from my account. In my case it looks like the retailer failed to take the funds so the held money was recredited to my account. So following on from that and given it looks like I'm not receiving any delivery tomorrow or in the near future (according to Amtrack) I'm worried about the money in my account - the bank customer services guy said he was unsure whether they could still take the money out of my account given they had failed to do it within the deadline, I asked if I could transfer it to another account of mine to keep it safe but he said with the transaction already being authorised if they did take it I would go overdrawn - he couldn't give me a direct answer and could only pass it on to their customer relations team who will take 48hrs to get back to me which by then I could be left with no money and no TV! So my question is - if the retailer has failed to take the money in time do they have any right to take it in the future? Is my money safe? Has this happened to anybody else? I'd move the money right away but I really can't afford to go overdrawn, not with the sort of money Natwest charges:( Can anybody help? Thanks guys! Heidi
  21. Yup - but if they do realise it then just hand it back. TBH I bet if you phoned the store right now they probably wouldn't be interested in you telling them the mistake.
  22. Exactly - you would have a murderous time trying to get your money back and they certainly wouldn't go out of their way to help you or alert you so why should you? When they do a stock check the mistake will be realised and they can contact you - until then do nothing, just don't use it.
  23. Hi, I just thought I'd ask this question here as I've not really been able to find out anywhere else, it concerns my sister and her 3yr old son. Basically when he was born there were major complications which led to his brain being starved of oxygen for a prolonged period. He has been diagnosed with brain damage and it was explained to my sister in layman terms which she relayed to me, that the part of his brain which deals with speech was very badly damaged in during the birth meaning that even at his age his speech is very limited to just a few basic words and noises and he suffers from what I can only describe as a very nervous disposition and really doesn't like interacting with people he doesn't know. His cognitive abilities are perfect, he's been tested and they are above average, he can draw and has learned bits of sign language as a substitute for what he can't say. He is seeing a speech therapist but to my mind there has been little improvement although the therapist seems to think the damage is reversible. My question is - my sister seems to be getting little or no support and really doesn't know where or what to ask, she seems to be coping OK but she did say she would like to find out if she is entitled to any additional support that what she is already receiving in terms of the speech therapist so I thought I'd ask here? Any help would be very well recieved:)
