The particulars of claim are: Monies due under regulated Credit Agreement number xxxxxxxxxxxxxxxxxxx Between Capital One and the Defendant the benefit of which was assigned to the claimant on xx/12/12 The Agreement terminated upon the Defendant(s) failure to comply with the terms of the agreement.   2. Hello All. I would be grateful for any help here. Capquest Investments CCJ claim form; My original debt was with a Capital One credit card. The account was opened in 2002 and run without any problems until Jan 2012 when due to a long illness I was unable to maintain the payments. I made an arrangement to pay Cap 1 £20 monthly and continued this until Dec 2012. In Jan 2013 I received letter from Capquest saying they had bought the debt and I was to now pay them. I did not receive any communication from Cap1 confirming this so until I did I stopped paying the £20 monthly. Between March and May 2013 I received two standard "threat'o'grams" from Capquest which I ignored. On 20th June 2013 I received from Capquest a " letter of claim under the practice direction - pre action conduct" allowing me 14 days to contact their "experienced team of negotiators" to discuss repayment or a CCJ claim would be issued. at this point I was going to send a prove it letter or CCA request.but sadly did not get around to it. Yesterday a CCJ claim for arrives from Northampton with me named as defendant and Capquest Investments ltd as claimants (for a sum less than £5.000). Can I defend this bearing in mind I have not received from Capquest or Capital One; Any default notice. No proof of ownership from Capquest or Cap1 in the form of a (deed ?) of assignment. No proof of any contract between myself and Capquest. No termination of agreement notice. No CCA, but I didnt ask for one and send £1 - is it too late to do this now ? Should I have received any of the above prior to a CCJ claim being issued and is there anything I should have received not included above ? If I am to defend this what should I write as my defence on the CCJ claim form ? Should I write to Capquest telling them my reasons for defending this claim ? and should I send them a CCA request ? and ask them for proof of debt ownership ? is there anything else I should be doing ? I am in the process of arranging through Stepchange a DMP to pay reduced amounts to my other creditors and I wouldnt have a problem paying Cap 1 as they are the original lender, but not Capquest. Would it be possible that Capquest do not have all the documentation for a successful claim and are hoping that I dont defend this so they can obtain judgement in their favour by default ?   3. I have just looked up one of these online tobacco companies websites FAQ's quote; Q; Are the products taxed ? A; All our boxes of tobacco display an EU country government seal which guarantees that the contents are genuine and that all taxes and duties have been paid to an EU government authority. Q; Is it legal ? A; Absolutely! since all our products are EU taxed you and every EU citizen may freely buy our products without having to pay any extra taxes or duties in the country of residence,if you reside in a country that is a member of the EU you have a great advantage ! one of the major reasons for the very formation of the EU is the free movement of goods between member countries. (That is until good old British customs and excise come along that is !!) So who is correct here ? anyone know?

Assuming that the customs charge is correct, this seems a very expensive way to buy tobacco; you buy 5x50g pouches of golden virginia costing about £30 online,add to that the shipping charges plus this extortionate customs charge it seems that you are paying about £15 per 50g pouch when it costs just over £11 per 50g pouch in my local Tesco!!
  5. I feel that I should mention that I got the parts for my vacuum cleaner from Vacuum cleaner spares Uk . The parts were delivered to my address within 24 hours of ordering, they only charged me the true cost for P&P ,the parts were the correct parts for my machine and if they had not been correct I could have returned them free of charge. Now thats what I call proper service ! I only wish I had found them earlier. Syd
  6. VICTORY !!!!!!!! I have just checked my credit card account online and £9.96 was credited to my account on Friday afternoon ! It seems that they have seen the light and have refunded the P&P costs shortly after I rang them, despite telling me that it was my fault and that the costs were to remain, I wonder if I will get an appology from them ?? I would like to think that because I mentioned CAG quite a few times during the phone call and also the fact that I was not going to give up -no matter the cost, this may have had some bearing on the outcome.   7. I rang Partmaster yesterday and tried to sort this out over the telephone and to get some feedback from them. They are adamant that it was I that made the mistake (I didnt) and that the charges for sending and returning the items remained. After reading the DSR kindly posted by Michael Browne I am of the opinion that even if I had ordered the wrong goods I would still be able to return them free of charge and exchange them for the correct goods ? As Partmaster were unable to supply the correct items as they were no longer available is it they who have breached the contract ? and I should therefore be entitled to a full refund including postage and handling charges? I am in the middle of drafting a letter to their head office and I need to get certain facts correct before I send it. Any comments as always well appreciated Syd

I have decided that I am going to fight these extortionate and unfair charges, I dont care if it will cost me much more than a tenner just to get my tenner back ! As I said before its the principle of this that really gets to me, I am not going to let Partmaster get away with this. I will draft a letter to them today and let you know how I get on. Hi all, I ordered some parts online for my vacuum cleaner from Currys Partmaster,The cost of these parts was £18.79 plus a very extortionate charge for postage and packaging of £4.98 ( the actual postage cost to Partmaster for sending the goods to me was only £1.14 plus the cost of a small jiffy bag- 20p ??), When I received the package (2 weeks later!!) I opened it and could immediately see that what they had sent me was nothing like what I had ordered. I rang Partmaster customer services and was told to return the items to them for a refund as the parts I had wanted were no longer available. I checked my credit card account today and was horrified to find that only £13.81 had been refunded to my account,I was expecting £23.77, It seems that Partmaster have charged me £4.98 for sending me the wrong items and are charging me another £4.98 to return the items to them!! I also received a letter from Partmaster today explaining their returns policy and it implies that I am at fault, the letter is headed ;Incorrectly Ordered Goods:, and part of it goes on to say :when returning an unwanted item the cost of the return carriage will be deducted from your refund: (this was not expained to me over the telephone), I didnt incorrectly order the goods -they sent me the wrong goods and are expecting me to pay for their mistake!!?? If this was the case then anyone could set up a mail order business and make a handsome profit on the postage charges alone by deliberately sending the wrong items then charging customers to return them! I know its only just under a tenner but its the principle of this that really gets to me,they shouldnt be allowed to get away with this daylight robbery,none of the other mail order/catalogue companies that i have dealt with have this high charging returns policy-its usually free. Any ideas on this one ? or should I let it go and put it down to experience? I will never deal with Partmaster again or any other company that charges in this manner. Ellie May Would it be possible for your mum to "give" away her money to a trusted family member (yourself for example ?) then you or whoever "give" it back when your step dad is able to go back to work ? £16000 is hardly a lot of money to get by on these days and it really annoys me that benefits are refused to people who have been prudent enough to save for their future. In my opinion if you have too much money to be entitled to any benefits that you have been paying N I contributions towards then you should be exempted from paying that percentage of your N I contribution that goes towards those benefits
  11. Likewise, at my childrens schools crisps,sweets and fizzy drinks etc are banned and healthy eating is encouraged by the teachers. But I believe that it is driving the problem "underground" . Children are often more rescourceful than teachers and parents give them credit for: At my younger daughters primary school there is an active "black market" in crisps and sweets and some of the children are secretly eating more junk food as a result of the ban than they would if small amounts of "treats" were allowed to be included in their packed lunch. At my elder daughters secondary school the children are allowed out at lunchtime so they visit the numerous confectionary shops, fish & chip shops and bakeries along the High Street, very few children seem to want to use the school canteen which serves the healthy option. It appears that a lot of children do not like being dictated to by parents and teachers alike about what is good and not good for them ( I know I didnt when I was at school ! ). Educating them in healthy eating is fine, but outrightly banning unhealthy foods I feel will make our kids more determined to eat them !
  12. Hi all, I recently bid for and purchased a cycle speedometer for a 1970's bicycle that I am restoring. The item was described as "new old stock" and the listing says "the item is boxed,includes drive gear and instructions for fitment" and incuded a photograph of the boxed item. When the item arrived on the 14th August it was missing the transmission cable from speedo to wheel thus making it totally useless. Through e-bay I contacted the seller who said he would look for it. I contacted him again a couple of days later asking him if he had had any luck finding it ,he said no. I contacted him a third time yesterday saying that I would give him until next thursday to find it (a very generous 2 weeks from me receiving it) or I would be returning the item to him for a full refund,he has responded with a rude e-mail saying that as the transmission cable was not mentioned in the listing (see above) then he is under no obligation to send it and therefore according to e-bay rules I cannot get a refund, surely this is not correct? I believe that he should have mentioned that the cable was missing on his listing. Who is in the right here? and do any of you think that I can get a refund? Many thanks in advance SYD
  13. This I would gladly do,but everytime I press 9 to be connected nothing happens,and as the number is withheld I cannot ring them back to scream at them and get me off their database. Does anybody know who this company is offering these holidays? or has anyone actually spoken to one of their consultants?

  15. I get a call like this usually about once a month and every time I either press button 9 or let it ring to find out who it is nothing seems to happen.As a night shift worker I find these calls bloody annoying to say the least. Are you sure that nothing can be done about this nuisance??
