  5. We are awaiting a court date for our claim against Barclaycard and have received a 'General Form of Judgement or Order' from our County Court. It says: "Before District Judge xxx sitting at xxx County Court. Upon reading the court file it is ordered that 1. The Claimant must by 4pm xxx October 2006 identify the dates and amounts of its charges challeged. 2. The parties are to consider whether this claim should be stayed pending a decision and decisions in other similar cases". With regards to the 1st request, we have already supplied both Barclaycard and the County Court (with the Allocation Questionnaire) with details of the charges claimed but will send it again! However, the 2nd request confuses me. I know a lot of the judges have been ordering that cases be stayed, but our judge says "consider whether this claim shoud be stayed". Excuse me being thick but does that mean he has left it up to us, and we could write back saying we have considered staying the claim but dont wish to, give us a court date please?? A word of advice from a moderator would be gratefully received - don't want to stuff it up when we are so near! Thanks, Lolly
  6. We did our Natwest Credit Card and Bank account claims separately after advice from this forum. They are separate contracts with different terms and conditions. Lolly
  7. Well, we gave NatWest 7 days to pay up after they did not file a defence to our claim for charges to Credit Cards. The 7 days has more than passed with no word so tomorrow we will be asking for the judgment to be enforced. Exciting stuff On another note, we have a separate claim for our bank account and today we received a copy of their allocation questionnaire from Cobbetts. No offers made whatsover, which is slightly worrying because a lot of people get offered half at this stage. Fingers crossed it wont be long now! Either that or we will see them in court. Lolly
  8. Hello all Natwest failed to respond to our credit card claim within 28 days and today we received a notice of judgment from Northampton County Court. What is the next step in order to enforce the judgment? I have looked in the FAQ's but cant find an answer to this one. Do the courts inform Natwest that they have lost and need to pay? Or do we do that and then send in baliffs ourselves if they dont pay? Comments gratefully received! Lolly
  9. Hi Sm03art. A defence just means that the bank has confirmed that they are going to defend the claim in court and gives the reasons why they are defending it. In nearly every case the banks have paid up before the court date is reached, but putting in a defence gives them more time and draws things out even more, probably also scaring off a lot of people from taking it any further. CPR 18 is a request for information, but if a case goes down the small claims court route they are not actually allowed to ask for a CPR 18 from you and it can be ignored - it is just another scare tactic. The CPR 18 request I received is long and complicated with loads of legal jargon, and I can imagine a lot of people get put off when it arrives. It doesnt mean they have won whatsoever.   10. Hi, We recieved a defence from Cobbetts today as well, also expecting a response by 9th August. Ours also received on last possible day. Ours is for a very similar amount too - be interesting to compare the progress of each. I will keep an eye on your thread! Going to supply them with a list of the charges, which wev'e given NatWest already (these people obviously can't read). Decided to politely refuse the CPR18 request as they cant ask us to do that when its going to the small claims court. However, if youre brave you could send a CPR 18 request of your own and really annoy them, you can find one here: http://www.consumeractiongroup.co.uk/forum/general/15172-reply-stock-defence-18-a.html Theres no mention of CPR 16 on ours though. I would think its just another stalling tactic, after all they cant argue the usual - "you havent supplied us with the charges" line because you did that in the particulars of claim.   14. That book sounds really interesting, I will keep an eye out for it. Im not English, and I reckon its do with the "musnt grumble" thing, people here generally seem very placid and happy to settle for things rather than get on their soapbox or risk causing stress.... (well, my English husband does that anyway!) Am being very generalising here, my apologies if it offends anyone. Obviously most people on this forum arent like that or they wouldnt be here! I am the other end of the spectrum which isnt always a great way to be either Cheers Lolly
  15. Yeah youre probably right about it being a damage limitation tactic. And about people thinking that the offer is a good one, from a few posts Ive seen on here theres a chunk of people who have misunderstood the OFT thing and think charging £12 is ok because the OFT says so ..... It does seem to be that a lot of people are just pleased to get any sort of refund or are put off at the court stage, despite the fantastic results seen in your survey. Funny how as consumers we think, "ooh we should be grateful for what we can get", where does that mentality stem from? Maybe its because we are all so used to being walked on (rip off Britain!). To have the roles reversed for once is such a unfamiliar, unexpected situation that we dont know quite how to deal with it?
  16. Hi Bookworm, I see where youre coming from but dont quite agree Im afraid. Barclaycard did offer us a refund of the difference but we didnt accept their offer. If the OFT had suggested a figure which more accurately represents the banks' costs (say £2-£3, for example) we would have been offered a more realistic refund, would have accepted it and wouldnt have had to go through the court system at all.... so need to worry about a judge thinking were greedy because there would be no need to go to court! And as for trying to recoup lost charges by raising the interest rate .....cant wait til we have paid off our cards and can tell them to naf off
  17. Just had a letter from Barclaycard officially saying they are reducing all their charges to £12. Letter also says they are increasing cash interest rate to 27.9% pa. If only the blinkin OFT has suggested a lower rate, £12 is still extortionate. Would have made life a whole lot easier for all of us! Lolly
  18. Excuse me being thick, but do you mean they have said they will settle in full? We were offered partial payment after our prelim, which we said no to and then sent the LBA. Just got another reply saying sod off and ours is only for £265....
  19. Can I just say that Natwest Credit Cards are absolutely crap. They have had both our prelim letter and our LBA and we have heard nothing from them. They have til the 14th to response to our LBA, then it will be moneyclaim. Its only £92, you would think they would just pay it! Our business with them earns them more than that (although not for much longer....)
  20. Thanks for all the replies everyone. They were all really helpful - especially the letter. I spoke to Tesco again today, they have now found our missing file and said dont worry, we are working on it, we just have a backlog. Actually got someone understanding for once! The guy I spoke to advised me not to deal with the other party personally but just let them deal with it. Apparently Tesco's solicitor will contact us soon (but they wouldnt give us a time frame!) So I'll give Tesco one last chance to get their act together before we take it to court ourselves. And you were right, Tesco said they would be taking the other driver to court, not the other parties insurer. I dont quite understand why you sue the driver when its the other insurer that wont pay out - but its obviously correct since you said it too!! Will keep you updated
  21. Hopefully someone can give us guidance on this, youre all so great with the bank charges! My husband was involved in an acccident bank in November - a taxi did a u turn in his pathway without checking it was safe to do so and he couldnt avoid hitting him (no witnesses though, Im afraid). Basically its 7 months on and the other party's insurers are still refusing to admit liability. It is now going through the small claims court. We have seen the taxi driving around and the car isnt fixed so the other party obviously arent claiming for it. Our car was written off. We have had to pay out 700 pounds in total (excess, hire car and increase in our premium at renewal as we lost our NCD). This all went on credit cards and we desperately need it back! Only problem is, our insurer (Tesco) are being absolutely crap. They seem totally disorganised and I get a different story each time I call. It has taken them 2 months just to get the forms to us agreeing that we are happy to go to court. When I last called our file had been 'lost'! They seem completely incompetent. We will definitely change insurer next renewal Its getting to the point where I dont trust Tesco at all any more, I dont think they are pushing the other party enough and want to do something myself to sort this out. I want to write to the other party threatening legal action, and if Tescos doesnt get their act together sharpiy, take them to the Small Claims Court ourselves. However, Im not sure who we should be taking to court - the other party's insurer, the taxi company (who own the car and in who's name the policy is), or the other driver?? Any advice or encouragement would be much appreciated. Im just so tired of money worries, there are too many other problems in life than to deal with, you dont need (edit) like this too!   23. All that effort for £170??!! You think the solicitors fees would be more than that. That response makes little sense to me, which I guess was the desired affect! Seems to me that theyre trying to bamboozle you with legal jargon, a scare tactic. I'm sure someone on this forum with legal expertise will be able to help you. Best of luck
  24. Hi, We are holding fire on sending off our letters to Natwest whilst we open a parachute account. However, we also have a £17K loan with them and are concerned they could demand repayment of that if they decide to get their knickers in a twist about our claim. Is that legal and has that happened to anyone else on the forum? If this is a possibility we will apply for a new loan elsewhere. We have tried once already but got turned down and dont want loads of searches on our credit reports, but if its a necessity we'll just have to do it!! Any thoughts welcome. Lolly
  25. Hi Woodpop Dont be disheartened, we received a cheque from Amex for our total (just over £300) within a week of sending our prelim letter. It was so hassle free, we were completely flabbergasted! Within 2 days of sending our prelim letter we received a standard complaint response letter, saying 'we will get back to you' etc but the next day received a letter offering us full payment. Then a couple of days later the cheque arrived. Incredible! I was impressed, they certainly are efficient! So definitely move onto the next step!
