  1. Thanks for all the advice. I dont remember having ever recieved letters from HSBC about a debt. I know it will have been at the very minimum 4 years since I last heard anything from them because I moved 4 years ago and this is the first letter regarding debt I have had at this address. The debt will be from 2006/7 I am not sure which but I really dont remember having ever recieved a letter about this debt so it could very well be more than 6 years. How do I go about proving this?

I recieved two letters a few days ago from 1st Credit asking if I lived at the address, I ignored them thinking it was some kind of [problem] (I mean either they know I live here or not). today I get two letters from HSBC (who I had a joint account with my ex-wife about 7 years ago) and they have said they have passed on two debts I owe them to 1st Credit! One if for £600 the other is over £2000! Do I contact 1st Credit and confirm I live here and ask for the details of the debts or contact HSBC?
  3. I should of been given my JSA on Thursday (28/04/11) but when I checked my account it wasn't there. I wait till 9 to phone the benefit line and was told there was no reason why it should not of been paid as my evidence had been put through on the 21st (oweing the to bank holidays), she said she'd get hold the of the payment office and get them to issue the money. To cut a long story short I waited till 12 like she said and heard nothing and so then called every hour for the next 4 hours each time being told the same, someone from the payment centre would phone me. Eventually at 4 someone phoned me saying my payment was ready but I would need to collect the giro! I said I didn't have the money to get the bus and it was nearly a 2 hour walk (plus you need to ID's to collect a giro, all I have is a passport), he said "tough, if you need to money you'll have to come get it". I said I couldn't could he not fast pay it into my account, as I had 2 small childern to feed. "No, I'll put it in the bank it'll take 3 working days, bye" and then he put the phone down on me... I tried ringing the benefit line back but no answer and I couldn't get through to the Job Centre at all... I've been claiming JSA (joint claim with partner) for a couple of years now and this isn't the first time I haven't beenpaid JSA on the right date but they've always corrected what is their mistake with a fast pay. Because of the bank holidays I wont see the money till thrusday (assuming he's put it through this time). I'm struggling with DD coming out and buying food, is there anything I can do apart from scream?
  4. Thanks for all the advice so far but was wondering about him returning in 7 days to force entry. I am deaf and have a small child (under 1 year) no amount of knocking is going to get my attention, am I even going to hear him getting in? Read on one thread that they have to tell you a time & date that they will force entry and another saying they cant force entry till they return to the magistrate and prove they are being ignored, is this true?
  5. Long and short of it is that we didn't have a TV licence got caught and now have a fine of £475. Have had a letter through the door from Marston bailiff telling me he is going to return in 7 days and use a locksmith to force entry. I know they are allowed to do this as it's a magistrate fine my question is can they do this at any time day or night? Surley they have to do it at a reasonable time of day? Also I read somewhere that Marstons can accept payment spread over 180 days, but when my partner rang them up to ask about this we were told it had gone to far and they would only accept the full amount, I assume they dont have to accept my payment over 180 days if they dont want too???
  6. I have been claiming JSA for the last two years. I've just come of New Deal (giant waste of time that it was) about 4 weeks ago and have moved back onto JSA. My partner has been claiming for about a year. A job has come up in Wales (we live in London) and my partner needs to get there for a job interview. We read that you can get some of the costs to get there and because it's too far to get there and back in a day overnight costs. She has gone to the Job Centre today to ask about it and has been told they can't help her, basicly because I've come of New Deal I am a new claimer and therefore not entitled to any help such as travel costs because I have to have been claiming JSA for 24 weeks!!! The only reason I haven't been claiming for 24 weeks is because they moved me onto New Deal Is this correct or am I entitled to some kind of help with getting my partner to her interview.
  7. I received this morning (sometime before 6:30am so they get up early round here) a hand delivered letter from Equita informing me of a "Bailiff Removal". It is to do with an unpaid parking ticket with Northampton Council. I was under the impression that I was still disputing this fine with Northampton Council, but it would seem they are :-| The letter says that unless I contact them within 24 hours regarding this notice they will take further action including Removal of good and impounding my car. Problem is, they have only suppiled an phone number and as I am deaf this means I can't actually phone them ... I was wondering if emailing Equita themselves and telling them this would make the bailif back off till I can sort it out with the Council? Also I am assuming they can't force entry to my property for this debt can they? They can impound my car if they can find it as it was crushed about 4 months ago

I thought that was maybe what they had done as on the first two "Notice Of Distress" they put through my door, in the "inventory of Goods Seized and distrained" they have put my neighbors car registration. But the last notice I received didn't list the car and was blank and so I assumed they had realised it wasn't my car. Can I use this against them surely if they are going to charge me for the levy they have to do it everytime?
  9. I think are trying to charge me a "Attending to Remove" fee, but I am under the impression that they have to have actually gain entry to the property before they can do this. Am I able to file a form 4 if I don't have the information regarding the bailiff who is attending my property?
  10. just looked at everything and I am now totally confused. Adding the charges together makes £175.50 which is what they charged me on there first visit (even though in there breakdown they have charged me for 2 visits). They have since visited again and upped it to £308.50 in charges. So Newlyn have told me in writing I owe 343.28 and yet the bailiff is wanting 476.28, if they cant even get what I owe right no wonder i am complaining...
  11. I asked Newlyn to break down the charges for me as they have now upped them to £343... They have never entered my property and have never taken anything but they say they can charge for attendance and services rendered... there breakdown: £167 - Debt £24.50 - Visit Fee 1 £18.00 - Visit Fee 2 £28 - Levy Fees £105 - Enforcement Fee Are these correct how can the levy agaisnt nothing? They are also refusing to provide me with any information regarding the bailiff who attended my property as they believe I am looking to fail a form 4 against hi personally, and they believe this to be "vexatious"...

Been looking at the notice of distress properly and noticed it says: Inventory of goods seized and distrained to which the above notice refers: and then lists a car that is owned by someone across the road. Do I need to worry about this? I was reading that ""levied" upon a vehicle either on your driveway or on the road outside." - the car is parked on a main road, our house is the fourth house down a pedestraten cul de sac it would be a wild stab in the dark to even consider if to be our car. The other thing is the notice of distresshasn't exactly got my partners name right, it's add an "s" on to her last name. What worries me is that if they can't even get her name right what else is going wrong???
  13. postggj newlyn are saying that we cannot pay the council direct as it has been passed on to them. They are charged us 167.78 for the council tax (8.50 debt and then various fines for not paying) 175.50 bailiff charge
