  3. Hi PT, Thanks for that, I want to get the council and ROBBINROSSERS as in my earlier posts. I don`t understand what a Regulation 46 is and I have family problems so cannot find the time at present to get my head round this. Normally I would spend as much time as poss and attack them!!! Any help and advice is greatly appreciated. Many thanks LL
  4. Hi JJ, not me on PM`s with you. They have added to all three accounts!! not my area of expertise, any help is greatly appreciated. I want to take Rossendales and the council as far as I can. How in this day and age can companies get away with this sort of behaviour!! LL
  5. I have what the 1st bailiff put through the door and he has added 1st, 2nd and levy fees to all the accounts for the levy on the cars we do not own. rossendales have also sent letters after my request they all say the same as the bailiffs. LL
  6. 4th April HPI check £10.00 they cant charge this fee They have not charged me their bill was saying £440.08 but we paid £430.08 and the bill is saying balance £00.00 when the police arrived were the 4 bailiffs still there Yes my partner was paying the bailiff the money. They had clamped the car and would not release the clamp until he paid. they had no levy on the car. Also the police have on record me saying 4 bailiffs were present. I have left the officer a message to call me but he is not in work until next week. have you made a formal complaint to the CEO of your council No not yet that is my next plan, just don1t know where to start!!! I have received a letter from them this morning demanding the whole amount on the next order, the bailiff said we could pay £150.00 a month but are denying that now. LL
  7. Two more things in their reply email. "With regards to the vehicles on the Notice of Distress, we require a copy of the V5 registration document, a valid insurance certificate and a copy of the purchase receipt to prove third party ownership. The vehicles will remain subject to the levy until we receive these documents." " The Notice of Distress is dated and does not have to have to contain a time." "The Notice of Distress we hold is that completed by Mr **********, which you confirm you hold a copy of. This has only been signed by the bailiff and I apologise for any confusion caused by my earlier statement regarding this". LL
  8. Hi HW, Will have to dig the rest of the paperwork out. But on the 20th APRIL my partner paid them £408.00 they did leave a receipt but I can`t find it!!!. I complained to them and they sent me a letter stating this one account is closed and paid. Summary for 7th March Debt £235.58 15th March Visit fee 1 £24.50 23rd March visit fee 2 £18.00 25th March levy fee £32.00 4th April HPI check £10.00 26th April Attendance /Van £110.00 Payments: Receipt Receipt Date Amount issued number Status April 27th £440.08 NO Cancelled May 6th £403.08 NO Waiting They have also lied through their teeth where they are saying only 2 bailiffs attended, I have it on email. "The bailiff has advised that there was a passer by stood at the top of the garden near your gate, but this person was not with the bailiffs" The top of my garden is private not near the road and I do not and never had a gate on my property!! LL
  9. Hi all, Sorry been so long getting back but sent a freedom of Information Request to the council. I received back yesterday and all they have sent is the front it gives me no information at all!! I have emailed Rossendales for information. They have charged me £152.00 more than they should £110.00 is van fees. I cannot believe this company they 1st stated their was only one bailiff present now they have apologised and said their was 2?? stated incorrect time they were at my property I know the correct time as I called the police!! I have told them the levy was illegal still stating it is not and they have charged £10.00 for DVLA check. now they say it still stands and I have to show them a receipt for the vehicles, log book, insurance. I don`t and never have owned the vehicles. I would like to peruse this further with them and the council, just don`t know where to start. I can usually get my head round most things but they are getting me in a right state as I have family problems as well that is taking most of my time. Any help would be really appreciated. Thanks in advance LL:???:
  10. Hi DM, Found this on Money saving expert. LL APRs - The official rate for borrowing Right, now we're going to get a little bit technical. APR stands for the Annual Percentage Rate, and when it's calculated it has to include both the cost of the borrowing and any associated fees that are automatically included. Thus it's meant to give you the overall equivalent cost of a debt. This is from the regulator, the Financial Services Authority (FSA). APR stands for the Annual Percentage Rate of charge. You can use it to compare different credit and loan offers. The APR takes into account not just the interest on the loan but also other charges you have to pay, for example, any arrangement fee. All lenders have to tell you what their APR is before you sign an agreement. It will vary from lender to lender.” The fact it includes charges means sometimes the APR can be a bit confusing. It is possible the interest rate is 14% per annum, but due to charges the APR is 17%, as the impact of the charges adds the equivalent to another 3% interest. Yet this is useful as it allows a true comparison. AERs - The official rate for savings The AER or Annual Equivalent Rate is the official rate for savings accounts, and is designed to allow easy comparisons as it's meant to smooth out the variances between accounts (it's the equivalent of the APR for debts).
  11. Hi HW, Mr **** ********** who was certified at Burnley combined courts on 22.3.2011. you need to phone Public Register of bailiffs on 020 3334 6355 and confirm if he was renewing his certificate and who he was certificated to previously. Sorry I have called he renewed it early and was with with RossRobbers before. I called my partner to come home as there was 4 of them and 2 were trying to force the back door in and 1 was trying to force the window. They then went round the front and were trying to break into the garage and next door`s garage was open and they were in there. shocked at this were the 4 of them still there when the police arrived were they all certificated bailiffs (they should have been). 2 were trainees!!! being taught the illegal way. It was 1 of the trainees that was kicking my back boor!!!! LL
  12. Hi HW, I sent Pt`s letter and I posted there response and mine, here it is again. two cars were on my drive (neither mine) one was my friends who came to see me, the other my partner was doing some work for a friend on there car. Was it one of these cars that she clamped No (Our car we do not tend to park on the drive as it’s an estate and the driveway access is difficult with a long car, also partner self employed so cannot take that.) was it this car she clamped (confirm its the car your husband uses for work but not registered to him there is no notice of seizure against this car ) to many cars getting confused sorry. Yes it was this car and there was no levy as it has never been here before when they are here. I called my partner to come home as there was 4 of them and 2 were trying to force the back door in and 1 was trying to force the window. They then went round the front and were trying to break into the garage and next door`s garage was open and they were in there. LL I have emailed a letter asking for a list of al charges, not replied yet. you posted this on the 31/3 have you still not received a reply (do you have a copy of the e-mail you sent)
  13. Hi HW thanks for the reply. do you know if the 1st&2nd visit fee was also charged for yesterdays visit or were they charged previously. They were charged previously the £120 fee does it state what this fee is for (possibly enforcement fee or van/attendance fee ) regardless of what its for it cant be charged the same day as a levy fee. No the only paperwork she left was pushed through my door as I would not open the door to her, that was a BAILIFF REMOVAL LETTER stating they want the full amount £4630.08 inclusive of costs within 24 hours. The letter was dated had her name on it no time of call and no signature from her. She also left my partner a receipt for the money paid and he agreed to pay £150.00 a month, she said we would receive paperwork in a week?? if we did not then ring them. My partner did sigh something but not sure what, I think it was the agreement to pay. As far as I am aware she did not levy the car just clamped it, the car is not in our name and my partner told her that. LL
  14. ask them regardless of the ownership of the cars you would be interested to know how bailiff Mr xxxx intended to sell the same goods 3 times as you have 3 levy's against the cars. Mrs this time. I was charged £120.00 for yesterday`s visit + £24.50 1st visit 2nd visit £18.00 and £32.00 levy fee. the original notice was for £235.58 my partner paid them £430.08. Also I am unemployed so in the vulnerable category., the only paperwork they put through the door was a Bailiff removal notice, dated not signed or time of visit. They did leave my partner with a receipt for payment and told him we would receive the paperwork for the agreement he made with them in about a weeks time, if not give them a call?? My partner asked for there ID, they said they would show him when the police were there, but by the time the police were there my partner was paying them SO they did not show him anything but she is a registered bailiff I checked. LL
  15. Hi all, Quick question, they clamped the car so my partner paid up. Highlighted in red not been told of charges beforehand, left a receipt for payment a BAILIFF REMOVAL NOTICE, NOTHING ELSE. LL COUNTY COURT JUDGEMENTSThis fee covers all visits made by bailiffs. £45 Charges: Transport of removed goods Reasonable costs. Where no goods are removed, the law doesn’t define charges for attendance with a van. However, it is likely that reasonable costs could be made, provided that goods are levied. See Note Storage of removed goods Reasonable costs. COUNCIL TAX Regulation 45(2) of the Council Tax (Administration and Enforcement) Regulations 1992 For each liability order where no levy is made, £20 for the first or only visit and £15 for a second visit can be charged. For levying distress, the following fees may be charged (or a lesser amount if that would be reasonable) Note: The law does not provide for bailiffs to charge a letter fee. Where the sum due is £100 or less £20 For the next £400 4% For the next £1,500 2.5% For the next £1,500 2.5% For the next £8,000 1% For any additional sum 0.25% Charges: Walking possession fee. See Note A flat rate of £10. Attendance with vehicle/removal/storage Reasonable costs See Note Valuation Reasonable costs, but no charge can be made unless the debtor has been advised beforehand of the charge and how it is calculated.
  16. On all three orders they have charged 1st, 2nd and levy fee`s. And the one my partner paid today £120.00 or a van fee. I do not believe they made a 2nd visit no paperwork was left. I have checked on both bailiffs they are registered. Will do that in the morning. LL
  17. Hi thanks for the quick reply. My partner came back and they clamped his car. I stayed inside home with the doors locked. I told him to get there ID they said they would when the police were here, but they did not. My partner has just paid them £430.08 as he cannot be without his car. They have not left correct paperwork AGAIN. They denied to my partner and the police trying to kick the door in!!!!! have checked the receipt and she is a certified bailiff. I really want to take this as far as I can. My partner has agreed to pay £150.00 a month, but I am not paying them!!!!!! Any help would be appreciated. Many thanks LL
