  1. Yes Andy,I have had letter from local court today. "Unless Claimant files an allocation questionnaire by 12:00 on 21 October 2010 their statement of case shall be automatically struck out." How is it they get all that extra time? Shirei
  2. I decided to phone FOS and they have taken details and given me a ref number for the claim.They have advised that as the questionnaire is relatively new it would be in my best interest to complete the one HFC sent to me also. That way they cannot come up with any excuses for not complying.
  3. I have requested help from FOS with this by email on 30th.Sept. but no reply yet. I think I am going to send this back with duplicates of what I sent before(Consumer questionnaire from FOS website,Complaints letter,and copy of agreement) and just refer all their questions to that.What do you think. They gave me 10 days to reply and their letter was dated 27th so I need to get this away asap. Shirei

  5. Well I phoned the court today and requested a copy of claimants AQ,I was told they do not do that. I have done this for another past case and they did forward me a copy Well I asked her to check if they had sent one and she said mine had gone to the Judge for direction but they have not received claimants AQ. Seems there are rules for us and different rules for them.

  9. Today is the last date for submitting my AQ (which I have done) would this be the same date for claimants AQ?
  10. Yes I know that,but my letter was addressed to Reading.Thats why I couldnt understand the letter being delivered from Birmingham post office.Maybe they have a mail direction to Birmingham.
  11. Something very strange,I posted my claim registered mail to HFC head office in Reading,but when I checked track & trace it says item was delivered from Birmingham office. Anyone had this happen?

  13. No it doesn't Andy, I thought I would put something in Other Information on the lines of Claimant frustrating proceedings and attach copies of my letter and their replies.What do you think?

Pre-Action Protocols Section C This case is not covered by any approved protocol, I have tried to act reasonably in exchanging information/documents relevant to the claim, however the claimant has been unco-operative. On the DATE I wrote to the claimant requesting information pursuant to the CPR part 18, in order that I could investigate their Particulars of Claim, and file a suitable defence. Dear Sir/Madam, Ref – Account no: XXXXXXXXXXX I believe I have been mis-sold a payment protection insurance policy added to the above account and would like to request a full refund of my premiums, plus interest paid. I took out a £6900 loan at your xxxxxx branch on 21/10/2000 and also bought a payment protection policy which would cost me an extra £1800.38 over the life of the loan. The total amount of my premiums plus interest is £ 2980.20. I have enclosed a photocopy of the Agreement for your information. When I took out the loan, I was told that my application would be refused if I did not also buy a PPI policy. The Financial Services Authority’s advice to consumers is that, while it does not breach FSA guidelines, a borrower should not be refused a loan if they choose not to buy an insurance policy. You are not allowed to make PPI a condition of taking out the loan unless you include the costs of PPI in the quoted interest rate, which you did not do. I was not asked whether I already had any existing insurance or employer benefits that would cover my repayments. I do not believe being forced to buy this policy as part of the loan was a fair and reasonable obligation. In forcing me to buy this policy, you have also breached paragraph 8.6 of the Banking Code, to which you are a signatory. I am requesting a full refund of all my insurance payments, plus interest, which total : Total PPI: £1,800.38 Compound interest: £1,179.83 8% on monthly premiums: £1,748.08 8% on difference from date of loan closure: £1,155.50 Total claim = £5,883.79 1) The 8% statutory interest on monthly premiums is paid from date of each repayment, until date of settlement. Now as we cannot know the date of settlement at this stage, I have used 1st September 2010. 2) The 8% on difference is total cost of PPI + compound interest. Ie the difference between what I actually paid and what I would have paid had the PPI not been added. If I do not receive a favourable response from you within 8 weeks of this letter I will pursue this claim through the Financial Ombudsman. Yours faithfully,
  22. Well I have downloaded the questionaire and started to fill in details. I am wondering if I should also send a letter to accompany it? Also as they have stated (in SAR request reply) they do not have an agreement for this account,I however do have all the docs.Should I send them a photocopy of the agreement??? Shirei
