Cheers Andy, I will have a read of the Carey case over the weekend. I have some health issues at the moment and will be at the hospital several times again next week. Will I need to bump this again next? Thanks for you help. Shirei

I believe so,just made me wonder why they have 2 different dates. I think to deem served is 2 days first class and 4 days second class. I am not sure then if you should have 14 calender days or workings days to rectify.

I think the default content is ok ( a discepancy of just over a hundred pounds between Default Notice sum and instructed balance to Sols).These they say were further interest for Feb,March & April. The rectify date was 1st March. They have supplied a copy of default but they have dated it 3 days earlier(typed letterdate,not rectifying date)

What about default notice,is it 14 working days from when it was issued to be compliant?

A copy of the Agreement reconstituted from electronic records held by the Claimant,together with the Terms and Conditions is shown at pages *** of "Exhibit ***.

On the order I was given extended time to resubmit amended defence. In the covering letter from Sols which came with the bundle today,"they look forward to receiving my amended defence,if any,on or before 4pm on 13th December 2010.

Its a bit longwinded with references to attached statements, default and agreement. Is it correct that they should have produced original agreement.if not now then in court. I really dont believe they have an original because we never had a copy either. How about the APR's the introductory rate is wrong on the agreement they have supplied,its the same as the ones they have sent in responce to CCA request, only this time they have entered some APR's.

This was the order I received.

The Judges orders were for a copy of the agreement in accordance with PD 16 C.P.R. I remember a thread somewhere about %'s being wrong on agreements,conflicting with statements but I cant find it.

Have now received new poc and seems in order.A copy of Agreement "reconstituted from electronic records held by the claimant" This one has %'s but do conflict with statements. Think maybe now its time to try and come to payment arrangement.

Well I did request in draft orders documents to clarify the amount in their p.o.c. also a copy of the agreement. I have been given 13th Dec to resubmit any amended defence. Also any party affected by the order has the right to apply to set aside,vary or stay etc..............not more than 7 days after order date.

IT IS ORDERED THAT The Claimant to file and serve fully particularised particulars of claim by 4.00pm on 15th November 2010 to include a copy of the agreement in accordance with PD 16 C.P.R. Also time extended for any amended defence.

I did request a copy but was refused by staff at the court.
