  2. Thank you I will do that this evening when I have a bit more time. I have been out this morning came and pressed 1471 on my landline had a number call I didn't recognise so google'd it and it was Lowell's!! I think I may just tell them if they call again they have the wrong number I may end up saying something to them I may later regret lol. Thanks Again for your advice
  3. Hi, Sorry to keep asking but do I fill the N1 court forms in and use money claim online? and should I also write to Lowell's to say the account is in dispute and not to write again until the dispute has been sorted? After checking my emails last night Lowell's had emailed me pretty much the same as the letter they sent me. Thanks Again In Advance

  5. Hi I'm just looking for a bit of advise as I'm unsure what to do. Here goes I recently DPA'D Littlewoods (the one where you pay the £10 fee) They sent me all the info etc. I tried to reclaim back £240 in late payment fee's (they were all £12 fees) and was told no. I sent them an LBA letter four weeks ago threatening court action received a reply still saying no get in touch with the FOS. Anyway 2 weeks later which was this Friday just gone the 12/4/13 I received a letter from Lowell's saying that they had purchased my debt from Littlewoods and that I had have pay them the £288 instead of Littlewoods. Part of this was for some goods however littlewoods have added approx. £200 in late payment fees over the past year which is why this has got this high. Please help as I am now totally unsure what I need to do. Any advice is greatly appreciated. And Thanks In Advance
  6. Hi, Iv'e had a look online and they only go back a year!! The charges come to £156. I can't see any interest rate tho. I think I may have to SAR Littlewoods as I don't know whats on the statements prior to this. Many Thanks Again Lynn

  8. Hello, I have a littlewoods account for a good 8 or 9 years. I always paid it etc but I am now having trouble financially due to been unemployed. I tried on 3 seperate occasions (by phone) to get my payment due date moved by 3 days to stop incuring the £12 late payment fee but was always told no we cannot change the due date. I owed approx £100 on goods but now owe £245 due to the late charges. I was passed to the internal debt company NDR Money and was suppoed to pay them so much each mont by tempary payment arrangement. (This was equivilent to the minimum payment littlewoods wanted anyway). I cannot afford it so I haven't paid it. Last week I recieved a Default Notice Served Under Section 87 (1) Of the consumer Credit Act 1974 Basically saying if I had to pay them 184.57 before 26/11. I called them on Tuesday last to say that I couldn't pay this amount by that date and was advised to after saying I could pay something but not all of it on the 28/11 that IF it hadn't been passed to an external Debt Collection they MAY try and arrange another tempoary payment plan. Please help and advise as I am unsure what more I can do. Many Thanks In Advance.

  14. Hi Everyone, I'm helping a friend claim back ppi from a credit card she has the statements which she paid 10 for. I've added all the monthly payments up and added interest to each paymant at the rate they were charging her at the time which comes to a total of 445.46. Is there anything else I need to do here or is that it. The statements she has begin from feb 2003 but there is a balance on it so i'm assuming here that the card was taken out before 2003. Does this affect the ppi claim at all? There's so much info to take in i'm starting to get a bit confused Just wanted to double check before we send any letters. Many Thanks For Your Help In Advance
  15. Hello. I'm looking for some advice for a friend of mine. She put her house up for sale in March 2010 when the HIP packs were a legal thing (we know they were abolished on May 2010). Anyway as nobody has been to view etc she has decided to take her house down from sale. However the estate agent has sent her a bill for £475 to cover the HIP pack fees. As part of the contract she signed this was payable upon sale or if contract with them was terminated. I/We were just wondering that now the packs have been abolished does she still have to pay this as they suggest or does she no longer have to pay for this with them been abolished. Many Thanks In Advance
  16. Hi, They wrote and advised me it was a higher lending charge. It may just worth asking them what it is on yours thou just incase is it anything different. Regards Lynn
  17. Hello, A couple of years ago I did an SAR to Halifax for my mortgage account. (I paid it off in 2006 when i moved house). I wanted to try and reclaim the ERC but now know this isn't possible. Anyway I was going through my drawers last night and came accross the paper work so decided to have a nosey at them as you. I noticed on there there was a Loan A and Loan B..... Loan A is quite clearly my mortgage however i'm a bit confused to what Loan B is. It's showing that I was getting charged 70p and 80p a month over the full term of my mortgage it varies each month how much I got charged I assume to do with interest rates etc. It does say the loan amount is £137 and the terms are in length with the time of my mortgage ie 25years then decreasing over the 4 years I paid the mortgage. Out of curiosity today I called Halifax and the lady I spoke to could only see as far back as 2005 assuming this as it's 6 years ago. She said normally Loan B is when there are product fees or insurance added to the mortgage. I had neither of these and explained this to her the only extra I got was a higher lending charge of £299, which doesn't tally up with the £137 Loan B amount. So she was passing it onto someone at the business centre and advised me that they would write to me within the next 7 to 10 working days. Does anybody know what this could be. Any Help/advise will be much appriciated.
  18. I have just rang the national debt helpline for advice and they aked if I had signed an agreement tio pay £71 per month I said no it was verbally agreed on the phone and they confirmed it in writing a couple of days later. He then said theres no fixed arrangenment in place then so they can either ask you for more money and on the other hand I could offer less money. Is this advice correct i'm just getting ideas to try and knock up yet another letter to them Thanks Once Again
  19. Hello, Iv'e not paid them anything 2day I got quite angry and put the phone down in the end. The interest and charges have been stopped for a while. They said it was to prevent it been passed to another DCA who would then probably add costs and interest etc. (Another way no doubt in order to get me 2 pay) I did tell them today I wouldn't pay anything until the 20th Sept when my next £71 was due. Something else I have just remembered about aswel I had online statements with crap1 they email to tell you when it's ready to look at but I went to check it the other day and my online has been suspended due to the status of my account. I may be opening a can of worms here but would they now need to be sending me usual statements through the post? Or will this not apply now the account is in default? I wrote to debitarse a couple of month ago to say that I would only deal with them in writing (the letter whats in the library on here) they passed the letter to crap1 who wrote back and confirmed that they would chase the outstanding debt and didn't see the phone calls as been unreasonable. Perhaps I should of followed this up when they wrote then but I've not had time I'm certianly gonna be making time now is there anything that I can do now? Many Thanks
  20. Hello, Not sure if this is place I need 2 be posting this link but just unsure what do at the minute. Debitarse still have my account and I agreed 2 pay 71 a mth by paymnt plan ealier this month i duly did this in a £35 payment and a £36 payment. They have called this morning saying I havn't stuck to it. They are saying that I paid the £35 on 7/8/09 and didn't enter the payment plan until the 10/8/09 therefore the £35 I paid then doesn't count towards the £71. Does anybody know if this is the case. My letter from them dated 10/08/09 just states that I had agreed to pay them £71 a month and that my first payment needed to be paid by the 20/08/09. Any advise will be much appriciated i'm starting to worry a bit now.
  21. Hi, I'm in the same position as you and I have now decided to complain to the FOS as per the advice in their letter. It's cheaper than going to court and if I'm right in thinking that whilst the complaint is being dealt with by the FOS then the account will still be classed as being in dispute. Good Luck In whatever you decide to do.
  22. Hi, From what I can make out from other threads there is a possibility they may 'copy and paste' your signature. Don't panic though as obviously if they do this then a whole can of worms would be opened from crap 1's point of view as it would be classed as fraud on there part I would of thought. IF you end up complaining to either the FOS or indeed go to court then crap1 would have to show/take the original signed agreement and you would know if this was your signature or not. I'm new to this as well and learning more and more each day but I think what I'm advising you is right. I am by no means an expert but wish I was as I would take these to the cleaners! Can you remember when you applied for your crap1 account? And if you applied by post or over the internet?
  23. Hi, Is that any type of account or just the crap 1 account? Sorry to be a pain in asking so many questions.
