  1. Has anyone had any good news with regards to GMAC? I, like others had tried previously but been told that if we sued they would counter sue and we would be far worse off than them!! They owe us well over £5000, if we can get it that is!! Anyone got any good advice?

    Does anyone have an address for GMAC? We only seem to have an old one and I believe they are now known as something else. Also, has anyone ever claimed and won in getting old fees for missed payment interest and DD fees? And lastly, is there a template I can find on here? This is very daunting!! Thanks, Owena
  3. Hope someone can help please. Last year, we fell into some hard times as my husband, who is self employed, did not have any work for most of the year. I had a loan with HSBC, and we had a joint bank account. To cut a very long story short, we could not afford to pay the loan every month, and even though we told HSBC they kept taking the money out of our joint account, making us seriously overdrawn and well over the limit. Anyway, I made an agreement with their solicitors to make a reduced payment on the loan, but never got any reply from HSBC in regards to the overdraft. Last month they took us to court. I rang Northampton on Monday, and the girl told me to download the forms to offer to make a payment. Today however, we had a letter from them to say it had been transferred to Norwich. So I rang up and was told it was to enforce the CCJ.She told me to ring DG Solicitors up. When I spoke to them, the lady told me that we could make reduced payments but they were going to put a charge on our property and to do this it would cost £260. This has now brought the total to £2400. Is there ANYTHING we can do?
  4. BUMP UP AGAIN Can I get my arrears charges/penalties of £50 per week back. They have offered me £125 for penalties of £10-£15 for not paying by DD but not said a word about arrears charges. Also, only gone back to 04. If they were not legal in 04, they could not have been legal previously. By my reckoning they owe me over £1300.

  8. Wrote to Gmac in 2007 requesting fees back for arrears and no DD set up. They gave us the usual answer and told to go to the FOS, with a 6 month period to do so. Personal circumstances and a bit of a mix up with information about Bank charges being held, stopped us from doing so until a month too late. FOB could then not help unless GMAC said they could, which they obviously said no to. As far as they were concerned case closed and if we wanted to go to court they would sue us!! Anyway, time has gone on and this morning we had a letter from them saying that they owed us £123. No info on how they got that figure. We reckon they owe us £1500. Rang the FSA and they said that it goes back to from August 04 till Nov 09. What about before that then? To be honest, they did not help very much and did not seem to know what it was all about. We left GMAC in August 05. If they were doing things wrong in 04 they must have been doing it wrong before that too. We will write to them again and see what happens, but I'm sure not going to let this just slip by this time. Just afraid of going to court as we cant afford to be sued by them! Any help or suggestions would be very gratefully received. Thanks

  12. What does SAR and POC mean? Last time we spoke Sharpgun, both of us were at the same point - starting with letters again and told to get lost. The man from GMAC even phoned me up and said that if we claimed through court, the would counter claim.

  14. Rang the FO about GMAC not re-opening the case, and they said they could not help unless GMAC said they could, so rang them up and spoke to them. The man I spoke to said they were in their right to charge penalties. I told him we would take the case to court then and he said they would counterclaim and it would cost us a lot more. Scare tactics I guess. Has anyone ever won against these people? We are away for a couple of weeks too, so will start again later. Would appreciate any help available about what happens when you start the court case - it is quite scary!!

We sent a prelim to start again around the same time as you and had a 'get lost' letter in the post yesterday:- Our records show that we have previously outlined our position in our final response dated 13 June 2007. We also reaffirmed our position in our letter dated 06 July 2007. It is for the reasons outlined; we are not looking to re-open your complaint. We consider your complaint closed and as such, we have nothing further to add. It is for this reason we will no longer communicate with you on this matter. We are not satisfied with the outcome of this and will just have to go down the court route now. Will send a LBA to them but dont expect to hear any different. We were hoping that the FOB could help if we started again, as they have just got all our money back from Capital One, but as the 6 months have passed I dont think they can. Has anyone else won against these mobsters?
