Hey Hillsy, be a little more patient. Quite a few have had defence lodged at the last minute, mine & a couple of others were the very end of May. Some jumped up & down, in the past some have not followed advice & tried to get a judgement by default too early (which only delays the process, quite the reverse of what they were trying to achieve) & others waited, most have been paid though. You will get your money back if you plan to end up in court, so do it & pass the time productively. The two weeks since the NW filed defence have been taxing, but when I took my £30 out tonight (having been returned this afternoon) & bought my darling wife a bottle of Bollinger I had the biggest smile on my face for ages. Thanks Will keep U updated ref Barclays & am going to try RBS from 6+ years, wish me luck.

They have paid the charges, they have yet to pay the interest or court fees, I e-mailed them with an up to date figure for the full amount, but I don't think that made a difference. I think it's just time pressures, you will get yours, to be honest I can't believe it's there it was only half-heartedly I checked beacuse Girlybiker got hers today. Good luck SP it'll happen soon. Hi mate, just picked up on this thread after your post on another. We have to wait for communication from your local court for the process to proceed further on a legal basis, I would suggest you start preparing your court bundle, copying statements & correspondence etc, if only that it re-assures & prepares you for the eventuality that it may end in court, but also passes the time. I think they are swamped with claims, i hope we will all get paid before long, other cases would indicate weeks at most, but it may still be the one that ends up with a date & a hearing so we may as well prepare ourselves. I am in the same position on 2 cases, now waiting for a court date from both, it seems to be who is more determined & I think I know the answer.

No offence intended EMT, I received my defence papers from the court in Northampton today & just like my Barclays one it contains the suggestion from them that the AQ be dispensed with unless the local judge specifically requests one. It could be that the court in Northampton is trying to take a lead & speed things up by doing this. For my Nationwide case it has taken 8 days from filing to the next step, I would guess the courts are being swamped. Andrew

Surprised you got time with a new baby andy. Huskyjoe, you are in for a bit more of a wait it would seem, not many people have been paid on request, it takes a court claim & a bit more waiting to prise your money from thier grasp, read up on the next steps & then follow to the letter. Thats what happens when you start the process only knowing a part of it. Unfortunately I took the advice from the MSE website, which is lightweight to say the least, it was only in the later stages after having filed with MCOL that i came across this site (redirected from MSE). I will remember your "comments" before i start on the next lot from the mid nineties, got to be worth a shot. Andrew -

My defence was on the doormat, it should be in the bin, exactly the same as yours. Have to wait & see what happens but i did e-mail eversheds with an offer to settle for the MCOL figure instead of the one your excel file generates which is a bit more. Andrew -

Just like Sittinpretty I received my papers from the court yesterday, NW defends citing that they blah confirm I have an account blah but the blah charges were in the contract blah & they told me they'd charge me blah. Wait now & see what happens BUT I have sent off my latest sheet of figures to the e-mail address @eversheds on the defence papers so.... Andrew -

Hi SP, no I think you are able to claim all back from the time you first started the process + dont forget you will be adding interest all the time as well, where could you get 8% on an investment right now? Guess mine will probabley come soon then. -

Chill girl chill....I am in exactly the same position. My MCOL simply said, you owe me this much money, you took it unlawfully now pay it back, from my perception the MCOL is not a place to go into chapter & verse on the subject, the address you served it to will already have been sent your initial data request, your intial request for the return of the monies & then the demand before court action......it's not your fault they did not respond appropriately, but they will. I know it's hard but keep the faith, i didn't come on to this site untill i had filed with MCOL but it is the same path, we will get our cash back, everyday costs them more.. Andrew

Yeah I know what you mean, there seems to be 3 or 4 of us on the same timescale. I am planning adding some bits to my XJR1300 with some of the cash, I do like the Buell, could maybe find the space for an addition (when I've paid for this one) lol Andrew
