  1. Hi all, Just sent through the t&c's for HSBC (circa 2004) to evidence@consumeractiongroup.co.uk. Hope this will be of help, the big difference between 2004 and 2006 is the following clause is missing from 2006: clause 7.13 states: “We may also charge this fee when your bank account goes over, or further over, any agreed overdraft limit. This fee is to cover our management and administration costs (see the relevant price list for details of the fee)." In fact in 2004's "Borrowing from us section" there are 20 clause's (7.1 - 7.20) whereas 2006 only has 10, what a big difference!!!
  2. Well I have the best news:grin: :grin: ...DG Solicitors has agreed to make an ex gratia payment for the full amount plus the £50 I paid to MCOL (Total £363.83). I sent my bundle on the 22nd May and received a response on the 28th May. I suppose HSBC and other banks are defending against every claim, as the letter they sent me is similar to what other's have receved - which goes to show if you keep pushing they will eventually settle. This forum is awesome!!! Many thanks to all, especially posts from Lateralus, Hagenuk, Gary H, Martin3030, Miss Oceania & Cbrundle.

I wouldn't have done it without your posts: Lateralus, Hagenuk, Gary H, Martin3030, Miss Oceania, Cbrundle etc.... I'd like to post my HSBC Court Bundle. I have taken CAG from Gary H, HSBC 1994 t&C's, Parliament early Day Motion , Australian bank charges report etc... and put them in a rather huge word document (40mb), with evey page numbered, I think many others may find this format useful - How do I go about uploading this??? This win will give me confidence to go after my credit card charges from HSBC also, is this along the same lines? In my letter from DG Solicitors they want me to sign off on this: "I agree not to make any other claims relating to charges for the period stipulate above", if I sign does that mean I couldn't get back any credit card charges within the period....Not sure how to accept the offer without disabling my chance's of getting the credit card charges back - any pointers???

  7. I've tried the Internet Archive wayback machine, and although it has links for the t & c's, they are pdf's and are not available. I too need to send my bundle off on Monday 21st, Tuesday the latest. cbrundle what did u get from HSBCcruscher, can you post it on the forum? I need HSBC t & c's circa 1999!!
  8. Greetings fellow claimants, I am new to the site, but have found the information very insightful, and of practical use to my case. I had a graduate bank account with HSBC which subsequently defaulted and was sent to debt collectors, this has now been paid. I have asked for the last 6 years of bank statements, and found returned direct debit charges which came to £300 quid. In the last few months I've tried to get the money back nicely from the bank but they just were not playing ball. So I decided to put my case through on MCOL, after a court transfer and the bank filing their defense (It's a service they cried ), I now need to put together my case and send a copy to the Judge and HSBC's Solicitors by 24th May. I've got my Statement of Evidence, Statements, Correspondence, Court Bundle and additional supporting info (Peter Mcnamara interview, Unfair fee's Australia media release pdf by Nicole Rich) and am feeling quite confident about things:rolleyes:, but would like to feel super confident:-D. To do that I need a couple of things: Correspondence in which the bank referred to the charges as ‘penalties’, ‘defaults’ or ‘exist to cover costs’. preferably HSBC An old copy of HSBC T & C's circa 1999 If you could point me in the right direction, I would be much obliged!! Also had a thought about waiting til just after the Tom Brennan vs NatWest case (May 21st). If it's a result for the claimant, I could use it as evidence to support my claim - Good/Bad idea??? Can you suggest any other juicy supporting evidence?
