I transferred £150.00 from my joint A&L account to my other A&L account on the 18th Sept at about 8.30 in the morning, I`ve now checked my account online and it shows that my bill payment went in yesterday then after it shows that £20.00 direct debit(which went out last month on the 20th) was taken out and now a £34 charge has been added and put in before both of them on the statement. I rang them up to kick of at them and they informed me that it takes 48hrs to transfer across. Told me I had to write a letter blah blah as there was nothing they could do. Is there any letter template that I can send as I`m well P*$!d. I`ve already got a claim for £2300 that is stayed. But I've managed my accounts better this year so not been charged this year by unpaid charges etc. I`ve looked in library but can`t find anything, just wondered if anyone can help. :mad:
  2. :o Sorry, I am Rubbish, yes I meant 4/8 but I've dyslexic fingers. I was under the impression that both parties had to send the court bundles to each other and the court before the 4/8 otherwise the case get kicks out. Cheers Kay
  3. Hello, Just wondering, I sent both my court bundles out on the 28th July to Wragges and the Court (Rotherham) to be in for the 4th July. Although both my cases are currently stayed, I still haven`t received my Court bundles from Wragges/A&L. Should I still have received them before the said date or doesn't it matter as its stayed.??

Hello, Just finishing my court bundle off and I`m having trouble printing off the terms and conditions for A&L for 2001,2003,2006 and 2007 (as I`m doing two claims am I right in thinking you only need the T&C`s start and finish date for each claim?) been on the wayback machine? and that doesn`t work, I also am having trouble printing off the office of fair trading report April 2006 (OFT842). Can anybody point me the right direction. I`m panick ing a bit as I go on holiday on friday so need to post the bundles out on that day.

Just recieved a letter from Wragges today offering £1100 inc court costs to settle before court, seems they`re going in the right direction but I`m still holding out for £2300, I will send them a letter rejecting their offer but will offer a lower settlemnt of £2000 if they reply before friday 27th otherwise I`ll be posting my court bundles off.

Heyalp:confused: I`m having a total brainfreeze and can`t seem to find a statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise. I`ve looked in the Cag libraries but to no avail, just wondered if anyone could point me in the right direction. Thanks
  9. Nice one, did you have a court date then or did you just say that yours was soon to be set?. I`ve not received a court date yet so might give Wragges a ring tommorrow and see what they say, Well done again!

  11. Hello please could anyone have a gander at m y General Form of Judgement or Order which says Upon the courts own motion. The Court has made this order of its own initiative without a hearing. If you object the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it IT IS ORDERED THAT Dated 04 july 2007 1. The Claimant shall within 28 days of service of this order send to the Defendant and to the Court: a) A schedule setting out each charge repayment of which is sought, showing the date, amount and reason(if any) for that charge being made. b) Copies of any statement or other document relied upon as showing that each and every such charge has been made; c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise. d) Copies of decided cases and other legal materials to be relied upon. It then goes on about what the defendant needs to send. I really only need help with parts c and d as a and b seem straight forward. Thanks James
  12. Hello, Congrats to everyone who have recently won their cases. Yesterday I received my General Form of Judgement or Order for both my A&L accounts that I`m claiming for. The 1st is for roughly £1200 inc interest whilst the second is for £800 inc interest. My local court (Rotherham) have been flooded (no pun intended ) with a load of cases and so I`ve had to wait a while to receive these judgements. Both Judgements state that the Court has made this order of its own initiative without a hearing (When i received notification of the court transfer a few weeks ago, the allocation part was crossed off.) Am I right to believe that because each claim is under £1500.00/allocation part crossed off then the fee is not due. I take it now that I have to sort my court bundle out and post copies to the Court and (Toe) Wragges or is it A&L or do I send to all three???. Just wondered if people slightly ahead of me in their cases could point me in the right direction of court bundles, nudge letters etc. Thanks Jim

  15. Hello again, Does anyone know what I should put in the covering letter to Toe Wragge & CO when sending a copy of charges that A&L owe, looked all over on threads and library put can`t seem to find one? . Thanks
  16. Thanks Alice , Luickily I did use the spreadsheet so each charge has a different interest amount. I think it was only by pure fluke that I did this but thanks for replying as its put my mind at rest and hopefully others starting out who your reply will see how to go about it. Good luck:D

  18. Hello I`m claiming for two different accounts on seperate claims from A&L. The first account total is £1270.70, the second is £868.41. I started with MCOL on the 22/05/07 after getting the usual pathetic offers and many letters refusing my claims. On the 1st june I received a letter from (toe) Wragge & Co enclosing Acknowledgement of service giving notice to claim, then on 8th June received 6 page defence from Wragge & Co. It mentions on section 9 Insufficent Particulars of Claim and mentions about proof etc, similar to what a lot of you have been getting. I`ve not heard anything else from either MCOL or (Toe) Wragge & Co, just wondered if I should have sent a copy of charges to Wragges although they have claim numbers from MCOL, or do I just sit tight and wait for a court date. Ive checked MCOL and it just says defend 22/05/07. Please could anyone clarify if I need to do anything else, also I used the calculator to calculate the 8% interest upto the date claimed and put this on my MCOL claims, is this right or have I made a slight boo boo. Thanks

  20. Hello, Is it just me or did A&L seem to be quicker than usual to send an offer of settlement within a week of starting your MCOL. I got a lower offer with two accounts I have with A&L which was £800 inc my £200 court charges but they owe £2200 plus court charges. I sent the letter of rejection the next day and also happened to get a letter from Wragge Solicitors the same day saying A&L were defending this claim. (With the letter coming within 24hrs of the offer of settlement I think A&L were trying to bully me into taking the lower offer and scare me with the Wragge letter.) Has anyone else had this situation happen to them.
