  1. this is still ongoing, so I am requesting a cca agreement today to see what they have got.

     

     

    they appear to be adding money to my account owed every month but am not sure what for as they are no longer sending statements. Do I need to send another SAR to get this information?

     

    account up to £700 now £300 has been added in the last year as far as I can tell

  2. have never got an offer off rbs and cannot afford mcol at the moment so send a cca off and got back a letter stating they have put my account on hold for 10days and would I please ring them up (lets hope it is not to make a credit agreement in their art dept). Anyway 12 days are up.

     

    they did not acknowledge it was a cca request and I cannot get proof of posting as yet

  3. I would like to charge this rate but it is too complicated for me, I would have to pay someone to work it out

     

    my barclaycard since asking for charges back has gone from 400 to 770 all charges as they have not put me in default but are adding charges every month (no more statements arriving though) + interest at a very high rate:eek:

     

    I am going to cca them this week just in case as if I just go for the charges and 8 per cent I will still be in debt + the fact I cannot even afford to lodge a claim with mcol at the moment

  4. I don't believe anyone has claimed their capital back up to date. You may wish to view tomterm's view on pursuing such a claim.

    money was claimed back in the early days, although the advice now seems to have changed

  5. Thanks I will try that:D, I also want to write a letter to Experian enclosing a copy of the Moorcroft/marshall ward letter admitting there is no credit agreement and ask for the default to be removed, is there a template for this?

  6. sent off a cca request to marshall ward (using same thread as they are part of the Littlewoods group anyway) regarding another account with a small balance a default has been issued which I want removed as it is made of completly of charges anyway.

     

     

    They have wrote back saying the client does not have a cca but I should pay them back anyway as I received the goods and this will help out my credit file.:rolleyes:

     

     

    I want the default removed and need to know how to go about this?

     

     

    also 12 days have just passed should I wait another 30 days before starting anything as they might try to reconstruct an agreement.

  7. is there a letter that I can send to get the documentation for a student overdraft of £2,000,

     

    do they need to keep/supply any documentation?

     

    Can they put markers on my credit file?

     

    I am being hassled by Bryan Carter and need to know what I can send off, I will be putting it into dispute soon for about £300 of charges but need to know what other avenues I can follow.

  8. keep up the fight:), I am in a similar position with littlewoods i.e no credit agreement but being hassled with letters from DCA's and a default on my credit record.

     

    I have finished my law degree and like you are considering studying consumer law as a side interest. I have had some time out from this forum and am trying to get back into it all again, alot of the advice has changed on here regarding CCA's and it is hard to keep up.

        Introduction
         

      1. This chapter provides policy guidance to LAs on how to deal with changes in the circumstances of a student that may have an impact on their entitlement to support, and on the recovery of overpayments of grants and loans from students who have received support under the Education (Student Support) Regulations 2007.
      2. This chapter deals with the following subjects:

            • students who have withdrawn from their course;

            • students who have suspended their study;
            • resuming payment of support; and
            • Recovery of overpayments of loans and grants.

        1. Policy guidance on previous study, including termination of eligibility and LA discretion can be found in the ’Assessing Eligibility’ chapter.
        2. LAs should refer to the ‘Assessing Eligibility’ chapter for policy guidance relating to students transferring courses. In all transfer cases, the written consent of the importing institution is required.
        3. An ‘overpayment’ occurs, for example, when a student’s entitlement is reassessed, and the result of this reassessment is that the annual entitlement to support is reduced to an amount less than that which the student has already been paid, or it comes to light that a student has been paid more than he is entitled to.

        I would be a good (idea if not already done to have a thread with the all the DCA's addresses (without the PO box parts) as I seem to spend longer trying to track down correct addresses than actually writing the letters.

        Have sent off another CCA, but I am going to have to get tough now and start complaining to authorities as no credit agreement exists
