Im in need of advice from anyone who can help......... l have paid my council tax for the past few years by direct debit - at the end of 2006 my arrears were down to about £200 - I was paying £100 a month - a little of this was paying off the arrears. I received the new tax bill and rang them up - they said pay £135 a month and that will pay the arrears off aswell in with it. I told them this was fine and they said they would amend the direct debit. A few weeks later a letter comes saying I have missed the first payment this year so im going to court! - I rang again and the lady said she was very sorry something had gone wrong at their end and the direct debit hadnt been altered but not to worry it was all sorted out now. Around the beginning of June I received a letter saying I was to appear in court on XXX date and that they had also applied charges. I got onthe phone again to the council and the guy at the other end couldnt understand it - he went away and phoned the baliffs office to speak to them - came back and apologised saying the fault was at their end - he's spoken to the baliifs office and it was now all sorted -I asked for confirmation in writing as I was getting worried - he said I would get it shortly but not to worry about it . Today My husband rang me at work - he's come home to find a hand delivered letter from the balliffs demanding the money along with nearly £300 charges!! - he went on the phone and the baliff said he didnt know what was going on because hes not normally in the office - and he would ring back when hed investigated.He rang back and said the problem appeared to be that they didnt have my bank details!! -( how come theyve had their money from my account all this time then?)anyway my husband gave him the details to stop anything else happening and they said it should be ok now. Im absolutely raging at this - im frightened to come home from work now at night incase more baliffs have been - I want to write a letter tomorrow to the council offices who kept telling me it was sorted out and I also want to tell them where they can stick all their charges cos Im not paying them - I think they should be paying me - to compensate for the stress they have put me under!! Anyone any ideas what I could write?:?

My friend rang the store today armed with this information and was told that they donated to the re-cycling fund do they were therefore not obliged to take any olde appliances away - my friend sais under the new law they have to and the lady said - no I have a plaque on the wall here telling me WE dont have to because I donate!:? is she right? there seems to be much confusion over this law - some say they are obliged to do it and some say they are not , if they are then people are wasting their money paying their council to do it - I think we need some clarity on this - any experts in here can advise please?

  4. Im sure there wa sa law passed in april something to do withe new WEEE legislation that means shops are obliged to take your old appliance away free of charge - anyone know of this?

A friend of mine bough a new fridge from a very big department store and has been quoted £15 by the local council to remove and dispose of the old one, but I thought the new ruling on this in July meant that if you buy a new appliance then the shop is obliged by law to offer top take away the old one free of charge? If this is so can he ring them up after he has now had delivery of the new one and demand that they remove the old one free of charge because they forgot to mention it to him at the time?

I dont think people have yet quite grasped the laws on using their mobiles whilst driving - and the police cant get that under control - so how they gonna manage stopping people smoking? - They need to get a grip of the 'mobile' situation first - which also is supposed to be against the law - but some people think it just applies to others and not them - you give them a disapproving look and youusually get the one finger sign - imagine giving a disapproving look at a group of drunks smoking where they shouldnt be - it wouldnt just be a one finger sign you got I bet.... I dont think the policing of this law has been thought through properly at all, same as the mobiles law. I hear now that the schools are thinking of writing to parents telling them their children are fat aswell - what next?
  7. Only have t&c for the credit card - it makes referneces to optional payment protection on one and worded slightly different ont he other t&c(my hubbys). I can email them to you if you pm me with an email adress cos I cant seem to send an attachment from my pm's.Also says in the t&c that they use London General Holdings group.

I had a bit of a clear out of my old handbags and drawers and I found things I didnt know I had! - Ive now got t&c on a few credit cards and I found another unused credit card still attached to the original agreement from citi-cards!. I have what is apparently a copy of my capital one agreement - but the space where my name and address go on the front cover are blank;) - also found a leaflet saying - your FREE purchase protection insurance policy(capital one)also Barclaycard original t&c and policy registration and a schedule for barclaycard payment protection dated 05/04/02 - dont think i'll be needing to bother them all now for things - I seem to have them HELLHASNOFURY - ive pm'd you with my final 'claimants text' - would you look it over please - thank you:-)

  11. yep - no problem:) Thats what I wanted to see - the terms and conditions for the ppi from capital one - but they just wont send me them! Do you mean that there was nothing onthe form that ASKED if you had any underlying medical condition or that they said they would still pay out because it didnt matter that you had an underlying condition?
  12. I am also an ex-smoker , Ive smoked for 30 years and gave up in february. I feel sorry for the likes of pensioners who meet in working mens clubs for a drinkand a game of cards or dominoes - some of them its their only pleasure and yet they now cant smoke in clubs - there are many examples like that - yet in parliament they have allowed themselves a place to carry on smoking - how fair is that? in prisons they can still smoke - how fair is that? so murderers,rapists,paedophiles etc all have more rights than a model citizen - because he chooses to smoke? what about smokers human rights? - youre being told you cant smoke in your own home if you are expecting someone in authority calling , you cant smoke in a vehicle if it is used by other people or owned by a company - shortly we will see 'smoke police' - out in marked cars waiting to put the sirens on and chase cars where someone has dared to light up!. - where will it all end - soon we will see the adverts on the telly - "have you taken a lift from a smoker recently or in the past at any time? - well now you can claim compensation" - oh yes im just waiting to see that one appear on telly!! - the drink is next - theyre going to tell you how much you can drink in your own home - yes your OWN home ! - I saw something about that on telly the other week and of course how can we leave the fat people out? - yes soon we will see the FAT police - fining anyone who is overweight - its all gonna happen - watch this space........:-|

They owe me over £600.00 I reckon in ppi . I have ben waiting to see how others have handled their claims for ppi against capital one but so far most ppi claims are to do with loans, so Im going to take the plunge and put this claim into MCOL today - I'll keep you updated as to what happens. you might wanna take a look through my thread - megan v capital one ppi - hellhasnofury has given me some advice on what to say inthere - take a look might be something of use to you in there.

  16. Do I now just wait to hear something from the court - I havent been told to fill anything in - is that not necessary for a set aside hearing? Do I just turn up onthe day ?advice please.
  17. Yes I claimed 8% on others I was just going to give it a shot on this one but I cant make head nor tale of it! - I dont want to risk making mistakes so ive just added 8%

They didnt acknowledge my claim either - I was going to issue a warrant on mcol as it says you can - but after reading this forum I realised what they were up to - I just knew they were going to ask for a set-aside because they didnt receive the original claim - and thats exactly what they did -you'll probably receive notice of this inthe post inthe next few days - theyll want a hearing for a set aside probably citing their latest 'potter v citicards'. I wouldnt waste any more of your money for a few days because they will have asked for a set aside of any judgment or warrant' - give it a few days and see if im right:cry: before parting with your money. - I now have a set aside hearing date for the middle of september - this of course delays things even more int he hope that I will get sick and give up - but they havent got a hope in hells chance of that - cos it just makes me more determined to win:pand im in no hurry!

  20. yep - start telling them you are going to get a court order to MAKE them hand over the information - they tried it with me - they sent 2-3 years worth of statements after 50 days then kept fobbing off with we are very busy and need more time when I asked for the rest - inthe end I told them they had 7 days to comply otherwise Id get a court order to make them comply - got statements withing 7 days:)I think its important not to give them too much time - if you specify 14 days then after 14 days chase it up otherwise they think youre just gonna forget it - keep on at them - stick to your dates you give them! - it shouyld never have taken from February for you to just be at this stage now - go after them!
  21. I just found my last credit card which came from them but I didnt even take it off the attached agreement! - its still not activated - so I have that agreement if you would like it - the card starts 08/05 - so I must have had it 2 years, if its any good let me know.
