  1. Has anyone had this happen to them? are they now trying to stop these claims by charging us hoping to put us off ?
  2. In the template library under wasted costs order- Bankfodder says: This application can be made by letter without a fee and there is no risk involved. You should keep your estimate of the time which you have spent moderate and convincing. You must lay out the work you have done and the expenses you have covered systematically in a spreadsheet. To make a wasted costs order you must supply:- Application letter Draft order Schedule of costs incurred and time spent list of settled cases for your bank taken from our litigation section (best entered into a spreadsheet) - just list the claim number and the bank and amount settled. ............................................. I submitted one for £47 , today it came back from the court with a letter stating that I can apply on an N244 application form together with a draft order but the fee for the application is £35. cheque or postal order to be made payable to 'HMCS'. They have returned all my forms I sent them - the ones I was told on the forum to send - and it was supposed to not cost anything to do this - how come they are now charging? it isnt worth taking a gamble and paying out £35 to claim back £47.
  3. I am just about to put this into mcol myself - they said exactly the same to me - they owe me over £600.! Im trying to find out if I would be liable to pay the court costs if I lose before I put it in - I havent claimed PPI back before.:?
  4. It cant be the amounts - they settled mine - £870 and yet want to go to court for my husbands - £980. only £110 in it! As I say if a payment was late on one it was late onthe other - I paid them both together - and they were both paid off together at the beginning of the year - both claims are same - but We are curious as to their explanation of why they are both being treat totally different - I would think the judge would like to know the answer to this one aswell....:confused:and yes Enron I think your notes are gonna come in handy at hubbys court case in september - thanks.

Id like to ask her why in my hubbys case - after issuing judgement by default - citi decided to ask for a set aside and now have a court date to defend their case as they think they can win - yet with me after issuing a judgement by default - they send me a cheque within a few days in full settlement - how on earth do they work? both cards were paid off and both cases were identical so how come theyre fighting one and paying up no questions asked on another? very strange - must admit the notorious Brian was very nice to me in his setlement letter - never had any bother from him at all.

I just rangthe court before and apparently they didnt receive my original wasted costs claim - nor my husbands - sent in a seperate envelope! - so Im having to resend them - recorded delivery this time I think!.

  11. Claiming back: Capital one - £1622.66p – settled in full Capital one - £632.69p – settled in full Capital one - £ 353.15p – settled in full Citicards - £ 790.00p – MCOL - 15th June - WON!! Citicards (OH) £941.56? – asked for judgement - CITI requesting set aside - court sept. Barclaycard – - made silly offer! Studiocards £422.44p – settled in full Lloyds - £35 – settled in full + ex gratia payment of £25 Halifax bank account - £39 - settled Halifax visa – awaiting S.A.R - (Subject Access Request) .......................... Cant fathom this out - both my OH and myself had citicards - both paid them off beginning of year - both submitted mcol claim , OH - Citi say they are defending - have asked for a setaside of judgement by default because they say they didnt get the original claim and are defending because they say they have a good chance of winning. ME - they didnt send their defence in after a further 14 days ,I issued a 'judgement by default' - same as OH did - that was a week ago - this morning a cheque arrived in post for full settlement.:o - I was expecting them saying the defence had been lost in the post and was prepared for a court date. I dont understand how 2 identical claims can be treat so different - one they defend and one they settle in full:confused:

  13. Only you can decide on that one - depends on how much of a gamble your willing to take on them paying up or sticking to their guns.

Well I have to sadly say that I have now come to the conclusion that although you may be a model citizen, struggled to pay off what you owe (never lying your way out of things), never been in trouble witht he police and worked all your life since leaving school - you get no thanks for it - infact id say your actuallly treat worse! - your more thought of if youre a lazy lay about - youve never worked - claim dole, do a fiddle job ( no tax or stamp to pay ) and claim every benefit you can.and youre richer!!

Yep - you can batter someone senseless and get off with a fine or a suspended sentence - but owe inland revenue money and they want to put you in jail!!:o owe council tax 'IN ADVANCE' payments and they wanna take your furniture away! - its crazy. RE: my post on council tax above - I have just wrote a 2 page letter - sending a copy to the head of the council tax department and a copy to my local councillor - I know him actually so he might do something about it.

Its worth sending him a copy I suppose:| didnt think they would get involved buit its worth a try cos im not taking this - I want to write to someone whos going to do something about it cos ive just looked again and they have actually had their court date and been granted a liability order against me!! - can this be lifted?

Re: my above post: I rang the council offices today to ask them what the problem was before I wrote to them - and I was put through to the mose snottiest jumped up little Sh** - he spoke to me like he's just scraped me off the sole of his shoe! - I asked him why this was the 4th time Id had to phone to try and put this right and why each time I had been told it had been sorted out - his reply was " I sorted this out with your husband yesterday so what is the purpose of your call?" I told him the purpose was to find out why they were keep saying they wanted money when it was supposed to be sorted and he said - but we havent had the money - thats the problem !! then the phone went dead- and it wasnt from my end!! - im gonna write such a letter of complaint - who the hell do they think they are talking to?

I agree and I usually always do everything by writing but when you come in from work and you see these letters - and baliffs have been to your door - you want to get it sorted out by phone quickly to stop the worry over it - but im definately gonna be doing some complainng by letter this week!
